Amendment of rule 2.- In the Karnataka Civil Services (Appointment of the Family Members of persons belonging to Scheduled Castes or Scheduled Tribes who die in atrocities on Scheduled Castes or Scheduled Tribes, on Compassionate Grounds) (Special) Rules, 1999 (hereinafter referred to as the said rules), in rule 2, in sub-rule (1), for clause (b), the following shall be substituted, namely:- “(b) “Family” for the purpose of these rules,- (i) in the case of the deceased male married person, his widow, son and daughter (unmarried/married/divorced/widowed), who were dependent upon him and were living with him; (ii) in the case of the deceased female married person, her son, daughter (unmarried/married/divorced/widowed) and widower who were dependent upon her and were living with her; (iii) in the case of the deceased male unmarried person, his brother or sister who were dependent upon him and were living with him; (iv) in the case of the deceased female unmarried person, her brother or sister who were dependent upon her and were living with her; and (v) in the case of the deceased married person, whose spouse has died and who has minor children, the certified guardian of such minor children who is living with them and taking care of them as per the provisions of relevant law”. 3. Amendment of rule 3.- In rule 3 of the said rules, in sub-rule (2),- (i) in clause (a), the words "and has no other income" shall be omitted; (ii) in clause (b), the word "income," shall be omitted; and (iii) for clause (c), the following shall be substituted, namely:- “(c) The applicant shall be within the age limit specified for the post in the relevant rules of recruitment specially made in respect of any service or post read with sub-rule (2) of rule 6 of the Karnataka Civil Services (General Recruitment) Rules, 1977 and where it is not so specified, such applicant shall be within the age limits specified in the above said rule 6: Provided that, notwithstanding anything contained in this clause, the upper age limit in respect of a widow or widower for appointment under the above said rules shall be fifty five years as on date of presenting his application.”7 (iv) after clause (d), the following proviso shall be inserted namely:- “Provided that, nothing in this clause or sub-rule (5) of rule 5 of the Karnataka Civil Services (General Recruitment) Rules, 1977, in so far as it relates to educational qualification, shall be applicable for appointment under these rules to any post in Group-D” (v) clause (f) shall be omitted: and (vi) for sub-rule (3), the following shall be substituted, namely:- “(3) The Appointment under these rules, shall be made in the order of preference and shall be restricted to the member of family of a person deceased, who was dependent on him and was living with him specified below:- (a) in the case of a deceased male married person,- (i) his widow; or (ii) if she is not eligible or is not willing to seek appointment for any valid reason, the son or daughter who is chosen by her; Note: In case the spouse of the deceased male married person has died before making her choice of son or daughter under sub-clause (ii), then preference shall be given to the eldest child willing and eligible for appointment under these rules. (b) in the case of a deceased male unmarried person, his brother or sister, who is chosen by both his parents consensually or in case of difference of opinion between them, the brother or sister chosen by the mother, who was dependent on him and living with him; Note: In case the mother of the deceased male unmarried person or both his parents have died before making choice of their child under this clause for appointment under these rules, then preference shall be given to the eldest child willing and eligible for appointment under these rules. (c) in the case of a deceased female married person,- (i) son or daughter who is chosen by the widower of the married female person deceased or; (ii) widower; if the son or daughter is not eligible or is not willing to seek appointment for any valid reason;R.N.I. (d) in the case of a deceased female unmarried person, her brother or sister, who is chosen by both her parents consensually or in case of difference of opinion between them, the brother or sister chosen by the mother, who was dependent on her and living with her; Note: In case the mother of the deceased female unmarried person or both her parents have died before making choice of their child under this clause for appointment under these rules, then preference shall be given to the eldest child willing and eligible for appointment under these rules. (e) in the case of a deceased married person, whose spouse has died and who has minor children, certified guardian of such minor children who is living with them and taking care of them as per the provisions of relevant law”. 4. Amendment of rule 4.- In rule 4 of the said rules, in sub-rule (1),- (i) for the words “one year”, in two places where they occur, the words “two years”, shall be substituted; (ii) for the first proviso, the following shall be substituted, namely:- "Provided that, in the case of a claimant who is a minor, he must have attained the age of eighteen years within three years from the date of death of the person deceased and he must make an application within two years thereafter." (iii) the second proviso shall be omitted. 5. Amendment of Form-D.- In Form- D of the said rules, column 7 and entries relating thereto shall be omitted .
