Official Journal EN of the European Union L series 2025/1364 24.7.2025 DECISION OF THE EEA JOINT COMMITTEENo 110/2025 of 8 May 2025 amending Annex XX (Environment) to the EEA Agreement [2025/1364] THE EEA JOINT COMMITTEE, Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof, Whereas: (1) Commission Implementing Regulation (EU) 2023/2767 of 13 December 2023 establishing a procedure for the approval and certification of innovative technologies for reducing CO emissions from passenger cars and light 2 commercial vehicles pursuant to Regulation (EU) 2019/631 of the European Parliament and of the Council(1)is to be incorporated into the EEA Agreement. (2) Commission Implementing Regulation (EU) 2023/2866 of 15 December 2023 implementing Regulation (EU) 2019/631 of the European Parliament and of the Council by determining the procedures for performing the verification of the CO emission and fuel consumption values of passenger cars and light commercial vehicles 2 in-service (in-service verification)(2)is to be incorporated into the EEA Agreement. (3) Commission Implementing Regulation (EU) 2024/889 of 15 March 2024 correcting the Dutch language version of Implementing Regulation (EU) 2023/2866 implementing Regulation (EU) 2019/631 of the European Parliament and of the Council by determining the procedures for performing the verification of the CO emission and fuel 2 consumption values of passenger cars and light commercial vehicles in-service (in-service verification)(3) is to be incorporated into the EEA Agreement. (4) Implementing Regulation (EU) 2023/2767 repeals Commission Implementing Regulations (EU) No 725/2011(4)and (EU) No 427/2014(5), which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement. (5) Annex XX to the EEA Agreement should therefore be amended accordingly, HAS ADOPTED THIS DECISION: Article 1 Annex XX to the EEA Agreement shall be amended as follows: 1. The following is inserted after point 21azq (Commission Implementing Decision (EU) 2024/865): ‘21azr. 32023 R 2767: Commission Implementing Regulation (EU) 2023/2767 of 13 December 2023 establishing a procedure for the approval and certification of innovative technologies for reducing CO emissions from 2 passenger cars and light commercial vehicles pursuant to Regulation (EU) 2019/631 of the European Parliament and of the Council (OJ L, 2023/2767, 14.12.2023). The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptations: (a) The following subparagraph shall be added in Article 3(1): “Applicants established in the EFTA States shall send applications pursuant to this Article to the Commission. The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptation: Without prejudice to Protocol 1 to the Agreement, in Articles 16(1) and (2), the words “or the EFTA Surveillance Authority, as regards manufacturers established in the EFTA States,” shall be inserted after the word “Commission”.’ 2. The texts of points 21aeb (Commission Implementing Regulation (EU) No 725/2011) and 21ayc (Commission Implementing Regulation (EU) No 427/2014) are deleted. Article 2 The texts of Implementing Regulations (EU) 2023/2767, (EU) 2023/2866 and (EU) 2024/889 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic. Article 3 This Decision shall enter into force on 9 May 2025, provided that all the notifications under Article 103(1) of the EEA Agreement have been made(*).
