L.-33004/99 सससससीीीीी.....जजजजजीीीीी.....-----डडडडडीीीीी.....एएएएएललललल.....-----अअअअअ.....-----1111111111000008888822222000002222233333-----222224444488888000002222244444 CCCCCGGGGG-----DDDDDxLLLLLx-----xEEEEEG-----I11111D11111H00000x88888x22222x00000 2222233333-----222224444488888000002222244444 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 3434] नई दिल्ली, िुक्रवार, अगस्ट्त 11, 2023/श्रावण 20, 1945 No. 3434] NEW DELHI, FRIDAY, AUGUST 11 , 2023/SHRAVANA 20, 1945 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 10 अगस्ट् त, 2023 का.आ. 3588(अ).—यत: आधार (वित्तीय और अन्य सवससडी, लाभ और सिे ाओं का लवित वितरण) अवधवियम, 2016 (2016 का 18) की धारा 4 की उ+9प-धारा (4) की खडं (ख) की उप-धारा (2) ऐस े प्रयोजिों हते ु स्िैवछिक आधार पर प्रमाणीकरण की अिुमवत प्रदाि करता ह,ै जैसा कक राज्य के वहत म ेंभारतीय विविष्ट पहचाि प्रावधकरण के साथ परामि श स े केन्रीय सरकार, विवहत करे; और यत: केन्रीय सरकार ि े सुिासि (समाज कल्याण, ििाचार, ज्ञाि) वियमािली, 2020 के वलए आधार प्रमाणीकरण (इसके बाद इस े उक्त वियमािली कहा जाएगा) ककया ह ै वजसके अंतगशत केन्रीय सरकार विम्नवलवखत प्रयोजिों हते ु स्िैवछिक आधार पर आधार प्रमाणीकरण का उपयोग करिे के वलए अिुमवत मागं सकती ह,ै िामत:- 1. सुिासि सुविवित करिे के वलए वडवजटल प्लैटफोमो का उपयोग ; 2. समाज कल्याण लाभों के अपव्यय की रोकथाम; और 3. ििाचार को सिम करिा और ज्ञाि का विस्तार। और यत: सड़क पररिहि और राजमागश मंत्रालय ि े मंत्रालय की सड़क पररिहि और अिसंरचिा विमाशण पररयोजिाओं की बोवलयों हते ु परामिी फमो द्वारा कायों के वलए वियुक्त ककए जा रह े प्रमुख कार्मशकों के ऑिलाइि पंजीकरण के वलए सत्यापि हते ु आधार प्रमाणीकरण का उपयोग करि े के वलए उक्त वियमािली के वियम 4 के अंतगशत इलेक्ट्रॉविक और सूचिा प्रौद्योवगकी मंत्रालय को एक आिेदि ककया ह;ै 5180 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और यत: इलेक्ट्रॉविक और सचू िा प्रौद्योवगकी मंत्रालय ि े ऑिलाइि पंजीकरण की प्रकिया के दौराि, सड़क पररिहि और राजमाग श मंत्रालय, केन्रीय लोक विमाशण विभाग और राज्य विमाशण विभागों के सड़क और अिसंरचिा विमाशण काय श तथा पररयोजिाओं हते ु बोवलयों के मल्ू यांकि म ें िावमल प्रमुख व्यवक्तयों की पहचाि स्थावपत करिे के वलए हा ं या िहीं और ई-केिाईसी का उपयोग करते हुए, स्िैवछिक आधार पर, वििावसयों के आधार प्रमाणीकरण के प्रदििश के वलए उक्त वियमािली के वियम अंतगशत सड़क पररिहि और राजमागश मंत्रालय को प्रावधकृत ककया; अब, इसवलए, सिु ासि (समाज कल्याण, ििाचार, ज्ञाि) वियमािली, 2020 के वलए आधार प्रमाणीकरण के वियम 5 के अिुसरण म,ें सड़क पररिहि और राजमाग श मंत्रालय एतद्द्वारा विम्नवलवखत अवधसूवचत करता ह,ै िामत:- (क) सड़क पररिहि और राजमाग श मंत्रालय, अपिी कायाशन्ियि एजेंसी, राष्ट्रीय राजमाग श एि ं अिसंरचिा विकास विगम वलवमटेड और सड़क पररिहि और राजमागश मंत्रालय के माध्यम स े ई-गििेंस के वलए बायोमेररक/िि टाइम पासिडश और ई-केिाईसी सेिा का उपयोग करके प्रमाणीकरण कर सकता ह ै तथा राष्ट्रीय राजमाग श एि ं अिसंरचिा विकास विगम वलवमटेड, उक्त वियमािली के वियम 4 के अतं गतश उवल्लवखत उपभोक्ता एजेंसी के उप-प्रमाणीकरण के वलए मंत्रालय और राष्ट्रीय राजमाग श एि ं अिसंरचिा विकास विगम वलवमटेड के बीच हस्तािररत समझौता ज्ञापि की विबंधि एि ंितों का पालि करेगा; (ख) आिावसयों का आधार प्रमाणीकरण मंत्रालय द्वारा इसकी कायाशन्ियि एजेंसी राष्ट्रीय राजमागश एिं अिसंरचिा विकास विगम वलवमटेड के माध्यम स े भारतीय विविष्ट पहचाि प्रावधकरण के सेिा अिुप्रयोग का उपयोग करत े हुए ककया जाएगा और उसके पिात् संबंवधत आिासी की सहमवत प्राप्त करि े के पिात ् ही बायोमैररक और िि टाइम पासिडश का उपयोग करत े हुए आिावसयों की जिसांवखकीय जािकारी प्राप्त की जाएगी; 2. अवधसूचिा, सरकारी राजपत्र म ें इसके प्रकािि की तारीख स े प्रिृत्त होगी । [फा.स.ं ए-12025/8/2023- एिएचआईडीसीएल सेल] महमदू अहमद, अपर सवचि MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 10th August, 2023 S.O. 3588(E).—WHEREAS sub-section (2) of clause (b) of sub-section (4) of section 4 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) allows performing authentication on voluntary basis for such purposes as the Central Government in consultation with Unique Identification Authority of India and in the interest of the State, may prescribe; AND WHEREAS the Central Government has made the Aadhaar Authentication for Good Governance (Social Welfare, Innovation, Knowledge) Rules, 2020 (hereinafter referred to as the said rules) under which the Government can seek permission to use aadhaar authentication on voluntary basis, for the following purposes, namely: — (a) usage of digital platforms to ensure good governance; (b) prevention of dissipation of social welfare benefits; and (c) enablement of innovation and the spread of knowledge. AND WHEREAS the Ministry of Road Transport and Highways has made an application to the Ministry of Electronics and Information Technology under rule 4 of the said rules for using aadhaar authentication for verification for online registration of key personnel being engaged by consultancy firms for Road Transport and Infrastructure construction bids for projects of the Ministry; AND WHEREAS the Ministry of Electronics and Information Technology authorised the Ministry of Road Transport and Highways under rule 5 of the said rules for performance of aadhaar authentication of residents, on voluntary basis, using yes or no and e-KYC authentication facility, for establishing the identity of key persons involved in road and infrastructure construction work and evaluation of bids for projects of the Ministry of Road[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 Transport and Highways, the Central Public Work Department and State Public Works Departments during the process of online registration; NOW, THEREFORE. in pursuance of rule 5 of the Aadhaar Authentication for Good Governance (Social Welfare, Innovation, Knowledge) Rules, 2020, the Ministry of Road Transport and Highways hereby notifies the following, namely: — a. the Ministry of Road Transport and Highways may carry out authentication using biometric/ One Time Password methods as well as e-KYC service for the e-Governance applications of Ministry through its implementing agency, National Highways and Infrastructure Development Corporation Limited and the Ministry of Road Transport and Highways and National Highways and Infrastructure Development Corporation Limited shall abide by the terms and conditions of the Memorandum of Understanding entered into between the Ministry and National Highways and Infrastructure Development Corporation Limited for sub-authentication user agency mentioned under rule 4 of the said rules; b. the aadhaar authentication of residents shall be performed by the Ministry through its implementation agency National Highways and Infrastructure Development Corporation Limited by using service application of the Unique Identification Authority of India and then fetch demographic information of the residents using biometric and one-time password only after obtaining the consent of the resident concerned; 2.
