Decision of the EEA Joint Committee No 170/2026 of 5 June 2026 amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2026/2009]

Whereas:

(1) Commission Implementing Decision (EU) 2026/336 of 13 February 2026 postponing the expiry date of the approval of permethrin for use in biocidal products of product-types 8 and 18 in accordance with Regulation

(EU) No 528/2012 of the European Parliament and of the Council(1)is to be incorporated into the EEA Agreement.

(2) Commission Implementing Decision (EU) 2026/337 of 13 February 2026 postponing the expiry date of the approval of alpha-cypermethrin for use in biocidal products of product-type 18 in accordance with Regulation

(EU) No 528/2012 of the European Parliament and of the Council(2)is to be incorporated into the EEA Agreement.

(3) Commission Implementing Decision (EU) 2026/378 of 20 February 2026 not renewing the approval of etofenprox for use in biocidal products of product-types 8 and 18 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council(3)is to be incorporated into the EEA Agreement.

(4) Commission Implementing Decision (EU) 2026/379 of 20 February 2026 repealing Implementing Decisions

(EU) 2022/1487 and (EU) 2025/434 postponing the expiry dates of the approval of etofenprox for use in biocidal products of product-types 8 and 18, respectively, in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council(4)is to be incorporated into the EEA Agreement.

(5) Commission Implementing Decision (EU) 2026/380 of 20 February 2026 postponing the expiry date of the approval of propan-2-ol for use in biocidal products of product-types 1, 2 and 4 in accordance with Regulation

(EU) No 528/2012 of the European Parliament and of the Council(5)is to be incorporated into the EEA Agreement.

(6) Commission Implementing Decision (EU) 2026/381 of 20 February 2026 postponing the expiry date of the approval of tebuconazole for use in biocidal products of product-type 8 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council(6)is to be incorporated into the EEA Agreement.

(7) Implementing Decision (EU) 2026/379 repeals Implementing Decisions (EU) 2022/1487(7)and (EU) 2025/434(8), which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement.

(8) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XV of Annex II to the EEA Agreement is amended as follows:

1. The following points are inserted after point 12zzzzzzzzzzzzzf (Commission Implementing Decision

(EU) 2025/1808): ‘12zzzzzzzzzzzzzg. 32026 D 0336: Commission Implementing Decision (EU) 2026/336 of 13 February 2026 postponing the expiry date of the approval of permethrin for use in biocidal products of product-types 8 and 18 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (OJ L, 2026/336, 17.2.2026).

12zzzzzzzzzzzzzj. 32026 D 0380: Commission Implementing Decision (EU) 2026/380 of 20 February 2026 postponing the expiry date of the approval of propan-2-ol for use in biocidal products of product-types 1, 2 and 4 in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council (OJ L, 2026/380, 23.2.2026).

2. The texts of points 12zzzzzzzzg (Commission Implementing Decision (EU) 2022/1487) and 12zzzzzzzzzzzv (Commission Implementing Decision (EU) 2025/434) are deleted.

Article 2 The texts of Implementing Decisions (EU) 2026/336, (EU) 2026/337, (EU) 2026/378, (EU) 2026/379, (EU) 2026/380 and

(EU) 2026/381 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3 This Decision shall enter into force on 6 June 2026, provided that all the notifications under Article 103(1) of the EEA Agreement have been made(*). (*) No constitutional requirements indicated.
