Decision of the EEA Joint Committee No 160/2026 of 5 June 2026 amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2026/1983]

Whereas:

(1) Commission Implementing Regulation (EU) 2026/154 of 23 January 2026 concerning the authorisation of sepiolitic clay as a feed additive for all animal species other than ruminants for milk production or reproduction, weaned piglets of porcine species, porcine species for fattening, salmonids and chickens for fattening and amending Implementing Regulation (EU) 2023/263 as regards the terms of the authorisation of sepiolitic clay as a feed additive for salmonids and chickens for fattening(1)is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2026/155 of 23 January 2026 concerning the renewal of the authorisation of a preparation of Saccharomyces cerevisiae NCYC R404 as a feed additive for cows (holder of

authorisation: Volac International Ltd) and repealing Implementing Regulation (EU) 2015/502(2) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Regulation (EU) 2026/178 of 23 January 2026 concerning the authorisation of eucalyptus tincture from Eucalyptus globulus Labill. as a feed additive for certain animal species(3) is to be incorporated into the EEA Agreement.

(4) Commission Implementing Regulation (EU) 2026/164 of 26 January 2026 concerning the renewal of the authorisation of an aqueous solution of choline chloride and a preparation of choline chloride as feed additives for all animal species and repealing Implementing Regulation (EU) No 795/2013(4)is to be incorporated into the EEA Agreement.

(5) Commission Implementing Regulation (EU) 2026/167 of 26 January 2026 concerning the renewal of the authorisation of clinoptilolite of sedimentary origin as a feed additive for all animal species and repealing Implementing Regulation (EU) No 651/2013(5)is to be incorporated into the EEA Agreement.

(6) Commission Implementing Regulation (EU) 2026/168 of 26 January 2026 concerning the renewal of the authorisation of a preparation of Saccharomyces cerevisiae CBS 493.94 as a feed additive for ruminants for milk production or reproduction, young ruminants for fattening except lambs for fattening and ruminants for fattening except sheep for fattening (holder of authorisation: All-Technology (Ireland) Limited [Alltech Ireland]) and repealing Implementing Regulation (EU) No 1109/2014(6)is to be incorporated into the EEA Agreement.

(7) Commission Implementing Regulation (EU) 2026/171 of 26 January 2026 concerning the renewal of the authorisation of fumaric acid as a feed additive for all terrestrial animal species, repealing Implementing Regulation

(EU) No 1078/2013 and amending Implementing Regulation (EU) 2017/56(7) is to be incorporated into the EEA Agreement.

(8) Implementing Regulation (EU) 2026/155 repeals Commission Implementing Regulation (EU) 2015/502(8), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(9) Implementing Regulation (EU) 2026/164 repeals Commission Implementing Regulation (EU) No 795/2013(9), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(10) Implementing Regulation (EU) 2026/167 repeals Commission Implementing Regulation (EU) No 651/2013(10), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(11) Implementing Regulation (EU) 2026/168 repeals Commission Implementing Regulation (EU) No 1109/2014(11), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(12) Commission Implementing Regulation (EU) 2026/171 repeals Commission Implementing Regulation

(EU) No 1078/2013(12), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(13) This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(14) Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex I to the EEA Agreement is amended as follows:

1. The following is added in point 198 (Commission Implementing Regulation (EU) 2017/56): ‘, as amended by: — 32026 R 0171: Commission Implementing Regulation (EU) 2026/171 of 26 January 2026 (OJ L, 2026/171,

27.1.2026).’

2. The following is added in point 498 (Commission Implementing Regulation (EU) 2023/263): ‘, as amended by: — 32026 R 0154: Commission Implementing Regulation (EU) 2026/154 of 23 January 2026 (OJ L, 2026/154,

26.1.2026).’

3. 716. 32026 R 0167: Commission Implementing Regulation (EU) 2026/167 of 26 January 2026 concerning the renewal of the authorisation of clinoptilolite of sedimentary origin as a feed additive for all animal species and repealing Implementing Regulation (EU) No 651/2013 (OJ L, 2026/167, 27.1.2026).

718. 32026 R 0171: Commission Implementing Regulation (EU) 2026/171 of 26 January 2026 concerning the renewal of the authorisation of fumaric acid as a feed additive for all terrestrial animal species, repealing Implementing Regulation (EU) No 1078/2013 and amending Implementing Regulation (EU) 2017/56 (OJ L, 2026/171, 27.1.2026).’

4. The texts of points 2zzl (Commission Implementing Regulation (EU) No 1078/2013), 92 (Commission Implementing Regulation (EU) No 651/2013), 100 (Commission Implementing Regulation (EU) No 795/2013), 117 (Commission Implementing Regulation (EU) No 1109/2014) and 129 (Commission Implementing Regulation

(EU) 2015/502) are deleted.

Article 2 The texts of Implementing Regulations (EU) 2026/154, (EU) 2026/155, (EU) 2026/164, (EU) 2026/167, (EU) 2026/168,

(EU) 2026/171 and (EU) 2026/178 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3 This Decision shall enter into force on 6 June 2026, provided that all the notifications under Article 103(1) of the EEA Agreement have been made(*).

Article 4 This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
