DECISION OF THE EEA JOINT COMMITTEENo 19/2026

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98
thereof,
Whereas:
(1) Commission Implementing Regulation (EU) 2025/1263 of 30 June 2025 authorising the placing on the market of
roasted seeds of Dipteryx alataVogel (baru) as a traditional food from a third country and amending Implementing
Regulation (EU) 2017/2470(1)is to be incorporated into the EEA Agreement.
(2) Commission Implementing Regulation (EU) 2025/1509 of 25 July 2025 amending Implementing Regulation
(EU) 2017/2470 as regards the specifications of the novel food phytosterols/phytostanols(2) is to be incorporated
into the EEA Agreement.
(3) Commission Implementing Regulation (EU) 2025/1513 of 28 July 2025 amending Implementing Regulation
(EU) 2017/2470 as regards the conditions of use and the additional labelling requirements of the novel food Calanus
finmarchicusoil(3)is to be incorporated into the EEA Agreement.
(4) Commission Implementing Regulation (EU) 2025/1515 of 28 July 2025 authorising the placing on the market of
Schizochytrium limacinum (ATCC-20889) oil as a novel food and amending Implementing Regulation
(EU) 2017/2470(4)is to be incorporated into the EEA Agreement.
(5) Commission Implementing Regulation (EU) 2025/1537 of 29 July 2025 amending Implementing Regulation
(EU) 2017/2470 as regards the conditions of use of the novel food ‘3-Fucosyllactose produced by a derivative strain
of Escherichia coliBL21 (DE3)’(5)is to be incorporated into the EEA Agreement.
(6) Commission Implementing Regulation (EU) 2025/1528 of 30 July 2025 authorising the placing on the market of
Cyperus esculentus(tiger nut) oil as a novel food and amending Implementing Regulation (EU) 2017/2470(6)is to be
incorporated into the EEA Agreement.
(7) Commission Implementing Regulation (EU) 2025/1530 of 30 July 2025 authorising the placing on the market of
potassium magnesium trichloride hexahydrate as a novel food and amending Implementing Regulation
(EU) 2017/2470(7)is to be incorporated into the EEA Agreement.
(8) Commission Implementing Regulation (EU) 2025/1549 of 30 July 2025 correcting Implementing Regulations
(EU) 2023/2210 and (EU) 2022/1365 as regards the conditions of use of the novel foods 3-Fucosyllactose produced
by a derivative strain of Escherichia coli K-12 DH1 and Schizochytrium sp. oil rich in DHA and EPA(8) is to be
incorporated into the EEA Agreement.

(9) This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to
Liechtenstein as long as the application of the Agreement between the European Community and the Swiss
Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to
Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.
(10) Annex II to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
Chapter XII of Annex II to the EEA Agreement is amended as follows:
1. The following indents are added in point 124b (Commission Implementing Regulation (EU) 2017/2470):

2. The following is added in the 89th indent (Commission Implementing Regulation (EU) 2022/1365) to point 124b
(Commission Implementing Regulation (EU) 2017/2470):

3. The following is added in point 242 (Commission Implementing Regulation (EU) 2023/2210):

Article 2
The texts of Implementing Regulations (EU) 2025/1263, (EU) 2025/1509, (EU) 2025/1513, (EU) 2025/1515,
(EU) 2025/1537, (EU) 2025/1528, (EU) 2025/1530 and (EU) 2025/1549 in the Icelandic and Norwegian languages, to be
published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 7 February 2026, provided that all the notifications under Article 103(1) of the EEA
Agreement have been made(*).
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European
Union.
