Decision of the EEA Joint Committee No 193/2021 of 9 July 2021 amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2024/321]

Official Journal EN of the European Union L series 2024/321 8.2.2024 DECISION OF THE EEA JOINT COMMITTEE No 193/2021 of 9 July 2021 amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2024/321] THE EEA JOINT COMMITTEE, Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2021/412 of 8 March 2021 amending Implementing Regulation

(EU) 2017/962 as regards the review of the suspension of the authorisation of ethoxyquin as a feed additive(1)is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2021/420 of 9 March 2021 correcting Implementing Regulation

(EU) 2020/1097 concerning the authorisation of lutein-rich and lutein/zeaxanthin extracts from Tagetes erecta as feed additives for poultry (except turkeys) for fattening and laying and for minor poultry species for fattening and laying(2)is to be incorporated into the EEA Agreement.

(3) Commission Implementing Regulation (EU) 2021/421 of 9 March 2021 concerning the authorisation of tincture derived from Artemisia vulgaris L. (mugwort tincture) as a feed additive for all animal species(3)is to be incorporated into the EEA Agreement.

(4) Commission Implementing Regulation (EU) 2021/422 of 9 March 2021 concerning the authorisation of a preparation of Enterococcus faecium DSM 7134 as a feed additive for laying hens (holder of authorisation: Lactosan GmbH & Co KG)(4)is to be incorporated into the EEA Agreement.

(5) Commission Implementing Regulation (EU) 2021/426 of 10 March 2021correcting Implementing Regulation (EU) No 1263/2011 as regards the authorisation of Lactococcus lactis (NCIMB 30160) as a feed additive for all animal species(5)is to be incorporated into the EEA Agreement.

(6) Commission Implementing Regulation (EU) 2021/485 of 22 March 2021 concerning the authorisation as feed additives of ginger essential oil from Zingiber officinale Roscoe for all animal species, ginger oleoresin from Zingiber officinale Roscoe for chickens for fattening, laying hens, turkeys for fattening, piglets, pigs for fattening, sows, dairy cows, veal calves (milk replacers), cattle for fattening, sheep, goats, horses, rabbits, fish and pets and ginger tincture from Zingiber officinale Roscoe for horses and dogs(6)is to be incorporated into the EEA Agreement.

(7) Commission Implementing Regulation (EU) 2021/505 of 23 March 2021concerning the denial of authorisation of phosphoric acid 60 % on silica carrier as a feed additive belonging to the functional group of preservatives(7)is to be incorporated into the EEA Agreement.

(8) Commission Implementing Regulation (EU) 2021/506 of 23 March 2021 concerning the authorisation of methanethiol as a feed additive for all animal species(8)is to be incorporated into the EEA Agreement.

(9) Commission Implementing Regulation (EU) 2021/507 of 23 March 2021 concerning the renewal of the authorisation of pyridoxine hydrochloride (vitamin B ) as a feed additive for all animal species and repealing 6 Implementing Regulation (EU) No 515/2011(9)is to be incorporated into the EEA Agreement.

(10) Commission Implementing Regulation (EU) 2021/508 of 23 March 2021 concerning the renewal of the authorisation of a preparation of Saccharomyces cerevisiae MUCL 39885 as a feed additive for weaned piglets and repealing Regulation (EU) No 170/2011 (holder of authorisation: Prosol S.p.A.)(10) is to be incorporated into the EEA Agreement.

(11) Commission Implementing Regulation (EU) 2021/551 of 30 March 2021concerning the authorisation of turmeric extract, turmeric oil, turmeric oleoresin from Curcuma longa L. rhizome as feed additives for all animal species and turmeric tincture from Curcuma longa L. rhizome as a feed additive for horses and dogs(11)is to be incorporated into the EEA Agreement.

(12) Implementing Regulation (EU) 2021/507 repeals Commission Implementing Regulation (EU) No 515/2011(12), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(13) Implementing Regulation (EU) 2021/508 repeals Commission Regulation (EU) No 170/2011(13), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(14) This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(15) Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex I to the EEA Agreement shall be amended as follows:

1. The following indent is added in point 2zw (Commission Implementing Regulation (EU) No 1263/2011): ‘- 32021 R 0426: Commission Implementing Regulation (EU) 2021/426 of 10 March 2021 (OJ L 84, 11.3.2021, p. 18).’

2. The following is added in point 218 (Commission Implementing Regulation (EU) 2017/962): ‘, as amended by: — 32021 R 0412: Commission Implementing Regulation (EU) 2021/412 of 8 March 2021(OJ L 81, 9.3.2021, p. 30).’

3. The following is added in point 353 (Commission Implementing Regulation (EU) 2020/1097): ‘, as amended by: — 32021 R 0420: Commission Implementing Regulation (EU) 2021/420 of 9 March 2021 (OJ L 83, 10.3.2021, p. 16).’

406. 32021 R 0551: Commission Implementing Regulation (EU) 2021/551 of 30 March 2021 concerning the authorisation of turmeric extract, turmeric oil, turmeric oleoresin from Curcuma longa L. rhizome as feed additives for all animal species and turmeric tincture from Curcuma longa L. rhizome as a feed additive for horses and dogs (OJ L 111, 31.3.2021, p. 3).’

5. The texts of points 2zf (Commission Implementing Regulation (EU) No 515/2011) and 2t (Commission Regulation (EU) No 170/2011) are deleted.

Article 2 The texts of Implementing Regulations (EU) 2021/412, (EU) 2021/420, (EU) 2021/421, (EU) 2021/422, (EU) 2021/426,

(EU) 2021/485, (EU) 2021/505, (EU) 2021/506, (EU) 2021/507, (EU) 2021/508 and (EU) 2021/551 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3 This Decision shall enter into force on 10 July 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made*.

Article 4 This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union. * No constitutional requirements indicated.
