of 7 January 2025
reopening the fishery for saithe in Norwegian waters of 1 and 2 by vessels flying the flag of France,
by repealing Regulation (EU) 2024/2844
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 1224/2009 of 20 November 2009establishing a Union control system for
ensuring compliance with the rules of the common fisheries policy, amending Regulations (EC) No 847/96, (EC)
No 2371/2002, (EC) No 811/2004, (EC) No 768/2005, (EC) No 2115/2005, (EC) No 2166/2005, (EC) No 388/2006, (EC)
No 509/2007, (EC) No 676/2007, (EC) No 1098/2007, (EC) No 1300/2008, (EC) No 1342/2008 and repealing
Regulations (EEC) No 2847/93, (EC) No 1627/94 and (EC) No 1966/2006(1), and in particular Article 36(2) thereof,
Whereas:
(1) Council Regulation (EU) 2024/257(2)lays down quotas for 2024.
(2) On 10 October 2024, France notified the Commission, pursuant to Article 35(3) of Regulation (EC) No 1224/2009,
of its decision to prohibit fishing for saithe in Norwegian waters of 1 and 2 as from 26 July 2024.
(3) Commission Regulation (EU) 2024/2844(3)prohibited fishing for saithe in Norwegian waters of 1 and 2 for vessels
flying the flag of France.
(4) According to the information received by the Commission on 7 November 2024 from the French authorities, a
quantity is still available to France for the quota for that stock. Consequently, the fishery for saithe in Norwegian
waters of 1 and 2 by vessels flying the flag of or registered in France should be reopened until further notice.
(5) That reopening of fishery should take effect on 7 November 2024, in order to allow the quantity of saithe in
question to be fished before the end of the current year.
(6) Regulation (EU) 2024/2844 should therefore be repealed with effect from 7 November 2024.
(7) Such retroactive application does not affect the principle of legal certainty and protection of legitimate expectations
as a quota is still available for that stock,
HAS ADOPTED THIS REGULATION:
Article 1
The fishery for saithe in Norwegian waters of 1 and 2 for the 2024 fishing season by vessels flying the flag of or registered
in France referred to in the Annex is reopened.
Regulation (EU) 2024/2844 is repealed.

Article 2
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
It shall apply from 7 November 2024.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
