(2) According to point 5.10.2.4 of the Table of priority of trackside supported levels of the Annex to Regulation (EU) 2016/919, when receiving the information about all European Rail Traffic Management System (ERTMS)/ European Traffic Control System (ETCS) levels that are supported by trackside, the ERTMS/ETCS on-board equipment is to select from the table the level with the highest priority which is available for use by the onboard equipment. The applicant requested the possibility to have an additional function ‘ATB-only’ implemented in the onboard control-command and signalling (CCS) subsystem. The ‘ATB-only’ function is to allow train drivers not yet trained for ETCS operations to operate the train on conventional ATB lines and also on so called ‘dual-signalling lines’ (ATB with ETCS level 2 overlay) in the Netherlands while they complete their training. (3) After the submission of the request, Regulation (EU) 2016/919 was repealed by Commission Implementing Regulation (EU) 2023/1695(3). In substance, the obligation to select ERTMS for train operations, without the possibility of using a Class B system laid down in Table A 2.2, Set of specifications #2, ETCS BL3-MR1, Index 4, Subset-026-5 v3.4.0, paragraph 5.10.2 of the Annex to Regulation (EU) 2016/919 is laid down in Table A 2, Index 4, Subset-026, point 5.10.2.4 of Appendix A of Annex I to Implementing Regulation (EU) 2023/1695. Therefore, the original request should be considered a request temporarily not to apply Table A 2, Index 4 Subset-026, point 5.10.2.4 of Appendix A of Annex I to Implementing Regulation (EU) 2023/1695. The vehicles are individually listed in the Annex to this Decision. (5) These ICNG trainsets are equipped with a certified onboard ERTMS signalling subsystem according to Regulation (EU) 2016/919 TSI CCS, Annex A, Set of specifications #2, ERTMS Baseline 3, Maintenance Release 1 (BL3-MR1). Two signalling systems are supported: ERTMS (level 0, level 1, and level 2) and the Class B system ATB-EG/Vv, the Dutch legacy signalling system. The ICNG trainsets are expected to perform services between Amsterdam – Utrecht (35 km) and the Hanse line (46 km). These are high-capacity lines in the Dutch railway network. (6) The request is based on Article 7(1), point (c), of Directive (EU) 2016/797. According to the Netherlands, if NS was required to put into service vehicles fully equipped with ETCS, that is, the part of ERTMS used for train operations, without the possibility of using a Class B system, there would be a very high financial impact, due to the insufficient number of ERTMS certified drivers for the trains and the inability to exploit optimally the rolling stock. (7) On request of NS, an additional function ‘ATB-only’ should be implemented in the onboard CCS subsystem. The ‘ATB-only’ function allows train drivers not yet trained for ERTMS operation to operate the train on so called dual signalling lines (ATB with ERTMS level 2 overlay) in the Netherlands. There are currently two dual signalling lines in operation in the Netherlands: Hanse line and Amsterdam-Utrecht. The ‘ATB only’ function will only be used for a limited period of time, during which lines are converted to ERTMS-only lines and train drivers are trained. After that period, the ‘ATB only’ system should be disabled. (8) Having the ‘ATB only’ function would create operational flexibility. Without the ‘ATB only’ function, the ICNG train could only be operated under ERTMS on the dual signalling tracks. There is a deployment plan to match ERTMS equipped trainsets with ERTMS trained drivers. However, NS will not be able to train a sufficient number of train drivers to fully operate the ICNG fleet on ERTMS basis by 2025, but can only complete such drivers’ training by 31 December 2029. (9) The 78 new vehicles ICNG will operate using the ‘ATB-only’ function only on the dual signalling lines Amsterdam – Utrecht (35 km) and the Hanse line (46 km). In 2026, the Hanse line will become an ERTMS only line, the ‘ATB-only’ function will then only be used on the Amsterdam – Utrecht line until 2029. (10) The ICNG trainsets are expected to be integrated into the timetable starting in 2025 to replace the current Intercity Materieel (ICM) trains. However, part of this fleet could not be used if the ‘ATB only’ function was not yet installed due to the lack of ERTMS trained drivers certified to run the new ICNG trains. As a result, the timetable could not be changed as of 2025 and the ICM trains could not be phased out, because they would be needed to serve traffic flows on the Hanse line. The extra costs for NS for having ICNG trains on standby but not used in operation over the period 2025-2029 is estimated to be EUR 31 million. (11) According to the information from the Dutch national ERTMS implementation plan, ERTMS is first installed in the trains and then the tracks are converted into ERTMS only tracks. Without the ‘ATB only’ function, the ICM trainsets would be kept in use for a longer time. If ERTMS was not installed in part of the new/retrofitted fleet, there would be bottlenecks in the deployment of train drivers and rolling stock turnover. There would also be less rolling stock available for gaining experience with driving with ERTMS. The training of train drivers would risk being delayed to such an extent that the roll-out of ERTMS in the infrastructure would be delayed by several years. 2/7 ELI: http://data.europa.eu/eli/dec_impl/2024/1212/ojEN OJ L, 30.4.2024 (12) From the analysis carried out by the Commission it can be concluded that the alternative specifications, consisting of the temporary application of the ‘ATB only’ function and subsequent removal of this function, will not cause a reduction in safety or interoperability in the deployment of ICNG trainsets in the Netherlands. (13) Based on the above, the conditions set out in Article 7(1), point (c) and Article 7(4) of Directive (EU) 2016/797 should be considered as fulfilled for the 78 vehicles concerned. Therefore, the request submitted by the Netherlands to not apply to those vehicles Table A 2.2 Subset-026 of the Appendix A of Annex I to Implementing Regulation (EU) 2023/1695 until all the necessary drivers have been duly trained, that is, until 31 December 2029, should be accepted. (14) The measures provided for in this Decision are in accordance with the opinion of the Committee referred to in Article 51(1) of Directive (EU) 2016/797, HAS ADOPTED THIS DECISION: Article 1 The request of the Kingdom of the Netherlands not to apply Table A 2, Index 4 Subset-026, point 5.10.2.4 of the table of priority of trackside supported levels of Appendix A of the Annex I to Implementing Regulation (EU) 2023/1695 to 78 vehicles ICNG is granted. Article 2 By 31 December of each year, the Kingdom of the Netherlands shall inform the Commission of the progress made in training the train drivers on ERTMS running and on ERTMS signalling. Article 3 This Decision applies within the geographic limits of the Dutch railway network. Article 4 This Decision shall apply until 31 December 2029.
