DECISION OF THE EEA JOINT COMMITTEENo 107/2026
of 20 March 2026
amending Annex XXI (Statistics) to the EEA Agreement [2026/1299]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98
thereof,
Whereas:
(1) Regulation (EU) 2019/2152 of the European Parliament and of the Council of 27 November 2019 on European
business statistics, repealing 10 legal acts in the field of business statistics(1) is to be incorporated into the EEA
Agreement.
(2) Regulation (EU) 2019/2152 repeals Regulation (EC) No 48/2004(2), Regulation (EC) No 808/2004(3), Regulation
(EC) No 716/2007(4), Regulation (EC) No 177/2008(5), Regulation (EC) No 295/2008(6), Decision
No 1608/2003/EC(7), Council Regulation (EEC) No 3924/91(8), Regulation (EC) No 471/2009(9) and Council
Regulation (EC) No 1165/98(10)which are incorporated into the EEA Agreement and which are consequently to be
repealed under the EEA Agreement.
(3) Annex XXI to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
Annex XXI to the EEA Agreement shall be amended as follows:
1. The text of point 1 (Regulation (EC) No 295/2008) is replaced by the following:
‘32019 R 2152: Regulation (EU) 2019/2152 of the European Parliament and of the Council of 27 November 2019
on European business statistics, repealing 10 legal acts in the field of business statistics (OJ L 327, 17.12.2019, p. 1).
The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptations:
(a) Liechtenstein is exempted from providing data referred to in Articles 2(1) and 6 and Annex I, except for data on
the following topics:
— Domain 1. Short-term business statistics, Topic: Business population, Detailed topic: Business
demographic events;
— Domain 1. Short-term business statistics, Topic: Labour inputs, Detailed topic: Employment;
— Domain 1. Short-term business statistics, Topic: Real estate, Detailed topic: Real estate;

— Domain 2. Country-level business statistics, Topic: Business population, Detailed topics: Population of
active enterprises and Business demographic events (births, deaths, survivals);
— Domain 2. Country-level business statistics, Topic: Labour inputs, Detailed topics: Employment and
Employment linked to business demographic events (births, deaths, survivals);
— Domain 4. Statistics on international activities, Topic: International trade in goods: Detailed topic: Extra-
Union trade in goods.
(b) Liechtenstein is exempted from the requirement to provide monthly data except for data under the topic
International trade in goods as referred to in Articles 2 and 6 and Annex I, Domain 4.
(c) Liechtenstein is exempted from providing data on exports and imports of goods by invoicing currency as
referred to in Articles 2(1) and 6 and Annex I, Domain 4.
(d) Liechtenstein is exempted from including in its register and transmitting to the European framework for
statistical business registers the data on the variable Net turnover referred to in Article 2(2) and Annex IV.
(e) Articles 5(2), 5(3), 5(4) and 5(5), Chapter V and Annex V and VI shall not apply to the EFTA States.
(f) As regards Liechtenstein, the text of Article 19 shall be replaced by the following:
“The NSA shall decide whether to disseminate statistical results relating to the respective imports or exports
without any amendment or, to amend the statistical results so as to make it impossible to identify individual
importers or exporters in order to comply with the principle of statistical confidentiality, in accordance with
point (a) of Article 20(3) of Regulation (EC) No 223/2009.”
(g) Extra-Union trade in goods, referred to in Annex I, Domain 4, shall be understood as to include trade between
the Contracting Parties.
(h) Iceland is exempted from providing the data referred to in the topics Prices, Outputs and performance and Real
estate in Annex I, Domain 1.
(i) As regards Iceland, data for the topic Regional business statistics in Annex I, Domain 3, shall be provided on
voluntary basis.
(j) The EFTA States are exempted from providing data on detailed topic Intra-Union trade in goods as referred to
in the topic International trade in goods in Annex I, Domain 4.
(k) As regards Iceland, the periodicity for the topic ICT usage and e-commerce in Annex II, Domain 2 shall be
bienially (every second year) with the first reference period being 2025.
(l) Liechtenstein is exempted from providing data on trade between Switzerland and Liechtenstein.
(m) In Article 24(1), as regards the EFTA States, the words “within three months of the date of the entry into force
of the act concerned” shall read “within three months of the date of the entry into force of the Decision of the
EEA Joint Committee No 107/2026 of 20 March 2026”.’
2. The texts of points 2 (Council Regulation (EC) No 1165/98), 4a (Council Regulation (EEC) No 3924/91), 4b
(Regulation (EC) No 177/2008 of the European Parliament and of the Council ), 4c (Regulation (EC) No 48/2004 of
the European Parliament and of the Council ), 8 (Regulation (EC) No 471/2009 of the European Parliament and of
the Council), 19x (Regulation (EC) No 716/2007 of the European Parliament and of the Council), 28 (Regulation
(EC) No 808/2004 of the European Parliament and of the Council) and 29 (Decision No 1608/2003/EC of the
European Parliament and of the Council) are deleted.

Article 2
The text of Regulation (EU) 2019/2152 in the Icelandic and Norwegian languages, to be published in the EEA Supplement
to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 21 March 2026, provided that all the notifications under Article 103(1) of the EEA
Agreement have been made(*).
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European
Union.

Joint Declaration by the Contracting Parties
to Decision of the EEA Joint Committee No 107/2026 of 20 March 2026 incorporating Regulation
(EU) 2019/2152 of the European Parliament and of the Council into the EEA Agreement
Regulation (EU) 2019/2152 on European business statistics repeals 10 legal acts in the field of business statistics. The
Contracting Parties recognise that many of these repealed acts were adapted when they were incorporated into the EEA
Agreement to exempt Liechtenstein from collecting, aggregating and submitting certain data.
These adaptations were granted, in particular, due to Liechtenstein’s size and its customs union with Switzerland. Requiring
Liechtenstein to collect, aggregate, and submit respective data would have imposed an excessive burden on its businesses.
Moreover, it would not be possible to ensure sufficient privacy for data providers and the confidentiality of the
information provided, and the quality of the data would not have met European standard.
However, in contrast to the legal acts repealed by Regulation (EU) 2019/2152, many details regarding data to be collected,
aggregated, and submitted pursuant to Regulation (EU) 2019/2152 will be defined in secondary legislation.
The Contracting Parties acknowledge that similar adaptations as were included in the repealed acts will be necessary under
the secondary legislation derived from Regulation (EU) 2019/2152, when they are incorporated into the EEA Agreement.
