Decision of the EEA joint Committee No 289/2021 of 29 October 2021 amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2024/537]

Official Journal EN of the European Union L series 2024/537 29.2.2024 DECISION OF THE EEA JOINT COMMITTEE No 289/2021 of 29 October 2021 amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2024/537] THE EEA JOINT COMMITTEE, Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1) Commission Implementing Regulation (EU) 2021/345 of 25 February 2021 approving active chlorine generated from sodium chloride by electrolysis as an active substance for use in biocidal products of product types 2, 3, 4 and 5(1)is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2021/347 of 25 February 2021approving active chlorine released from hypochlorous acid as an active substance for use in biocidal products of product-types 2, 3, 4 and 5(2) is to be incorporated into the EEA Agreement.

(3) Commission Implementing Regulation (EU) 2021/348 of 25 February 2021approving carbendazim as an existing active substance for use in biocidal products of product-types 7 and 10(3) is to be incorporated into the EEA Agreement.

(4) Commission Implementing Decision (EU) 2021/327 of 23 February 2021postponing the expiry date of approval of metofluthrin for use in biocidal products of product-type 18(4)is to be incorporated into the EEA Agreement.

(5) Commission Implementing Decision (EU) 2021/333 of 24 February 2021postponing the expiry date of approval of alphachloralose for use in biocidal products of product-type 14(5)is to be incorporated into the EEA Agreement.

(6) Commission Implementing Decision (EU) 2021/354 of 25 February 2021postponing the expiry date of approval of propiconazole for use in biocidal products of product-type 8(6)is to be incorporated into the EEA Agreement.

(7) Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1 The following points are inserted after point 12zzzzzzu (Commission Implementing Regulation (EU) 2020/1763) of

Chapter XV of Annex II to the EEA Agreement: ‘12zzzzzzv. 32021 R 0345: Commission Implementing Regulation (EU) 2021/345 of 25 February 2021 approving active chlorine generated from sodium chloride by electrolysis as an active substance for use in biocidal products of product types 2, 3, 4 and 5 (OJ L 68, 26.2.2021, p. 163).

(EU) 2021/327, (EU) 2021/333 and (EU) 2021/354 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3 This Decision shall enter into force on 30 October 2021, provided that all the notifications under Article 103(1) of the EEA Agreement have been made*.

Article 4 This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
