of 28 July 2023
specifying the content and format of the questions and laying down the additional set of
predetermined questions for the European Travel Information and Authorisation System (ETIAS)
pursuant to Articles 17(5) and (6) of Regulation (EU) 2018/1240 of the European Parliament and of
the Council
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2018/1240 of the European Parliament and of the Council of 12 September 2018
establishing a European Travel Information and Authorisation System (ETIAS) and amending Regulations (EU)
No 1077/2011, (EU) No 515/2014, (EU) 2016/399, (EU) 2016/1624 and (EU) 2017/2226(1), and, in particular,
Article 17(5) and (6) thereof,
Whereas:
(1) Regulation (EU) 2018/1240 established the European Travel Information and Authorisation System (ETIAS) for
third-country nationals exempt from the requirement to be in possession of a visa when crossing the external
borders. It laid down the conditions and procedures for issuing or refusing a travel authorisation.
(2) As part of the ETIAS application form to be completed by each applicant, applicants should provide information
related to their criminal convictions, their stays in specific war or conflict zones and decisions requiring them to
leave the territory or to return, as well as related additional questions. This Decision should specify the content and
format of the questions on those points.
(3) Where applicants answer affirmatively to any of the questions referred to above, they will be required to provide
answers to an additional set of predetermined questions. This Decision should also lay down the content and format
of related additional sets of questions and answers. For the latter, the applicant should choose answers from a
predetermined list of answers.
(4) The list related to a stay in a specific war or conflict zone should be based on reliable and commonly recognised data
reported on subnational-level specific war or conflict zones. To that end, the list should be established on the basis of
data published by independent and internationally recognised institutes dedicated to the distribution of knowledge
about the emergence, course and settlement of political conflicts.
(5) The application forms should be designed so as to ensure that family members of a Union citizen to whom
Directive 2004/38/EC of the European Parliament and of the Council(2)applies or of a national of a third country
enjoying the right of free movement equivalent to that of Union citizens under an agreement between the Union
and its Member States on the one hand and a third country on the other should not reply to questions that relate to
decision(s) requiring them to leave the territory or to return.
(6) This Decision is without prejudice to the application of Directive 2004/38/EC and of the Agreement on the
withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the
European Atomic Energy Community(3).

(7) Given that Regulation (EU) 2018/1240 builds upon the Schengen acquis, in accordance with Article 4 of Protocol
No 22 on the position of Denmark, annexed to the Treaty on European Union and to the Treaty on the Functioning
of the European Union, Denmark notified the implementation of Regulation (EU) 2018/1240 in its national law.
Denmark is therefore bound by this Decision.
(8) This Decision constitutes a development of the provisions of the Schengen acquis in which Ireland does not take
part(4); Ireland is therefore not taking part in the adoption of this Decision and is not bound by it or subject to its
application.
(9) As regards Iceland and Norway, this Decision constitutes a development of the provisions of the Schengen acquis
within the meaning of the Agreement concluded by the Council of the European Union and the Republic of Iceland
and the Kingdom of Norway concerning the latter’s association with the implementation, application and
development of the Schengen acquis(5), which fall within the area referred to in Article 1, point A of Council
Decision 1999/437/EC(6).
(10) As regards Switzerland, this Decision constitutes a development of the provisions of the Schengen acquis within the
meaning of the Agreement between the European Union, the European Community and the Swiss Confederation
on the Swiss Confederation’s association with the implementation, application and development of the Schengen
acquis(7), which fall within the area referred to in Article 1, point A of Council Decision 1999/437/EC, read in
conjunction with Article 3 of Council Decision 2008/146/EC(8).
(11) As regards Liechtenstein, this Decision constitutes a development of the provisions of the Schengen acquis within the
meaning of the Protocol between the European Union, the European Community, the Swiss Confederation and the
Principality of Liechtenstein on the accession of the Principality of Liechtenstein to the Agreement between the
European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association
with the implementation, application and development of the Schengen acquis(9), which fall within the area referred
to in Article 1, point A of Decision 1999/437/EC read in conjunction with Article 3 of Council
Decision 2011/350/EU(10).
(12) As regards Cyprus, Bulgaria and Romania, this Decision constitutes an act building upon, or otherwise relating to,
the Schengen acquis within, respectively, the meaning of Article 3(1) of the 2003 Act of Accession and Article 4(1)
of the 2005 Act of Accession.
(13) The European Data Protection Supervisor was consulted on 7 July 2022 and delivered an opinion on 3 August
2022,

HAS ADOPTED THIS DECISION:
Article 1
Subject
This Decision establishes the format and contents of the questions and answers to be included in the application form for
the purposes of Article 17(4) of Regulation (EU) 2018/1240 and the additional set of predetermined questions and
answers pursuant to Article 17(6) of that Regulation.
Article 2
Content and format of questions and predetermined set of questions and answers related to criminal offences to
be declared in the application form
1. The applicant shall be presented with the following questions:
(a) ‘Have you been convicted in the last 15 years of one or more of the criminal offences listed below?’; and
(b) ‘Have you been convicted in the last 25 years for terrorist offences?’.
In relation to point (a), the applicant shall be presented at the same time with a list containing the criminal offences listed in
the Annex to Regulation (EU) 2018/1240. The applicant shall be requested to answer the question for each criminal offence
by selecting an answer from a predetermined list comprised of the fields ‘yes’ and ‘no’. The applicant shall also be presented
with the option to answer ‘no’ all at once for the criminal offences listed in relation to point (a).
In relation to the question referred to in point (b), the applicant shall be requested to answer by selecting an answer from a
predetermined list comprised of the fields ‘yes’ and ‘no’.
2. Where a positive reply is provided for the questions referred to in paragraph 1, the applicant shall be presented with:
(a) the following instruction: ‘Please indicate the country of conviction as well as the date of each conviction and provide answers to
the additional questions.’;
(b) a predetermined list of countries;
(c) a fixed format field for the completion of the dates (day – if available/month as word/year); and
(d) a predetermined list of additional questions.
For the purpose of point (c), it shall not be possible to select a conviction date earlier than 15 years for criminal offences or
25 years for terrorist offences from the date of the application. In addition, the applicant shall be informed that the word
‘conviction date’ shall be understood as the date of the official judgment issued by a court.
For each category of criminal offences, the applicant shall be able to record multiple convictions, countries and dates.
3. The predetermined list of additional questions referred to in paragraph 2, point (d), shall be the following:
(a) ‘Is the conviction final?’; and
(b) ‘Have you completed that sentence?’.
The applicant shall be requested to answer the questions referred to in points (a) and (b) by selecting an answer from a
predetermined list comprised of the fields ‘yes’ and ‘no’.
For the purpose of point (a), the applicant shall be informed that the word ‘final’ shall be understood as convictions that
cannot be subject to further appeal at national level.

4. For the predetermined list of countries, the ISO 3166-1 standard shall apply (or newer version), including countries
that no longer exist but have existed in the last 25 years.
Article 3
Content and format of questions and predetermined set of questions and answers related to a stay in specific war
or conflict zones to be declared in the application form
1. The applicant shall be presented with:
(a) the following question: ‘Have you stayed in one or more of the following areas in the past 10 years?’;
(b) a predetermined list of countries within which the specific war or conflict zones, established in accordance with
Annexes I and II, are located, containing, for each country, selectable fields ‘yes’ and ‘no’; and
(c) for each country selected as ‘yes’, a predetermined list of specific war or conflict zones located within that country and
established in accordance with Annexes I and II, containing, for each war or conflict zone, selectable fields ‘yes’ and ‘no’.
The applicant shall also be presented with the option to answer ‘no’ all at once for the countries listed in relation to point (b)
or for the specific war or conflict zones listed in relation to point (c). Where the applicant answers ‘no’ all at once for the
countries listed in relation to point (b), the ETIAS information system shall automatically answer ‘no’ for all the specific
war or conflict zones listed in relation to point (c).
2. Where a positive reply is provided to the question referred to in paragraph 1, the applicant shall be presented with:
(a) the following instruction: ‘For each area selected as ‘yes’, please indicate the period(s) and the main reason(s) of each stay. Where
required, please provide replies to additional questions.’;
(b) a fixed format field for the selection of the start and end of the period (day – if available/month as word/year) for each
area selected and the possibility to enter multiple periods; and
(c) reasons and sub-reasons for each stay.
For the purpose of point (b), it shall not be possible to select a start date of a period earlier than 10 years from the date of
the application. The applicant shall be informed that, if their stay started on a date earlier than 10 years from the date of
application but finished on a date within that 10-year period, the applicant shall select the earliest applicable date as the
start date of their stay.
The ETIAS information system shall determine automatically, based on the applicant’s reply, whether the applicant was
present in an area in a period during which it was considered to be a specific war or conflict zone, in accordance with
Annex II to this Decision. For the purpose of the application form, the ETIAS information system shall only record those
relevant periods of stay.
3. The reason(s) and sub-reason(s), where applicable, referred to in paragraph 2, point (c), shall be:
(a) permanent residence or citizenship;
(b) family visit:
(i) parents;
(ii) grandparents;
(iii) children;
(iv) grandchildren;
(v) brother/sister;
(vi) spouse/partner;
(vii) other;

(c) friend visit;
(d) tourism;
(e) professional reasons:
(i) governmental work;
(ii) humanitarian assistance;
(iii) international organisation;
(iv) journalism;
(v) military mission;
(vi) posted work;
(vii) business trip/congress/conference;
(viii) other;
(f) other.
Selection of at least one reason and, where available, at least one sub-reason shall be mandatory.
Selection of multiple reasons and sub-reasons shall be possible.
4. The applicant shall be presented, for each selection made pursuant to this Article, with the following additional
questions:
(a) ‘Are you planning any further trip to this area within the next 3 years?’
(b) ‘With what frequency?’
The applicant shall be requested to answer the question referred to in point (a) by selecting an answer from a predetermined
list comprised of the fields ‘yes’ and ‘no’.
If the applicant has answered ‘yes’ to the question referred to in point (a), they shall be requested to answer the question in
point (b) and shall be presented with the following predetermined list of answers:
(i) several times per week;
(ii) once per week;
(iii) more than twice per month;
(iv) twice per month;
(v) once per month;
(vi) more than three times per year;
(vii) three times per year;
(viii) twice per year;
(ix) once per year;
(x) more than twice within the next three years;
(xi) twice within the next three years; and
(xii) once within the next three years.
Article 4
Content and format of questions and predetermined set of questions and answers related to decisions taken
against the applicant to leave a territory or return to be declared in the application form
1. Without prejudice to Article 24(2)(a) of Regulation (EU) 2018/1240, the applicant shall be presented with the
following questions:
(a) ‘Over the past 10 years, have you been subject to one or more return decisions issued by an EU Member State or any third country?’

(b) ‘Over the past 10 years, have you been subject to one or more decisions requiring you to leave the territory of an EU Member State or
of a third country listed below?’
The applicant shall be requested to answer the questions referred to in points (a) and (b) by selecting an answer from a
predetermined list comprised of the fields ‘yes’ and ‘no’.
For the purpose of point (a), the applicant shall be informed that the word ‘return decision’ shall be understood in
accordance with Article 3(4) of Directive 2008/115/EC of the European Parliament(11).
For the purpose of point (b), the applicant shall be informed that the word ‘decision requiring to leave the territory’ shall be
understood to mean any administrative or judicial decision or act, different from a return decision, requiring the applicant
to leave the territory of an EU Member State or of any third country.
2. Where a positive reply is provided for question (a) in paragraph 1, the applicant shall be presented with:
(a) the following instruction: ‘Please specify the country, the date of the decision and answer additional questions.’;
(b) a predetermined list of countries comprised of: the Member States; the third countries listed in Annex II to Regulation
(EU) 2018/1806 of the European Parliament and of the Council(12); and the list of countries of the ISO 3166-1
standard (or newer version), including countries that ceased to exist during the previous 10 years from the moment of
application; and
(c) a fixed format field for the completion of the dates (day – if available/month as word/year), where it shall not be
possible to select a start date of a period earlier than 10 years from the date of the application.
3. Where a positive reply is provided for question (b) in paragraph 1, the applicant shall be presented with:
(a) the following instruction: ‘Please specify the country, the date of the decision and answer additional questions.’;
(b) a predetermined list of countries comprised of the Member States and the third countries listed in Annex II to Council
Regulation (EC) No 539/2001(13); and
(c) a fixed format field for the completion of the dates (day– if available/month as word/year), where it shall not be possible
to select a start date of a period earlier than 10 years from the date of the application.
4. Where a positive reply is provided for one or both of the questions in paragraph 1, the applicant shall also be
presented with the following additional question for each positive answer: ‘Did you remain on the said territory or country
after the decision was issued?’
The applicant shall be requested to answer the question referred to in this paragraph by selecting an answer from a
predetermined list comprised of the fields ‘yes’ and ‘no’.
Article 5
Changes in the predetermined lists
In the case of an amendment to the predetermined lists referred to in Articles 2 to 4:
(a) eu-LISA shall implement without delay the necessary changes to the predetermined lists;

(b) the European Border and Coast Guard Agency shall implement changes to the factsheets referred to in Article 16(4) of
Regulation (EU) 2018/1240 and the information to the general public referred to in Article 71 of that Regulation, if
necessary;
(c) eu-LISA shall communicate the changes in the predetermined lists to the Central Unit and National Units, 20 days
before the changes become effective;
(d) the date of effect of the change shall be recorded in the Central System.
Article 6
Entry into force and applicability
This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the
European Union.

ANNEX I
The methodology to establish the list of specific war and conflict zones (referred to in
Article 3(1)(b))
This Annex lays down the methodology to establish the list of specific war and conflict zones referred to in Article 3(1),
point (b). The methodology is composed of the following steps:
(a) yearly extraction of data from the Heidelberg Institute for International Conflict Research (HIIK) databases(1),
corresponding to the following cumulative criteria:
— political conflicts corresponding to intensity levels 4 (limited war) and 5 (war), with the exception of conflicts solely
between drug cartels or drug trafficking organisations;
— conflicts having occurred at subnational level outside of the EU;
— conflicts having occurred in the previous 10 years;
(b) presentation of the extracted data, in the form of a list, for consultation to the ETIAS sub-group of the Expert Group on
Information Systems for Borders and Security (‘the ETIAS subgroup’);
(c) adoption of the list by the Commission following the consultation of the ETIAS subgroup, as Annex II;
(d) by March, the year following entry into operation of ETIAS and every year thereafter where amendments are needed,
revision of the list following steps referred to in points (a), (b) and (c).
