की संभावना ह,ै उस तारीख से जिसको उि अजधसूचना में अतं र्वगष्ट रािपत्र की प्रजतयां िनता को उपलब्ध करा िी गई थीं,
तीस दिन की अवजध की समाजि से पहले आिेप और सुझाव अमं ंजत्रत दकए गए थे;
और उि रािपत्र की प्रजतया ं जिसमें उि अजधसूचना प्रकाजित की गई थी, िनता को 18 अप्रलै , 2022 को
उपलब्ध करा िी गई थीं;
और उि प्रारुप जनयमों के संबंध म ें िनता स े प्राि आिेपों और सुझावों पर केन्द्द्रीय सरकार द्वारा जवचार कर जलया
गया ह;ै
अतः अब, केन्द्द्रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 27 द्वारा प्रित्त िजियों का
प्रयोग करते हुए, केन्द्द्रीय मोटर यान जनयम, 1989 का और सिं ोधन करने के जलए जनम्नजलजखत जनयम बनाती ह,ै अथागत्:-
1. संजिि नाम और प्रारंभ – (1) इन जनयमों का संजिि नाम केन्द्द्रीय मोटर यान (सोलहवां संिोधन) जनयम, 2022 ह ै।
(2) य ेरािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंग े।

2. केंद्रीय मोटर यान जनयम, 1989 (जिसे इसम ेंइसके पश् चात ् उि जनयम कहा गया ह ैके जनयम 11 म,ें-
(क) उप-जनयम (1) के स्ट्थान पर जनम्नजलजखत उपजनयम रखा िाएगा, अथागत ्:-
“(1) जनयम 10 के अधीन आवेिन प्रस्ट्तुत करन े के सात दिन के भीतर, जििाथी अनुज्ञजि के जलए प्रत्येक आवेिक, पोटगल पर
इलैक्ट्राजनक रुप से सुरजित चालन संबंधी अनुजििण या तो स्ट्वयं आवेिक द्वारा उस पर पहुचं कर या सुजवधा केन्द्द्र की
सहायता से पूरा करेगा";
(ख) उप-जनयम (2) म,ें खंड (घ) के पश्चात,् जनम्नजलजखत खंड अंतःस्ट्थाजपत दकया िाएगा, अथागत्: -
"(ड़) ईंधन िि चालन तकनीक का ज्ञान और समझ होना;"
3.उि जनयमों के जनयम 14 म,ें उपजनयम (1) के स्ट्थान पर जनम्नजलजखत उपजनयम रखा िाएगा, अथातग ् :-
“(1) चालन अनुज्ञजि के जलए आवेिन प्ररुप 4 म ें दकया िाएगा और उसके साथ जनम्नजलजखत होंगे -
(क) उस प्रकार के यान का जिससे आवेिन संबंजधत ह ैचलान े की कोई प्रभावी जििाथी अनुज्ञजि;
(ख) यथाजस्ट्थजत, परीिण या पश्चात्वती परीिण जनयम 32 म ें प्रत्येक वग ग को चलान े के जलए और अनुज्ञजि िारी करने के
जलए यथाजवजनर्िष्टग समुजचत फीस;
(ग) आवेिक का हाल का पासपोटग आकार जचत्र;
(घ) जनयम 6 में यथा-अन्द्यथा उपबंजधत के जसवाय पररवहन यान चलाने के जलए अनुज्ञजि के जलए आवेिन के मामले म ें
प्ररुप 1 क म ेंजचदकत्सा प्रमाणपत्र;
(ड.) पररवहन यान चलान े के जलए चालन अनज्ञु जि के जलए आवेिन के मामल े में, उस स्ट्कूल या स्ट्थापन से िहां आवेिक न े
अनुिेि यदि कोई हो, प्राि दकए ह,ै िारी दकया गया प्ररुप 5 में चालन प्रमाणपत्र;
(च) जनवास और आय ुका सबूत;
(छ) जनयम 31ड. के अनुसार प्ररुप 5ख में प्रत्यायन चालक प्रजििण केन्द्द्र स ेप्रमाणपत्र”।
4. उि जनयमों के जनयम 31ग में “नवीकरण के जलए दिया िा सकेगा” िब्िों के पहले “आवेिन पर” के पश्चात ् “एक बार म ें
पांच वर्ग की अवजध के जलए” िब्ि अतं ःस्ट्थाजपत दकए िाएगं े ।
5. उि जनयमों के जनयम 31ञ में.-
(क) उपजनयम (1) म ें हल्के मोटर यान चालक स े संबंजधक खडं क के पश्चात ् जनम्नजलजखत खडं अंतःस्ट्थाजपत दकया िाएगा,
अथागत ् :-

NOTIFICATION
New Delhi, the 20th September, 2022
G.S.R. 714(E).—Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989,
were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of
1988), vide notification of the Ministry of Road Transport and Highways, Government of India , number
G.S.R. 299 (E), dated the 18th April, 2022 in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-
section (i) , inviting objections and suggestions from all persons likely to be affected thereby, before the
expiry of the period of thirty days from the date on which copies of the Official Gazette containing the said
notification were made available to public;
And, whereas, copies of the said Official Gazette in which the said notification was published, were
made available to the public on the 18th April, 2022;
And, whereas, the objections and suggestions received from the public in respect of the said draft
rules have been duly considered by the Central Government;
Now, therefore, in exercise of powers the conferred under section 27 of the Motor Vehicles Act,
1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central
Motor Vehicles Rules, 1989, namely:-
1. (1) These rules may be called the Central Motor Vehicles (Sixteenth Amendment) Rules, 2022.

2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), in rule 11, -
(a) for sub-rule (1), the following sub-rule shall be substituted, namely:-
“(1) Within seven days of submitting an application under rule 10, every applicant for a learner’s license
shall complete a tutorial on safe driving, electronically on a Portal, either accessed by the applicant himself
or with the help of a Facilitation Centre.”;
(b) in sub-rule (2), after clause (d), the following clause shall be inserted, namely:-
“(e) knowledge and understanding of fuel efficient driving technique;”.
3. In rule 14 of the said rules, for sub-rule (1), the following sub-rule shall be substituted, namely:-
“(1) An application for a driving license shall be made in Form 4 and shall be accompanied by-
(a) an effective learner’s license to drive the vehicle of the type to which the application relates;
(b) appropriate fee as specified in rule 32, for the test, or the subsequent test, as the case may be, of
competence to drive for each class and for issue of licence;
(c) the applicant’s recent passport size photograph;
(d) save as otherwise provided in rule 6, a medical certificate in Form 1A in case of an application for
license to drive a transport vehicle;
(e) in the case of an application for driving license to drive a transport vehicle, a driving certificate in Form
5 issued by the school or establishment from where the applicant received instruction, if any;
(f) proof of residence and age;
(g) certificate from Accredited Driver Training Centre in Form 5B as per rule 31E, if any.”.
4. In rule 31C of the said rules, after the words “may be renewed”, the words “, for a period of five
years at a time,” shall be inserted.
5. In rule 31J of the said rules,-

6. In rule 32 of the said rules, in the table, for the Serial Numbers 14, 14, 15 and 16 and the entries
relating thereto, the following Serial Numbers and entries shall be substituted, namely:-
