correcting Commission Implementing Regulation (EU) 2023/265 imposing a definitive anti-dumping
duty on imports of ceramic tiles originating in India and Türkiye
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection
against dumped imports from countries not members of the European Union(1)(‘the basic Regulation’), and in particular
Articles 9 and 14(1) thereof,
Whereas:
(1) By Commission Implementing Regulation (EU) 2023/265(2) (‘the original Regulation’), the European Commission
(‘the Commission’) imposed definitive anti-dumping duties on imports of ceramic tiles originating in India and
Türkiye.
(2) In the investigation leading to the imposition of definitive anti-dumping duties, sampling was used when
investigating exporting producers, in accordance with Article 17 of ‘the basic Regulation’.
(3) In July 2025, the Bien & Qua group, a group of sampled Turkish exporting producers whose products were made
subject to the individual anti-dumping duty of 4,8 % contacted the Commission, bringing to its attention an error in
the way names of their exporting producers appeared in the original Regulation. A new analysis of the documents
already submitted by the group during the original investigation, namely their Articles of Association, confirmed
that the parties’ names were misspelled in the original Regulation.
(4) In view of the above, it is considered necessary to amend the original Regulation retroactively from the day of its
entry into force to reflect the correct names of the relevant exporting producers, which are Qua Granite Hayal Yapi
ve Ürünleri Sanayi Ticaret A.Ş. and Bien Yapi Ürünleri Sanayi Turizm ve Ticaret A.Ş.
(5) The measures provided for in this Regulation are in accordance with the opinion of the Committee established by
Article 15(1) of Regulation (EU) 2016/1036,
HAS ADOPTED THIS REGULATION:
Article 1
Article 1(2) of Implementing Regulation (EU) 2023/265 is amended as follows:
‘Türkiye Qua Granite ve Hayal Yapi Ürünleri San. Tic. A.Ş.; 4,8 % C901’
Bien Yapi Ürünleri San. Tic. A.Ş.
is replaced by:
‘Türkiye Qua Granite Hayal Yapi ve Ürünleri Sanayi Ticaret A.Ş.; Bien Yapi 4,8 % C901’

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
It shall apply from 11 February 2023.
