Official Journal EN of the European Union L series 2025/2209 5.11.2025 COMMISSION DECISION(Euratom) 2025/2209 of 31 October 2025 on the conclusion, by the European Commission, on behalf of the European Atomic Energy Community, and provisional application of the Agreement between the European Union and the European Atomic Energy Community, of the one part, and the Swiss Confederation, of the other part, on the participation of the Swiss Confederation in Union Programmes THE EUROPEAN COMMISSION, Having regard to the Treaty establishing the European Atomic Energy Community, and in particular Article 101, second paragraph, thereof, Having regard to the approval of the Council, Whereas: (1) By Decision(1), the Council approved the conclusion, by the European Commission, on behalf of the European Atomic Energy Community, of the Agreement between the European Union and the European Atomic Energy Community, of the one part, and the Swiss Confederation, of the other part, on the participation of the Swiss Confederation in Union Programmes (‘the Agreement’), including its provisions on provisional application, as regards matters falling under the Treaty establishing the European Atomic Energy Community (the ‘Euratom Treaty’). (2) The Agreement should be concluded on behalf of the European Atomic Energy Community, as regards matters falling under the Euratom Treaty. The conclusion should take place at the same time as the conclusion of the other elements of the broad package of measures related to bilateral relations with the Swiss Confederation and as an integral part of that package. (3) The Agreement should be applied provisionally by the European Atomic Energy Community, pending its entry into force, as regards matters falling under the Euratom Treaty. (4) The signing, provisional application and conclusion of the Agreement, as regards matters falling under the Treaty on the Functioning of the European Union, is subject to a separate procedure, under that Treaty, HAS DECIDED AS FOLLOWS: Article 1 The Agreement between the European Union and the European Atomic Energy Community, of the one part, and the Swiss Confederation, of the other part, on the participation of the Swiss Confederation in Union Programmes(2) is hereby approved on behalf of the European Atomic Energy Community, as regards matters falling under the Euratom Treaty. Article 2 Following its signature, and subject to reciprocity, the Agreement shall be applied provisionally in accordance with its Article 18.
