Official Journal EN of the European Union L series 2023/2768 11.12.2023 COUNCIL DECISION (CFSP) 2023/2768 of 8 December 2023 amending Decision 2010/788/CFSP concerning restrictive measures in view of the situation in the Democratic Republic of the Congo THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on European Union, and in particular Article 29 thereof, Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy, Whereas: (1) On 20 December 2010, the Council adopted Decision 2010/788/CFSP(1), which concerns restrictive measures in view of the situation in the Democratic Republic of the Congo (DRC). (2) On 12 December 2016, the Council adopted Decision (CFSP) 2016/2231(2)in response to the obstruction of the electoral process and related human rights violations in the DRC. Decision (CFSP) 2016/2231 amended Decision 2010/788/CFSP, introducing autonomous restrictive measures in Article 3(2) of Decision 2010/788/CFSP. (3) On the basis of a review of the restrictive measures laid down in Article 3(2) of Decision 2010/788/CFSP, and considering the relevant circumstances and in view of the gravity of the situation in the DRC, those measures should be renewed until 12 December 2024. (4) The statements of reasons relating to certain persons listed in Annex II to Decision 2010/788/CFSP should be amended. (5) Decision 2010/788/CFSP should therefore be amended accordingly, HAS ADOPTED THIS DECISION: Article 1 Decision 2010/788/CFSP is amended as follows: (1) in Article 9, paragraph 2 is replaced by the following: ‘2. The measures referred to in Article 3(2) shall apply until 12 December 2024. They shall be renewed, or amended as appropriate, if the Council deems that their objectives have not been met.’; (2) Annex II is replaced by the text appearing in the Annex to this Decision. William DOB: 1970 William Yakutumba is the Secretary-General and Commander of the Coalition Nationale du 8.12.2022 YAKUTUMBA Peuple pour la Souverainité du Congo (CNPSC), a coalition of the so-called Mai-Mai militias in POB: Lunbondia, South-Kivu, DRC South Kivu province of the DRC. He is the founder and leader of one of the largest militias of that Nationality: DRC coalition, the Mai-Mai Yakutumba. Gender: male The Mai-Mai Yakutumba contributes to the armed conflict, instability and insecurity in the DRC, Function or profession: leader of the in particular through violence and serious human rights abuses, including massacres of village Coalition Nationale du Peuple pour la populations, attacks on civilians, rapes and other acts of sexual violence. Souverainité du Congo (CNPSC); The Mai-Mai Yakutumba also controls gold mines in the Eastern DRC, together with CNPSC founder and leader of the Mai-Mai members who control the mining routes. They profit from the illicit exploitation of and trade in Yakutumba militia gold. The Mai-Mai Yakutumba uses profits gained through that trade to finance its armed activities. Owing to his leading position in the CNPSC and in the Mai-Mai Yakutumba militia, William Yakutumba is therefore involved in planning, directing or committing acts that constitute serious human rights violations or abuses in the DRC. He is also responsible for sustaining and exploiting the armed conflict, instability and insecurity in the DRC, including through the illicit exploitation and trade of natural resources. Tiger One Bernard Byamungu holds a leading position in the military branch of the March 23 28.7.2023 BYAMUNGU Movement/Congolese Revolutionary Army (Mouvement du 23 mars/Armée révolutionnaire Function/rank: Brigadier-General in congolaise – M23/ARC) as Brigadier-General and Deputy-Commander of operations of this non- the March 23 Movement/Congolese governmental armed group operating in Eastern DRC.
