## Report on Commission Regulation (EU) 2025/1108 Amending Council Regulation (EC) No 2368/2002 implementing the Kimberley Process certification scheme for the international trade in rough diamonds **1. Executive Summary:** This report analyzes Commission Regulation (EU) 2025/1108, an amendment to Council Regulation (EC) No 2368/2002. The core purpose of this amendment is to update the list of participants in the Kimberley Process (KP) certification scheme to include Uzbekistan. This report details the background, rationale, and specific changes introduced by this amendment, highlighting its impact on stakeholders involved in the international trade of rough diamonds. The inclusion of Uzbekistan aims to further strengthen the KP's efforts to prevent conflict diamonds from entering the legitimate trade. **2. Introduction:** This report aims to provide a comprehensive overview of Commission Regulation (EU) 2025/1108, based solely on the provided policy text. The report will examine the rationale behind the amendment, the specific changes it introduces, the affected stakeholders, and the anticipated outcomes for the international trade in rough diamonds. **3. Policy Overview:** * This regulation is an amendment to **Council Regulation (EC) No 2368/2002** implementing the Kimberley Process certification scheme for the international trade in rough diamonds. * **Core Objective:** To update the list of participants in the Kimberley Process (KP) certification scheme to accurately reflect the current membership, thus maintaining the integrity of the KP. **4. Background and Rationale:** This amendment addresses the need to update the list of participants in the Kimberley Process certification scheme. The inclusion of Uzbekistan as a participant is prompted by the KP's recognition that Uzbekistan fulfills the minimum requirements of the certification scheme, as well as the KP Plenary’s approval of Uzbekistan’s addition to the list in November 2024. This ensures that the list of participants remains current and reflects the evolving landscape of the international diamond trade. **5. Key Provisions / Changes:** This regulation amends Annex II to Regulation (EC) No 2368/2002, which lists the participants in the Kimberley Process certification scheme and their respective competent authorities. * **Specific Part of Original Policy Changed:** Annex II of Council Regulation (EC) No 2368/2002. * **New Rule/Provision:** Annex II to Regulation EC No 2368/2002 is replaced by the text set out in the Annex to the amending Regulation. This effectively means the entire list of participants and their competent authorities is updated and replaced by the new Annex. According to the new Annex, Uzbekistan is added to the list with the following entry: * "UZBEKISTAN Ministry of Investment, Industry and Trade of the Republic of Uzbekistan Legal Department I. Karimov street, building 1, 100029, Tashkent, Republic of Uzbekistan" * **Difference/Effect of the Change:** The inclusion of Uzbekistan means that the European Union now officially recognizes Uzbekistan as a participant in the Kimberley Process. This means rough diamonds imported from or exported to Uzbekistan will now be subject to the rules and procedures of the KP certification scheme as enforced by the EU. Conversely, Uzbekistan becomes obligated to adhere to the KP's requirements and is entitled to the benefits of participation within the KP framework. **6. Target Audience and Stakeholders:** The primary target audience includes: * **EU Member States:** The regulation is directly applicable in all Member States. * **Diamond Traders and Businesses:** Companies involved in the import and export of rough diamonds within the EU and those trading with KP participants, including Uzbekistan. * **Customs Authorities:** Responsible for enforcing the Kimberley Process certification scheme at EU borders. * **The European Commission:** Responsible for monitoring and updating the list of participants. * **Uzbekistan:** As a new participant, Uzbekistan and its relevant authorities are directly affected. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The European Commission (Service for Foreign Policy Instruments), customs authorities in Member States, and the competent authorities in Uzbekistan (Ministry of Investment, Industry and Trade). * **Timelines/Procedures:** The regulation enters into force on the twentieth day following its publication in the Official Journal of the European Union (May 28, 2025). This implies that 20 days after that publication date, Member States are expected to enforce the amended list of participants, including the addition of Uzbekistan, into their existing Kimberley Process enforcement mechanisms. * Specifically for the change: EU Member States must update their internal systems and procedures to recognize Uzbekistan as a Kimberley Process participant and apply the necessary certification and control measures for rough diamond trade with Uzbekistan from the effective date of the regulation. **8. Expected Outcomes / Impact of Changes:** The intended outcome of this amendment is to: * Enhance the effectiveness of the Kimberley Process by ensuring all participants are accurately represented in the official list. * Facilitate legitimate trade in rough diamonds with Uzbekistan, subject to KP certification requirements. * Prevent conflict diamonds from entering the legitimate supply chain by extending the KP's reach to include Uzbekistan's diamond trade activities. * The addition of Uzbekistan should help in better monitoring of rough diamond trade originating from or passing through Uzbekistan. **9. Conclusion:** Commission Regulation (EU) 2025/1108 is a technical update that incorporates Uzbekistan into the Kimberley Process certification scheme. This amendment is significant because it reinforces the KP's commitment to eradicating conflict diamonds from international trade. By including Uzbekistan, the regulation contributes to the broader goal of ensuring that the diamond trade is transparent and ethical, supporting sustainable development in diamond-producing countries. The effectiveness of this amendment will depend on the diligent implementation and enforcement by the EU Member States and the responsible authorities in Uzbekistan.
