Decision of the EEA Joint Committee No 166/2026 of 5 June 2026 amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2026/1992]

Whereas:

(1) Commission Implementing Regulation (EU) 2025/854 of 7 May 2025 concerning a coordinated multiannual control programme of the Union for 2026, 2027 and 2028 to ensure compliance with maximum residue levels of pesticides and to assess the consumer exposure to pesticide residues in and on food of plant and animal origin and repealing Implementing Regulation (EU) 2024/989(1)is to be incorporated into the EEA Agreement.

(2) Implementing Regulation (EU) 2025/854 repeals, with effect from 1 September 2026, Commission Implementing Regulation (EU) 2024/989(2), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement with effect from 1 September 2026.

(3) This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to

Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(4) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XII of Annex II to the EEA Agreement shall be amended as follows:

1. The following is inserted after point 277 (Commission Implementing Regulation (EU) 2026/397): ‘278. 32025 R 0854: Commission Implementing Regulation (EU) 2025/854 of 7 May 2025 concerning a coordinated multiannual control programme of the Union for 2026, 2027 and 2028 to ensure compliance with maximum residue levels of pesticides and to assess the consumer exposure to pesticide residues in and on food of plant and animal origin and repealing Implementing Regulation (EU) 2024/989 (OJ L, 2025/854,

8.5.2025).

The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following

adaptations:

The following shall be added to the table in part A (1) of Annex II:

IS 8 NO 12’

2. The text of point 260 (Commission Implementing Regulation (EU) 2024/989) shall be deleted with effect from 1 September 2026.

Article 3 This Decision shall enter into force on 6 June 2026, provided that all the notifications under Article 103(1) of the EEA Agreement have been made(*).

Article 4 This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
