COMMISSION IMPLEMENTING REGULATION(EU) 2026/1398
of 25 June 2026
amending Implementing Regulation (EU) 2021/1378 as regards the recognition of certain control
bodies in accordance with Article 46 of Regulation (EU) 2018/848 of the European Parliament and of
the Council as competent to carry out controls and issue organic certificates in third countries for
the purpose of imports of organic products into the Union

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2018/848 of the European Parliament and of the Council of 30 May 2018 on organic
production and labelling of organic products and repealing Council Regulation (EC) No 834/2007(1), and in particular
Article 46(1) thereof,
Whereas:
(1) Annex II to Commission Implementing Regulation (EU) 2021/1378(2) contains the list of control authorities and
control bodies recognised in accordance with Article 46 of Regulation (EU) 2018/848 as competent to carry out
controls and issue organic certificates in third countries for the purpose of imports of organic products into the
Union in accordance with Article 45(1), point (b)(i), of that Regulation.
(2) Article 46(2) of Regulation (EU) 2018/848 lays down the criteria that the control authorities and control bodies must
fulfil in order to be recognised in accordance with Article 46(1) of that Regulation. Commission Delegated
Regulation (EU) 2021/1698(3) lays down the procedural requirements to be met by those control authorities and
control bodies when submitting to the Commission their request for recognition consisting of a technical dossier.
(3) The Commission has received and examined, in accordance with Article 1 of Delegated Regulation (EU) 2021/1698,
the requests for recognition from the control bodies βBaltic Testing India Private Limitedβ, βKAYOS ULUSLARARASI
SERTΔ°FΔ°KASYON VE DENETΔ°M HΔ°ZMETLERΔ° LΔ°MΔ°TED ΕΔ°RKETΔ°β, βLETIS AUDIT & CERTIFICATION S.A.β, βMS
Agroland Services Private Limitedβ, βVCERT QUALITY CERTIFICATION PRIVATE LIMITEDβ, and βZENITH
CERTIFICATIONS PRIVATE LIMITEDβ. Based on the information contained in their technical dossiers, the
Commission has concluded that it was justified to recognise, for an indefinite duration, those control bodies for
certain product categories in certain third countries.

(4) The Commission has also received and examined, in accordance with Article 2 of Delegated Regulation
(EU) 2021/1698, the requests for the extension of the scope of their recognition to certain product categories and
certain third countries from the control bodies βbio.inspecta AGβ, βControl Union Certifications B.V.β, βFlorida
Certified Organic Growers and Consumers, Inc. (FOG), DBA as Quality Certification Services (QCS)β, βIBD
Certificaçáes Ltdaβ, βIMOcert LatinoamΓ©rica Ltda.β, βIMO Control Private Limitedβ, βINDOCERTβ, βLacon Quality
Certification Private Limitedβ, βONECERT INTERNATIONAL PRIVATE LIMITEDβ, and βOrganizacion Internacional
Agropecuaria S.A.β. Based on the information contained in their technical dossiers, the Commission has concluded
that it was justified to recognise, for an indefinite duration, those control bodies for the requested product categories
and third countries.
(5) The Commission has received requests from βBio Latina Certificadoraβ, and βSouthern Cross Certified Australia Pty Ltdβ
for the reduction of their scope of recognition by removing certain third countries, certain product categories or
both. The scope of recognition of those control bodies should therefore be updated accordingly.
(6) Implementing Regulation (EU) 2021/1378 should therefore be amended accordingly.
(7) The measures provided for in this Regulation are in accordance with the opinion of the Organic Production
Committee,
HAS ADOPTED THIS REGULATION:
Article 1
Annex II to Implementing Regulation (EU) 2021/1378 is amended in accordance with the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European
Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
