क्रम-संख्या- 97 है रजिस्ट्रेशन नम्बर-एस०एस०्पी०,/एल०- Seo / VAotlo—94 / 2074—-46 लाइसेन्स टू पोस्ट Ye कन्सेशनल रेट सरकारी गजट, उत्तर प्रदेश उत्तर प्रदेशीय सरकार दारा प्रकाशित असाधारण विधायी परिशिष्ट भाग--4, खण्ड .(क) (सामान्य परिनियम नियम) लखनऊ, शुक्रवार, 4 जुलाई, 2025 संख्या 3304,/77-4-25-6460-24 'लखनऊ, 4 जुलाई, 2025 अधिसूचना साएप0नि0-44 उत्तर प्रदेश औद्योगिक क्षेत्र विकास अधिनियम, 4976 (उत्तर प्रदेश अधिनियम संख्या 6 सन्‌ ।976) की धारा 6 के साथ पठित धारा 49 के अधीन शक्तियों का प्रयोग करके बुन्देलखण्ड औद्योगिक विकास प्राधिकरण, राज्य सरकार के पूर्व अनुमोदन से बुन्देलखण्ड औद्योगिक विकास क्षेत्र के समुचित नियोजन और विकास के प्रयोजनार्थ एतदृद्वारा निम्नलिखित विनियमावली बनाता है, अर्थातः- बुन्देलखण्ड औद्योगिक विकास क्षेत्र (योजना की तैयारी और अन्तिम रूप देना) विनियमावली, 2025 अध्याय-एक प्रारंभिक +-() यह विनियमावली बुन्देलखण्ड औद्योगिक विकास क्षेत्र (योजना की तैयारी और संक्षिप्त नाम, अन्तिम रूप देना) विनियमावली, 2025 कहीं जायेगी प्रार्म और लागू (2) यह अधिनियम की धारा 2 (घ) के अधीन यथा परिभाषित औद्योगिक विकास क्षेत्र होना पर लागू ert! (3) यह सरकारी गजट में प्रकाशित किये जाने के दिनांक से प्रवृत्त होगी । कि 82. RPH (Audyogik Vikas Anubhag-4) 2025 data 8eउत्तर प्रदेश असाधारण गजट, 4 जुलाई, 2025 2 परिमाषाएं 2-00 जब तक संदर्भ में अन्यथा अपेक्षित न हो, इस विनियमावली में (क) “अधिनियम” का तात्पर्य उत्तर प्रदेश औद्योगिक क्षेत्र विकास अधिनियम, 4976 उत्तर प्रदेश अधिनियम संख्या 6 सन्‌ t976 से है; (ख) “कृषि उपयोग” का तात्पर्य अधिनियम और इस 'विनियमावली के अनुसार अनुमोदित योजना में यथा परिभाषित उपयोग से है; (ग) “प्राधिकरण” का तात्पर्य उत्तर प्रदेश औद्योगिक क्षेत्र विकास अधिनियम, jo7e की धारा 3 के अधीन गठित बुन्देलखण्ड औद्योगिक विकास प्राधिकरण से है; (a) “वाणिज्यिक उपयोग” का तात्पर्य अधिनियम और इस विनियमावली के अनुसार अनुमोदित योजना में यथा परिभाषित उपयोग से है; (ड). "हरित उपयोग” का तात्पर्य अधिनियम और इस विनियमावली के . अनुसार अनुमोदित योजना में यथा परिभाषित उपयोग से हैं; (a) “औद्योगिक उपयोग” का तात्पर्य अधिनियम और इस विनियमावली के अनुसार अनुमोदित योजना में यथा परिमाषित उपयोग से है; ©) “संस्थागत उपयोग" का तात्पर्य अधिनियम और इस विनियमावली के अनुसार अनुमोदित योजना में यथा परिभाषित उपयोग से है; (ज) ”संस्थागत हरित उपयोग” का तात्पर्य अधिनियम और इस विनियमावली के अनुसार अनुमोदित योजना में यथा परिभाषित उपयोग से है; (झ)“मू-उपयोग” का तात्पर्य औद्योगिक विकास क्षेत्र में प्राधिकरण द्वारा योजनां में "यथा अवधारित औद्योगिक आवासीय, teri, वाणिज्यिक, जल निकाय, मनोर॑जनात्मक उपयोग, सड़कों, परिवहन, सार्वजनिक और अर्द्धसार्वजनिक -सुविधाओं, कृषि और ऐसे अन्य प्रयोजनों के लिये किसी भूमि ar भवन या उसके भाग के उपयोग से है; ः (अ) “अभिन्‍्यास योजना” का तात्पर्य सम्पूर्ण स्थल की ऐसी योजना से है, जिसमें भू-भागों के उपयोग / गतिविधियों को उपदर्शित करते हुए भू--खण्डों /भवन समूह, सड़कों, खुले स्थान, पार्किंग, भू-दृश्य आदि को नर्शायां गया हो; ©) “योजना” का तात्पर्य प्राधिकरण द्वारा अधिनियम की धारा 6 की उपघारा (2) के अधीन अधिनियम के अर्थान्तर्गत औद्योगिक विकास क्षेत्र के विकास के लिये अनुमोदित महायोजना से है; © “सार्वजनिक और अर्द्धसार्वजनिक सुविधायें” का तात्पर्य ऐसी सुविधाओं से है जो शहर में जनसामान्य के हित में उपबंधित की जाती है, जैसे मूलभूत aan सुविधाएं an vie, wher, सड़क, नाली, इत्यादि एवं विद्यालय, चिकित्सालय धार्मिक स्थल, इत्यादि; (डी “आमोद-प्रमोद उपयोग” का तात्पर्य आमोद-प्रमोद: सम्बंधी प्रयोजनों हेतु उपयोग किए जाने वाले खुले स्थानों से है; @ “आवासीय उपयोग” का तात्पर्य अधिनियम और. ss विनियमावली के अनुसार अनुमोदित योजना में यथा परिभाषित उपयोग से है; (0) ”सेक्टर” का तात्पर्य ऐसे डिवीजनों में से किसी एक डिवीजन से है जिसमें औद्योगिक विकास क्षेत्र या उसके भाग को अधिनियम के अधीन नियोजन और विकास के प्रयोजन के लियें विभाजित किया जा सकता हैं; (त) “एसएई0जेड0 -उपयोग” का तात्पर्य अधिनियम और इस विनियमावली के अनुसार अनुमोदित योजना में यथा. परिभाषित उपयोग से है; @) “यात्तायातत और परिवहन उपयोग” का तात्पर्य अधिनियम और इस विनियमावली के अनुसार अनुमोदित योजना में यथा परिभाषित उपयोग से है; (दो) “जल निकाय” का तात्पर्य भूतल पर जल के संवहन और संग्रहण के 5 gs प्रयुक्त की जाने वाली किसी भूमि से है; 82 APH (Audyogik: Vikas Anubhag-4) 2025 data Beउत्तर प्रदेश असाधारण गजट, 4 जुलाई, 2025 अध्याय-दो जि नगर योजना और नागरिक सर्वेक्षण प्रपत्र और योजना की विषयवस्तु स अधिनियम, 3-00) प्राधिकरण, यथासम्भव शीघ्र, नगर योजना और नागरिक सर्वेक्षण करेगा और ह के अनुसार औद्योगिक विकास क्षेत्र के लिये योजना का प्रारूप तैयार करेगा; (2) प्रारूप योजना में- IS (क) विद्यमान विभिन्‍न सेक्टर्स, जिनमें विकास श्षेत्र अथवा इसके भाग को विकास १ अधिनियम, के प्रयोजनार्थ विभाजित किया जाना हो, को उपदर्शित तथा वर्णित किया जाएगा और प्रत्येक सेक्टर में भूमि का उपयोग किये जानें की रीति को उपदर्शित किया जायेगा | रण से है; (ख) विभिन्‍न भू--उपयोग के अधीन भूमि के क्षेत्रफल का उल्लेख किया जायेगा। यमावली के (a) निम्नलिखित को उपदर्शित तथा वर्णित किया जाएगा-- प्रमावली के ie eke कि (दो) परिवहन और संचार, जिसमें रेल और हवाई अड्डा भी सम्मिलित है। (3) प्रारूप योजना में निम्नलिखित प्रारूप योजना में ऐसे मानचित्र डायग्राम, चार्ट, रिपोर्ट और किसी व्याख्यात्मक या — वर्णनात्मक प्रकृति के ऐसे अन्य लिखित मामलें होंगे जो औद्योगिक विकास क्षेत्र के सम्पूर्ण या यमावली किसी भाग के विकास से सम्बन्धित हों, : (5) प्रारूप योजना के लिखित मामले में मुख्य विकास विशेषताओं प्रस्तावों का ऐसा रण. द्वारा सारांश और ऐसा वर्णनात्मक मामला भी सम्मिलित होगा, जिसे प्राधिकरण मानचित्रों, ae, न निकाय, saat और अन्य दस्तावेजों द्वारा उपदर्शित प्रस्तावों को दृष्टान्त द्वारा समझाने या स्पष्ट करने सुविधाओं, के लिये आवश्यक समझें। (6) विद्यमान भू--उपयोंग की कोई योजना, में विभिन्‍न प्रयोजनों के लिये भूमि के वांछित ane उपयोग का प्रस्ताव करने वाली योजना प्रारूप का भाग बनेगी | न | (7) योजना में- Tee (क) विभिन्‍न सेक्टर जिनमें औद्योगिक विकास क्षेत्र या नगर योजना और नागरिक सर्वेक्षण प्रपत्र और योजना कीं विषयवस्तु उसके भाग को विकास के हं/भवन प्रयोजन के लिए विभाजित किया जा सकता है, सम्मिलित हो सकते हैं; थे fa) योजना में निम्नलिखित के लिये भूमि का वांछित उपयोग उपदर्शित करते हुए विभिन्‍न विद्यमान और प्रस्तावित भू--उपयोग प्रदर्शित किये जा सकते हैं- cee (एक) औद्योगिक उपयोग; ue (दो) आवासीय उपयोग; (तीन) वाणिज्यिक उपयोंग; (चार) संस्थागत उपयोग; विधाओं (पांच) हरित उपयोग; मूलभूत (छ) संस्थागत हरित उपयोग; द्यालय, (सात) एस0ईएजेड0 उपयोग; - (आठ) कृषि उपयोग; तो हित (नौ) सार्वजनिक और of सार्वजनिक उपयोग; g (दस) आमोद-प्रमोद उपयोग; (ग्यारह) ऐसे अन्य उपयोग के लिये जैसा प्राधिकरण औद्योगिक विकास क्षेत्र a के के उचित विकास के दौरान उपयुक्त समझें; (ग) यातायात और परिवहन योजना, जिसमें सड़क, रेल और wag परिवहन से है भजन प्रणाली के लिये प्रस्ताव समाविष्ट होंगे; (@) अवसंरचनात्मक योजना जिसमें जल विद्युत, जल निकास तथा मल और Ht कूड़ा करकट के निस्तारण की व्यवस्था के लिये भूमि/भवन के उपबंध के लिये प्रस्ताव होंगे और आमोद-प्रमोद के लिये खुले स्थान, नागरिक और अवसंरचना सुविधाओं के te | | प्रस्ताव भी उपदर्शित होंगे; (ड) आवास से सम्बन्धित प्रस्ताव; इस (व विभिन्‍न woody में अनुज्ञात की जाने वाली विभिन्‍न क्रिया-कलापों के सम्बन्ध में परिक्षेत्र संबंधी विनियमों को प्रस्तावित करने वाली योजना; fe (छ) सम्पूर्ण नगर क्षेत्र, (आपत्तियां) प्रस्तुत की है, नोटिस तामील करेगी और सुनवाई के समय, दिनांक और स्थान की सूचना देने के पश्चात्‌ प्रभावित व्यक्ति (व्यक्तियों) / निकाय को उसकी /उनकी आपत्ति (आपत्तियों स) ्क पे ष ्स टम ी् कबन उसके द्वारा की गयी संस्तुति को उस पर far करन (3े ) के म ुल ख्ि यए कव ाा रप ्स य पभ ाे लज क स अक धे िग का ा। री समिति की संस्तुतियों के साथ अपनी रिपोर्ट प्राधिकरण को विचारार्थ एवं अनुमोदनार्थ प्रस्तुत परिवर्तन, उपान्तरण या संशोधन करने के लिए निदेश को अन्तिम रूप देना सकता है। (2) प्राधिकरण ऐसे परिवर्तनों, उपान्तरों या संशोधनों के साथ जो प्राधिकरण द्वारा आवश्यक समझे जाये, योजना को अनुमोदित करेगा और अंतिम रूप से अनुमोदित योजना राज्य सरकार को अनुमोदन हेतु प्रेषित करेगा । (3) अनुमोदित योजना प्राधिकरण द्वारा विनिर्दिष्ट अवधि तक अथवा नवी,/ पुनरीक्षित योजना के अनुमोदन एवं प्रारम्भ होने तक प्रभावी होगी | 9-राज्य सरकार द्वारा योजना को अनुमोदित कर दिये जाने के पश्चात्‌ तुरन्त मुख्य कार्यपालक अधिकारी अथवा मुख्य कार्यपालक अधिकारी द्वारा प्राधिकृत किसी अन्य अधिकारी के हस्ताक्षर से विनियम 5 में उपबन्धित रीति से एक सार्वजनिक नोटिस प्रकाशित की जायेगी, जिसमें यह उल्लेख होगा कि योजना अनुमोदित हो गयी है और उस स्थान का नाम होगा जहाँ पर योजना की प्रति का समस्त युक्तियुक्त समय पर निरीक्षण किया जा सकता है और पूर्वोक्त नोटिस के प्रथम प्रकाशन के दिनांक से योजना प्रभावी हो जायेगीं। 40-00) इस विनियम के अधीन किया गया प्रत्येक संशोधन विनियम 5 में विनिर्दिष्ट रीति से प्रकाशित किया जायेगा और संशोधित योजना को राज्य GOR के अनुमोदन के लिए प्रेषित किया जायेगा। योजना को तभी क्रियान्वित किया जायेगा, जब योजना पर राज्य सरकार से अनुमोदन प्राप्त हो जाये एवं मुख्य कार्यपालक अधिकारी द्वारा योजना का प्रकाशन प्रथम प्रकाशन के दिनांक को या अन्य ऐसे दिनांक को जैसा प्राधिकरण नियत करे, किया जायेगा । (2) योजना में कोई संशोधन करने से पूर्व प्राधिकरण कम से कम दो समाचार-पत्रों में जिसका विकास क्षेत्र में प्रसार हो एक नोटिस प्रकाशित करेगा, जिसमें प्रस्तावित संशोधन के सम्बन्ध में किसी प्रभावित व्यक्ति से ऐसे दिनांक के पूर्व जो नोटिस के प्रकाशन के दिनांक से १5 दिन पूर्व का न हो आपत्तियां और सुझाव आमंत्रित किया जायेगा और वह उन सभी आपत्तियों पर विचार करेगा जो प्राप्त हो। (3) इस विनियम के अधीन किया गया प्रत्येक संशोधन विनियम 5 में विनिर्दिष्ट रीति से प्रकाशित किया जायेगा और संशोधित योजना को अनुमोदन हेतु राज्य सरकार को प्रेषित किया जाएगा।' यदि संशोधन भू--उपयोग या इसके विस्तार से सम्बंधित हो, तो योजना को राज्य सरकार के अनुमोदन के पश्चात क्रियान्वित किया जाएगा। मुख्य कार्यपालक अधिकारी द्वारा योजना का प्रकाशन या तो प्रथम प्रकाशन के दिनांक को या अन्य ऐसे दिनांक को जैसा प्राधिकरण नियत करे, किया जायेगा । Re कार्यपालक अधिकारी सेक्टर या सेक्टर के किसी भाग अथवा स्कीम के लिए तैयार की गयी अभिन्‍्यास योजना को अनुमोदित करने के लिए सक्षम होगा। सेक्टर या सेक्टर के किसी भाग अथवा स्कीम की अभिन्‍्यास योजना में किसी संशोधन को मुख्य कार्यपालक अधिकारी द्वारा सम्यक रूप से अनुमोदित किया जायेगा। यदि ऐसे संशोधन में किसी सेक्टर के क्षेत्रफल और / अथवा सुविधाओं, सार्वजनिक पार्क और, अथवा हरित पट्टी की अवस्थिति में अन्त: सेक्टर परिवर्तन सम्मिलित है तो इसे विनियम 40 के उपविनियम (2) में निर्धारित प्रक्रिया के अनुसार किया जायेगा । CHAPTER-II 3. () The Authority shall as soon as possible carry out town planning and Town Planning and civic survey and prepare Draft Plan for the industrial development area; Civic Survey (2) The Draft Plan shall,— Form and (a)Indicate and describe the existing various sectors into which the Contents of development area or part thereof is divided for the purpose of development and Plan indicating the manner in which the land in each sector is being used; (b) Indicate the area of land under different land use; (c) Indicate and describe— (i) the existing roads; (ii) the existing lines of transportations and communication including Railways and Airport. (3) The Draft Plan may indicate,— (a) the existing public facilities and physical features such as rivers, water : bodies etc. (b) all or any of the matters specified in Regulation 4. (4) The Draft Plan shall consist of such maps, diagrams, charts, reports and other written matter of any explanatory or descriptive nature as pertain to the development of the whole or any part of Industrial Development Area. (5) Written matter forming part of Draft plan shall include such summary of the main development features and such descriptive matter as the Authority may consider necessary to illustrate or explain the proposals indicated by maps, charts, diagrams and other documents. (6A plan of existing land use shall also form a part of the Draft Plan for proposing the desirable utilization of land for different purposes. (7) The plan may include,- (a) Various sectors into which the Industrial Development Area or part thereof may be divided for the purpose of development; (b)The Plan may show the various existing and purposed land use indicating the desirable utilization of land for:— (i) _ Industrial Use; (ii) Residential Use; (iii) Commercial Use; (iv) Institutional use; (v) Green Use; (vi) Institutional Green use; (vii) SEZ use; (viii) Agricultural Use; (ix) Public and semi-public use; SL (x) Recreational use; (xi) Such other use as the Authority may deem fit in the course of proper development of the industrial development area; 82. RPH (Audyogik Vikas Anubhag-4) 2025 data हिटउत्तर प्रदेश असाधारण Wie, 4 जुलाई, 2025 (c) Traffic and Transportation plan consisting of proposals for road, railway and air transportation system; (d) Infrastructural plan showing proposals for land/building for the provision of water, electricity, drainage and disposal of sewage and refuse and also indicate proposals for recreational open space, civic and other infrastructural facilities; (ec) Proposals regarding Housing; (f) Plan proposing zoning regulations regarding the various activities to be permitted in different land use; (g) Plan giving the conceptual landscape for entire township, road side plantation, treatment of park, open spaces and area of active and passive recreations; (h) Such maps, diagrams charts, reports and other written matter of any explanatory or descriptive nature as pertain to the development of the whole or any part of the Industrial Area, () Written matter consisting of summary of main proposals and such descriptive matter the Authority may consider necessary to illustrate or explain the proposals indicated by the maps, charts, diagrams and other documents. (8) The plan may also provide for any other matter which is deemed necessary for the proper development of the Industrial Development Area. (9) In case of any conflict or inconsistency between the number of proposals shown on one map and those shown on any other map in respect of any land to which the plan relates, the map which is of a larger scale shall prevail and in case of any such conflict or inconsistency between any map and the written matter, the latter shall prevail. CHAPTER-II PROCEDURE FOR FINALIZATION OF PLAN 4. (I) The Authority shall as early as may be practicable after the Draft Plan has been prepared, publish a public notice stating that, (a) The Draft Plan has been prepared and may be inspected by any person at such time and place as may be specified in the notice. (b) Objections and suggestions, if any, in respect of the Draft Plan shall be sent in writing by any person to the Chief Executive Officer or any other Officer authorized by the Chief Executive Officer of the Authority before such date not being earlier than 5 days from the date of publications of Public Notice regarding preparation of Plan the notice and in such manner as may be specified in the notice. (2) This notice may be issued in Form ‘A’ appended to these regulations. (5) Every public notice mentioned in regulation 4 herein under shall be in Mode of writing under the signature of the Chief Executive Officer or any other Officer publication of the Public authorized by the Chief Executive Officer and shall be published in newspaper having Notice circulation in the town. This publication shall be published in two or more newspapers, which the Chief Executive Officer or any other officer authorized by the Chief Executive Officer of the Authority may think fit. 6. (I) After the expiry of the period specified in the notice for making Inquiry and objections and suggestions, the same will be placed before a committee to consider the hearing objections and suggestions. The committee-shall be constituted by the Chief Executive Officer and shall consist of three members. One of whom shall be town planner. The committee shall fix date(s)for disposal of objection(s)received and shall serve notice to the affected person(s/body who has filed objection(s)and may allow a personal hearing to the affected person(s)/body in connection with his/their objection(s), after intimation of the time, date and place of hearing. Explanation: The identification of affected person(s)/body shall be done by the Committee and its decision in this regard shall be final and conclusive. (3) The approved plan shall be effective for a period specified by the Authority or till the new/revised plan is approved and commenced, 9, Immediately after a plan has been approved by the State Government, 8 Date and ee of public notice shall be published under the signature of the Chief Executive Officer or any other officer authorized by the Chief Executive Office’ in the manner provided in Regulation 5 stating therein that a plan has-been approved and naming a place where a copy of the plan may be inspected at all reasonable hours and from the date of first publication of the aforesaid notice, the plan shall come into operation. 0. (I) Every amendment made under this Regulation shall be published in Amendment of the manner specified in Regulations 5 and the amended plan shall be sent to the State Meas Government for approval. The plan shall come under operation after it the plan is “approved by the State Government and then published by the Chief Executive Officer either on the date of first publication or on such other date as the Authority may fix. The Chief Executive Officer shall be competent to approve the layout Sector Layout plan prepared for the sector or a part of the sector ora scheme. Any amendment in the कक layout plan of a sector or a part of a sector or a scheme shall duly be approved by Chief Executive Officer. If such amendment involves the change in the area of a sector and / or inter-sector changes in the location of facilities, public parks and / or green belts, it shall be done in accordance of the procedure laid down in Sub regulation (2) of regulation 0.
