On November 9, 2023, the Council of the European Union adopted Decision (CFSP) 2023/2487, amending Decision 2013/798/CFSP concerning restrictive measures in view of the situation in the Central African Republic (CAR). This amendment responds to United Nations Security Council Resolution 2693 (2023), adopted on July 27, 2023. Resolution 2693 (2023) establishes that the arms embargo measures and related notification requirements no longer apply to the supply, sale, or transfer of arms and related materiel, and the provision of assistance, advice, and training to the CAR security forces, including state civilian law enforcement institutions.
The key change introduced by Council Decision (CFSP) 2023/2487 is the amendment of Article 2 of Decision 2013/798/CFSP. Point (g) of paragraph 1 is replaced, now pertaining to the allowance of sale, supply, transfer or export of arms and related materiel of all types, including weapons and ammunition, military vehicles and equipment, paramilitary equipment, and spare parts for the aforementioned, and the provision of related assistance, advice and training to the CAR security forces, including state civilian law enforcement institutions. Paragraph 2 is also replaced, specifying that Member States shall notify the Committee in advance of the delivery of any sale, supply, transfer or export as permitted in points a, b, c, d, f and i of paragraph 1.
This Decision entered into force on the day following its publication in the Official Journal of the European Union (L series). amending Decision 2013/798/CFSP concerning restrictive measures in view of the situation in the
Central African Republic
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on European Union, and in particular Article 29 thereof,
Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,
Whereas:
(1) On 23 December 2013, the Council adopted Decision 2013/798/CFSP(1), concerning restrictive measures in view
of the situation in the Central African Republic (‘CAR’).
(2) On 27 July 2023, the United Nations Security Council adopted Resolution 2693 (2023). That Resolution establishes
that the arms embargo measures and the related notification requirements are no longer to apply to the supply, sale
or transfer of arms and related materiel, and the provision of assistance, advice and training to the CAR security
forces, including state civilian law enforcement institutions.
(3) Decision 2013/798/CFSP should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
In Decision 2013/798/CFSP, Article 2 is amended as follows:
(1) in paragraph 1, point (g) is replaced by the following:
‘(g) the sale, supply, transfer or export of arms and related materiel of all types, including weapons and ammunition,
military vehicles and equipment, paramilitary equipment, and spare parts for the aforementioned, and the
provision of related assistance, advice and training to the CAR security forces, including state civilian law
enforcement institutions; or’;
(2) paragraph 2 is replaced by the following:
‘2. Member States shall notify the Committee in advance of the delivery of any sale, supply, transfer or export as
permitted in points (a), (b), (c), (d), (f) and (i) of paragraph 1.’.
Article 2
This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.
