संख्या-3026/पप्रोबे0-5-दया0 बैठक दिनांक 6.09.2024, दिनांक 07.0.2024 का कृपया संदर्भ ग्रहण करें।
2- Oh पत्र द्वारा उपलब्ध कराये गये प्रस्तावानुसार बन्दी जगराम पुत्र TAO शिवनरायण (दिनांक
3.2.2023 तक बन्दी की आयु लगभग 62 वर्ष 04 माह ॥3 दिन) सिजनौडा, थाना-मौदहा, जनपद-हमीरपुर
का निवासी है। रिक्शा चालक जगराम ने दिनांक 23.07.986 को Ol सहअभियुक्त के साथ मित्रकर रिक्शे में
बैठी सवारी करन सिंह व उसकी पत्नी मैना देवी से कीमती सामान लूट कर हत्या कारित की गयी। उक्त
अपराध हेतु सत्र परीक्षण Beal-7/i986 में भा0द0वि0 की धारा-302/34, 394, 4व॥ के अन्तर्गत मा०
न्यायात्रय विशेष न्यायाधीश (दण्प्र०क्षे०ग). हमीरपुर के आदेश दिनांक 24.07.990 द्वारा आजीवन कारावास से
दण्डित किया गया, जिसे Alo उच्च न्यायालय, इलाहाबाद के आदेश दिनांक 07.2.20॥8 द्वारा उक्त सजा को
यथावत् रखा गया। Fecal द्वारा दिनांक 3.42.2023 तक अपरिहार 09 वर्ष, 0। माह, 23 दिन तथा सपरिहार
09 वर्ष, i0 माह, 74 दिन मात्र की सजा भोगी गयी है। जिला मजिस्ट्रेट एवं पुलिस अधीक्षक ने बन्दी द्वारा
कारित अपराध व्यक्ति विशेष तक सीमित अपराध की श्रेणी में नहीं आने, बल्कि पूरे समाज को प्रभावित करने
वाला अपराध होने, भविष्य में अपराध किये जाने से इन्कार नहीं किये जाने, पुनः अपराध से इन्कार नही किये
जाने, जेल में निरूद्ध रखने का सार्थक प्रयोजन होने एवं परिवार की समाजिक, आर्थिक दशा समयपूर्व रिहाई
हेतु उपयुक्त नहीं होने के दइृष्टिगत समयपूर्व रिहाई की dedi नहीं की गयी है। दयायाचिका समिति की
आख्यानुसार बन्दी द्वारा कारित अपराध की प्रकृति (02 लोगों की हत्या) एवं आजीवन कारावास के सापेक्ष
दिनांक 3.2.2023 तक अपरिहार 09 वर्ष, O! माह, 23 दिन तथा सपरिहार 09 वर्ष, ॥0 माह 4 दिन की
भोगी गयी सजा के सापेक्ष समयपूर्व रिहाई होने पर समाज में प्रतिकूल सन्देश जाने तथा पुलिस अधीक्षक एवं
जिला मजिस्ट्रेट, हमीरपुर द्वारा समयपूर्व रिहाई की संस्तुति नहीं किये जाने के इृष्टिगत, सभी बिन्दुओं पर
सम्यक् विचारोपरान्त समिति द्वारा बन्दी की समयपूर्व रिहाई की संस्तुति नहीं की गयी है।
3- उपर्युक्त वर्णित तथ्यों के परिप्रेक्ष्य A मुझे यह सूचित करने का निदेश हुआ है कि केन्द्रीय कारागार,

जनपद-हमीरपुर की भारत का संविधान के Heqede-6 के अन्तर्गत दयायाचिका के आधार पर समयपूर्व
रिहाई सम्यक विचारोपरान्त श्री राज्यपाल द्वारा अस्वीकार कर दी गयी है। कृपया उपरोक्त से बन्दी को भी
अवगत कराने का कष्ट करें।
