Commission Implementing Regulation (EU) 2024/1323 amends Regulation (EU) 2023/2820, which provides emergency financial support to the agricultural sectors in Greece and Slovenia that were affected by natural disasters.
The amendment clarifies the eligibility of payments related to the emergency financial support.

amending Regulation (EU) 2023/2820 providing for emergency financial support for the agricultural
sectors affected by natural disasters in Greece and Slovenia, as regards eligibility of payments
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013
establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC)
No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007(1), and in particular Article 221(1) thereof,
Whereas:
(1) Commission Implementing Regulation (EU) 2023/2820(2) provides for emergency financial support for the
agricultural sectors affected by natural disasters in Greece and Slovenia.
(2) In order to ensure that the beneficiaries can rapidly benefit from the emergency financial support, Article 1(5) of
Implementing Regulation (EU) 2023/2820 lays down the latest possible date for payments for measures under that
Implementing Regulation, which is set on 31 May 2024.
(3) As no payments are to be made after 31 May 2024, Article 38(1) of Regulation (EU) 2021/2116 of the European
Parliament and of the Council(3)should apply so that any payment made after this latest possible date for payments
is to be considered ineligible for Union financing. Consequently, Article 5(2) of Commission Delegated Regulation
(EU) 2022/127(4), providing for a proportional reduction of the monthly payments effected after the deadline,
should not be applicable.
(4) Therefore, in order to clarify the eligibility of payments, Article 1(5) of Implementing Regulation (EU) 2023/2820
should be amended accordingly.
(5) In view of the necessity to take immediate action and clarify the eligibility of payments well in advance of the
deadline of 31 May 2024, this Regulation shall enter into force on the day following that of its publication in the
Official Journal of the European Union.
(6) The measure provided for in this Regulation is in accordance with the opinion of the Committee for the Common
Organisation of the Agricultural markets,

HAS ADOPTED THIS REGULATION:
Article 1
In Article 1 of Implementing Regulation (EU) 2023/2820, paragraph 5 is replaced by the following:
‘5. The expenditure borne by Greece and Slovenia referred to in paragraph 1 in relation to the payments for the
measures referred to in paragraph 2 shall only be eligible for Union aid if those payments are made by 31 May 2024.
Article 38(1) of Regulation (EU) 2021/2116 of the European Parliament and of the Council(*) shall apply to these
payments.

Article 2
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
