Decision of the EEA Joint Committee No 67/2026 of 20 March 2026 amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2026/1259]

Official Journal EN of the European Union L series 2026/1259 25.6.2026 DECISION OF THE EEA JOINT COMMITTEENo 67/2026 of 20 March 2026 amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2026/1259] THE EEA JOINT COMMITTEE, Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof, Whereas: (1) Commission Regulation (EU) 2025/2223 of 4 November 2025 refusing to authorise a health claim made on foods, other than those referring to the reduction of disease risk and to children’s development and health(1) is to be incorporated into the EEA Agreement. (2) Commission Regulation (EU) 2025/2224 of 5 November 2025 amending Annex II to Regulation (EC) No 1925/2006 of the European Parliament and of the Council and Annex II to Directive 2002/46/EC of the European Parliament and of the Council as regards monosodium salt of L-5-methyltetrahydrofolic acid as a source of folic acid added to foods and as a source of folate used in the manufacture of food supplements(2) is to be incorporated into the EEA Agreement. (3) Commission Delegated Regulation (EU) 2025/2017 of 8 October 2025 amending Delegated Regulation (EU) 2016/127 as regards the protein-related requirements for infant and follow-on formula manufactured from protein hydrolysates(3)is to be incorporated into the EEA Agreement. (4) Commission Implementing Regulation (EU) 2025/2233 of 6 November 2025 authorising the placing on the market of Clostridium butyricum TO-A as a novel food and amending Implementing Regulation (EU) 2017/2470(4), as corrected by OJ L, 2025/90972, 1.12.2025, is to be incorporated into the EEA Agreement. (5) Commission Implementing Regulation (EU) 2025/2242 of 7 November 2025 authorising the placing on the market of yellow tomato extract as a novel food and amending Implementing Regulation (EU) 2017/2470(5) is to be incorporated into the EEA Agreement. (6) Commission Implementing Regulation (EU) 2025/2245 of 7 November 2025 amending Implementing Regulation (EU) 2017/2470 as regards the conditions of use of the novel food Schizochytriumsp. (ATCC PTA-9695) oil(6)is to be incorporated into the EEA Agreement. (7) This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein. The following indent is added in point 54zzi (Directive 2002/46/EC of the European Parliament and of the Council): ‘— 32025 R 2224: Commission Regulation (EU) 2025/2224 of 5 November 2025 (OJ L, 2025/2224, 6.11.2025).’ 2. The following indent is added in point 54zzzu (Regulation (EC) No 1925/2006 of the European Parliament and of the Council): ‘— 32025 R 2224: Commission Regulation (EU) 2025/2224 of 5 November 2025 (OJ L, 2025/2224, 6.11.2025).’ 3. The following indent is added in point 77b (Commission Delegated Regulation (EU) 2016/127): ‘— 32025 R 2017: Commission Delegated Regulation (EU) 2025/2017 of 8 October 2025 (OJ L, 2025/2017, 12.12.2025).’ 4. The following indents are added in point 124b (Commission Implementing Regulation (EU) 2017/2470): ‘— 32025 R 2233: Commission Implementing Regulation (EU) 2025/2233 of 6 November 2025 (OJ L, 2025/2233, 7.11.2025), as corrected by OJ L, 2025/90972, 1.12.2025, — 32025 R 2242: Commission Implementing Regulation (EU) 2025/2242 of 7 November 2025 (OJ L, 2025/2242, 10.11.2025), — 32025 R 2245: Commission Implementing Regulation (EU) 2025/2245 of 7 November 2025 (OJ L, 2025/2245, 10.11.2025).’ 5. The following points are inserted after point 272 (Commission Regulation (EU) 2025/2222): ‘273. 32025 R 2223: Commission Regulation (EU) 2025/2223 of 4 November 2025 refusing to authorise a health claim made on foods, other than those referring to the reduction of disease risk and to children’s development and health (OJ L, 2025/2223, 5.11.2025). 274. 32025 R 2233: Commission Implementing Regulation (EU) 2025/2233 of 6 November 2025 authorising the placing on the market of Clostridium butyricum TO-A as a novel food and amending Implementing Regulation (EU) 2017/2470 (OJ L, 2025/2233, 7.11.2025), as corrected by OJ L, 2025/90972, 1.12.2025. 275. 32025 R 2242: Commission Implementing Regulation (EU) 2025/2242 of 7 November 2025 authorising the placing on the market of yellow tomato extract as a novel food and amending Implementing Regulation (EU) 2017/2470 (OJ L, 2025/2242, 10.11.2025).’ Article 2 The texts of Regulations (EU) 2025/2223 and (EU) 2025/2224, Delegated Regulation (EU) 2025/2017 and Implementing Regulations (EU) 2025/2233, as corrected by OJ L, 2025/90972, 1.12.2025, (EU) 2025/2242 and (EU) 2025/2245 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic. Article 3 This Decision shall enter into force on 21 March 2026, provided that all the notifications under Article 103(1) of the EEA Agreement have been made(*).
