## Policy Analysis Report: Acquisition of Land for Eastern Dedicated Freight Corridor (Based on Notification No. 1780E) **1. Executive Summary:** This report analyzes Government of India, Ministry of Railways Railway Board Notification No. 1780E, dated April 7, 2022, concerning the acquisition of land in the Dhanbad district of Jharkhand for the Eastern Dedicated Freight Corridor (EDFC) project. The notification declares the Central Government's intent to acquire specified lands free from encumbrances, following due process and consideration of objections. This report details the objective, rationale, key provisions, affected parties, implementation aspects, and expected impact based solely on the information provided within the notification. **2. Introduction:** This report aims to provide an informative analysis of Notification No. 1780E, issued by the Government of India, Ministry of Railways Railway Board, regarding land acquisition for the Eastern Dedicated Freight Corridor project. The analysis is based exclusively on the content of the notification text provided. **3. Policy Overview:** * This is a *new policy* concerning the acquisition of land for a specific infrastructure project. * **Core Objective:** The core objective, as stated in the text, is to acquire the land specified in the schedule annexed to the notification for the execution, maintenance, management, and operation of the Special Railway Project, namely, the Eastern Dedicated Freight Corridor in the district of Dhanbad in the State of Jharkhand. **4. Background and Rationale:** * The notification addresses the need to acquire land to facilitate the construction and operation of the Eastern Dedicated Freight Corridor. The likely problem/issue addressed is the lack of land availability for this railway infrastructure project, which necessitates government intervention for acquisition. The text implies the project is vital for improving freight transportation. **5. Key Provisions / Changes:** * The notification declares that the Central Government will acquire the lands specified in the schedule annexed to the notification for the purpose of the EDFC project. * Upon publication of the notification in the official Gazette, the land specified in the schedule will vest absolutely in the Central Government, free from all encumbrances (claims, liens, etc.). * The schedule specifies the land being acquired, including details of the district (Dhanbad), circle, mauza (village), thana (police station), khata number, plot number, area (in acres and hectares), type of land (Raiyati - tenant land), nature of the land, and the names of the recorded owners. * The notification references prior actions, including a preliminary notification (S.O. 118E, dated January 5, 2022) declaring the government's intention to acquire the land, publication of the substance of the notification in newspapers (Dainik Jagran and The Times of India on January 20, 2022), and consideration of any objections received. The notification also states that no objections were received or that they were considered and orders passed. **6. Target Audience and Stakeholders:** The primary target audience and stakeholders directly affected by this policy include: * **Landowners:** The individuals and entities listed in the schedule as the recorded owners of the land being acquired (e.g., Baid Bipeen Mandal, Milan Mandal, Bahal Nanhu Miya, Sanik Mandal). * **Residents of Dhanbad District:** Particularly those residing in the areas where land acquisition is taking place (e.g., Kaliyasol Kayarabank, Katajani, Elakend, Kalubathan). * **Ministry of Railways and Railway Board:** The government agencies responsible for implementing the EDFC project. * **Construction and Operation Entities:** Companies involved in the execution, maintenance, management, and operation of the EDFC. **7. Implementation Aspects (Inferred):** * **Responsible agency/bodies:** The Central Government (Ministry of Railways and Railway Board) is the primary responsible body. A "competent authority" submitted a report to the Central Government, suggesting a delegated implementation structure. * **Timelines or procedures:** The notification states that the land will vest in the Central Government upon publication of the notification in the official Gazette. The process involves prior notification, publication in newspapers, consideration of objections, and submission of a report by the competent authority. * **Compensation:** While not explicitly stated in this specific notification, land acquisition typically involves compensation to landowners, which is an implied aspect of implementation based on general land acquisition principles. **8. Expected Outcomes / Impact:** * The primary intended outcome is to secure the necessary land for the construction and operation of the Eastern Dedicated Freight Corridor. * The acquisition of land free from encumbrances is expected to facilitate the timely and efficient execution of the EDFC project. * The project is likely to improve freight transportation infrastructure in the region, potentially leading to economic benefits. * Landowners will be displaced, requiring resettlement and/or compensation. **9. Conclusion:** Notification No. 1780E represents a crucial step in acquiring land for the Eastern Dedicated Freight Corridor project. By declaring the government's intention to acquire specified lands in the Dhanbad district of Jharkhand, free from encumbrances, the notification paves the way for the execution of this significant railway infrastructure project. The impact will be most directly felt by landowners and residents in the affected areas, while the broader region is expected to benefit from improved freight transportation infrastructure. This policy is significant because it enforces eminent domain to facilitate a crucial infrastructure project.
