amending Implementing Regulation (EU) 2017/892 and Implementing Regulation (EU) No 511/2012
with regard to notifications by Member States of recognised producer organisations, associations of
producer organisations and interbranch organisations in the fruit and vegetables and the milk and
milk products sectors
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013
establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC)
No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007(1), and in particular Articles 174(1), point (a),
174(2), point (a) and 223(3), point (b), thereof,
Whereas:
(1) Regulation (EU) No 1308/2013 lays down specific rules on the recognition of producer organisations, associations
of producer organisations and interbranch organisations and empowers the Commission to adopt delegated and
implementing acts in that respect.
(2) Regulation (EU) No 1308/2013 provides that Member States must inform the Commission of their decisions to
grant, refuse or withdraw recognitions for producer organisations, associations of producer organisations and
interbranch organisations during the previous calendar year.
(3) Commission Implementing Regulation (EU) 2017/892(2) lays down certain reporting obligations for recognised
producer organisations, associations of producer organisations and transnational organisations of such entities in
the fruit and vegetables and processed fruit and vegetables sectors.
(4) Commission Implementing Regulation (EU) No 511/2012(3), lays down, among other things, reporting obligations
in relation to recognised producer organisations, associations of recognised producer organisations and interbranch
organisations in the milk and milk products sector.
(5) Commission Delegated Regulation (EU) 2016/232(4)as amended by Commission Delegated Regulation (EU) 2022/
2092(5) provides for an improved and streamlined notification system of recognised national and transnational
producer organisations, associations of producer organisations and interbranch organisations in a uniform manner
for all sectors. Accordingly, the rules on notifications by Member States laid down in that Regulation apply to
information on recognised producer organisations in all sectors of agricultural products listed in Article 1(2) of
Regulation (EU) No 1308/2013, including the information currently required under Article 21 of Implementing
Regulation (EU) 2017/892 as regards the fruit and vegetables and processed fruit and vegetables sectors and under
Article 1 of Implementing Regulation (EU) No 511/2012 as regards the milk and milk products sector.

(6) In order to avoid that Member States have to provide twice the required information, it is appropriate to amend
Implementing Regulations (EU) 2017/892 and (EU) No 511/2012.
(7) In order to ensure that there is no disruption between the old and the new notification regimes, the rules laid down
in this Regulation should apply as of 1 January 2023.
(8) The measures provided for in this Regulation are in accordance with the opinion of the Committee for the Common
Organisation of the Agricultural Markets,
HAS ADOPTED THIS REGULATION:
Article 1
In Part A of Annex II to Implementing Regulation (EU) 2017/892, point 2 is deleted.
Article 2
Article 1 of Implementing Regulation (EU) No 511/2012 is deleted.
Article 3
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the
European Union.
It shall apply from 1 January 2023.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
