WHEREAS the Tamil Nadu Universities Laws (Second Amendment) Bill, 2022 (L.A.Bill No.48 of 2022) was passed by the Tamil Nadu Legislative Assembly on the 19th October 2022 and was presented to the Governor for his assent; AND WHEREAS the Governor withheld the assent to the said Bill on the 13th November 2023; AND WHEREAS based on the resolution moved by the Hon’ble Chief Minister, which was passed unanimously in the Tamil Nadu Legislative Assembly on the 18th November 2023, the said Bill was reconsidered and passed again by the Tamil Nadu Legislative Assembly without any change; AND WHEREAS the said L.A.Bill No.48 of 2022 was presented again to the Governor on the 18th November 2023 and he reserved the Bill for consideration of the Hon’ble President on the 28th November 2023; AND WHEREAS the Hon’ble President assented to the said Bill on the 18th February 2024 and the same was published as Tamil Nadu Act 10 of 2024 in Part IV - Section 2 of the Tamil Nadu Government Gazette Extraordinary, dated the 7th March 2024 and the said Act came into force on the above said date, namely on the 7th March 2024; [87] IV-2—Ex. (169)88 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY AND WHEREAS the Hon’ble Supreme Court, in its Judgment, dated 08.04.2025 in W.P.(C) No.1239/2023 has ordered that the consequential action of the Hon’ble President after the date of reserving the above said Bill is non-est in law and that the said Bill shall be deemed to have been assented by the Governor on the date on which the said Bill was presented to the Governor for assent, after being reconsidered by the Tamil Nadu Legislative Assembly, that is, on the 18th November 2023; AND WHEREAS in view of the above said Judgment of the Hon’ble Supreme Court of India, dated 08.04.2025, the said Tamil Nadu Act 10 of 2024 is non-est in law. NOW, THEREFORE, the following Act of the Tamil Nadu Legislative Assembly which is deemed to have received the assent of the Governor on the 18th November 2023, pursuant to the Judgment of the Hon’ble Supreme Court of India, made under Article 142 of the Constitution of India in WRIT PETITION (CIVIL) No.1239 of 2023 titled “THE STATE OF TAMIL NADU Vs THE GOVERNOR OF TAMIL NADU & ANOTHER”, dated the 8th April 2025 is hereby published for general information:— ACT No. 23 of 2025. An Act further to amend the Tamil Nadu Universities Laws. Be it enacted by the Legislative Assembly of the State of Tamil Nadu in the Seventy third Year of the Republic of India as follows:— PART-I. PRELIMINARY. Short title and 1. (1) This Act may be called the Tamil Nadu Universities Laws commencement. (Second Amendment) Act, 2022. (2) It shall come into force at once. PART-II. AMENDMENTS TO THE MADURAI-KAMARAJ UNIVERSITY ACT, 1965. Amendment of 2. In section 10 of the Madurai – Kamaraj University Act, 1965 Tamil Nadu Act section 10. (hereafter in this Part referred to as the 1965 Act), in sub-section (1), 33 of 1965. for the expression “Education”, the expression “Higher Education” shall be substituted. Amendment of 3. In section 19 of the 1965 Act,— section 19. (1) in clause (a), under the heading “Class I—Ex-Officio Members.”,— (i) in item (1), for the expression “Education;”, the expression “Higher Education;” shall be substituted;TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY 89 (ii) item (1-AAA), shall be renumbered as item (1-AAAA), and before item (1-AAAA) as so renumbered, the following item shall be inserted, namely:— “(1-AAA) The Secretary to Government in-charge of Finance;”; (2) in clause (aa),— (i) for the expression “Education”, the expression “Higher Education” shall be substituted; (ii) after the expression “the Secretary to Government in-charge of Law”, the expression “or the Secretary to Government in-charge of Finance” shall be inserted. PART-III. AMENDMENT TO THE ANNA UNIVERSITY ACT, 1978. Tamil Nadu Act 4. In section 17 of the Anna University Act, 1978,— Amendment of 30 of 1978. section 17. (1) in sub-section (2), under the heading “Class I–Ex-Officio Members.”, after item (d), the following item shall be inserted, namely:— “(dd) The Secretary to Government, in-charge of Finance;”; (2) in sub-section (4), in clause (i), after the expression “the Secretary to Government, in-charge of Law”, the expression “or the Secretary to Government in-charge of Finance” shall be inserted. PART-IV. AMENDMENTS TO THE BHARATHIAR UNIVERSITY ACT, 1981. Tamil Nadu Act 5. In section 11 of the Bharathiar University Act, 1981 (hereafter Amendment of 1 of 1982. in this Part referred to as Tamil Nadu Act 1 of 1982), in sub-section section 11. (1), for the expression “Education” the expression “Higher Education” shall be substituted. 6. In section 24 of Tamil Nadu Act 1 of 1982,— Amendment of section 24. (1) in clause (b), under the heading “Class I—Ex-Officio Members.”,— (i) in item (1), for the expression “Education;”, the expression “Higher Education;” shall be substituted; (ii) after item (1-AA), the following item shall be inserted, namely:— “(1-AAA) The Secretary to Government in-charge of Finance;”; (2) in clause (d),— (i) for the expression “Education”, the expression “Higher Education” shall be substituted; (ii) after the expression “the Secretary to Government in-charge of Law”, the expression “or the Secretary to Government in-charge of Finance” shall be inserted.90 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY Amendment of 7. In section 32 of Tamil Nadu Act 1 of 1982, in sub-section section 32. (1), in item (iii), for the expression “Education;”, the expression “Higher Education;” shall be substituted. PART-V. AMENDMENTS TO THE BHARATHIDASAN UNIVERSITY ACT, 1981. Amendment of 8. In section 11 of the Bharathidasan University Act, 1981(hereafter Tamil Nadu Act section 11. in this Part referred to as Tamil Nadu Act 2 of 1982), in sub-section 2 of 1982. (1), for the expression “Education”, the expression “Higher Education” shall be substituted. Amendment of 9. In section 24 of Tamil Nadu Act 2 of 1982, — section 24. (1) in clause (b), under the heading “Class I—Ex-officio Members.”,— (i) in item (1), for the expression “Education;”, the expression “Higher Education;” shall be substituted; (ii) after item (1-AA), the following item shall be inserted, namely:— “(1-AAA) The Secretary to Government in-charge of Finance;”; (2) in clause (d),— (i) for the expression “Education”, the expression “Higher Education” shall be substituted; (ii) after the expression “the Secretary to Government in-charge of Law”, the expression “or the Secretary to Government in-charge of Finance” shall be inserted. PART-VI. AMENDMENTS TO THE MOTHER TERESA WOMEN’S UNIVERSITY ACT, 1984. Amendment of 11. In section 11 of the Mother Teresa Women’s University Act, Tamil Nadu Act section 11. 1984 (hereafter in this Part referred to as the 1984 Act), in sub-section 15 of 1984. (1), for the expression “Education”, the expression “Higher Education” shall be substituted. Amendment of 12. In section 20 of the 1984 Act, — section 20. (1) in clause (a), under the heading “Class I—Ex-officio Members”, in item (4), for the expression “Education;”, the expression “Higher Education;” shall be substituted; (2) in clause (b), for the expression, “Education” the expression, “Higher Education” shall be substituted.TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY 91 13. In section 23 of the 1984 Act, — Amendment of section 23. (1) in clause (b), under the heading “Class I—Ex-officio Members.”, in item (1), for the expression “Education;”, the expression “Higher Education;” shall be substituted; (2) in clause (d), for the expression “Education”, the expression “Higher Education” shall be substituted. 14. In section 31 of the 1984 Act, in sub-section (1), in item (c), for Amendment of the expression “Education;”, the expression “Higher Education;” shall section 31. be substituted. PART-VII. AMENDMENTS TO THE ALAGAPPA UNIVERSITY ACT, 1985. Tamil Nadu Act 15. In section 12 of the Alagappa University Act, 1985 (hereafter Amendment of 23 of 1985. in this Part referred to as the 1985 Act), in sub-section (1), for the section 12. expression “Education”, the expression “Higher Education” shall be substituted. 16. In section 21 of the 1985 Act,— Amendment of section 21. (1) in clause (a), under the heading “Class I—Ex-officio Members.”, in item (4), for the expression “Education;”, the expression “Higher Education;” shall be substituted; (2) in clause (b), in sub-clause (i), for the expression “Education”, the expression “Higher Education” shall be substituted. 17. In section 25 of the 1985 Act,— Amendment of section 25. (1) in clause (b), under the heading “Class II — Ex-officio Members”,— (i) in item (1), for the expression “Education;”, the expression “Higher Education;” shall be substituted; (ii) after item (2-A), the following item shall be inserted, namely:— “(2-AA) The Secretary to Government in-charge of Finance;”; (2) in clause (d),in sub-clause (i),— (i) for the expression “Education”, the expression “Higher Education” shall be substituted; (ii) after the expression “the Secretary to Government in-charge of Law”, the expression “or the Secretary to Government in-charge of Finance” shall be inserted. 18. In section 33 of the 1985 Act, in sub-section (1), in item (iii), for Amendment of the expression “Education;” the expression “Higher Education;” shall section 33. be substituted.92 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY PART-VIII. AMENDMENTS TO THE MANONMANIAM SUNDARANAR UNIVERSITY ACT, 1990. Amendment of 19. In section 10 of the Manonmaniam Sundaranar University Act, Tamil Nadu Act section 10. 1990 (hereafter in this Part referred to as the 1990 Act), in sub-section 31 of 1990. (1), for the expression “Education”, the expression “Higher Education” shall be substituted. Amendment of 20. In section 23 of the 1990 Act,— section 23. (1) in clause (b), under the heading “Class I—Ex-officio Members.”,— (i) in item (1), for the expression “Education;”, the expression “Higher Education;” shall be substituted; (ii) after item (3), the following item shall be inserted, namely:— “(3-A) The Secretary to Government in-charge of Finance;”; (2) in clause (d),— (i) for the expression “Education”, the expression “Higher Education” shall be substituted; (ii) after the expression “the Secretary to Government in-charge of Law”, the expression “or the Secretary to Government in-charge of Finance” shall be inserted. Amendment of 21. In section 31 of the 1990 Act, in sub-section (1), in item (iii), for section 31. the expression “Education;” the expression “Higher Education;” shall be substituted. PART-IX. AMENDMENTS TO THE PERIYAR UNIVERSITY ACT, 1997. Amendment of 22. In section 11 of the Periyar University Act, 1997 (hereafter Tamil Nadu Act section 11. in this Part referred to as the 1997 Act), in sub-section (1), for the 45 of 1997. expression “Education”, the expression “Higher Education” shall be substituted. Amendment of 23. In section 24 of the 1997 Act,— section 24. (1) in clause (b), under the heading “Class I—Ex-officio Members.”, after item (3), the following item shall be inserted, namely:— “(3-A) The Secretary to Government in-charge of Finance;”; (2) in clause (d), after the expression “the Secretary to Government, in-charge of Law”, the expression “or the Secretary to Government, in-charge of Finance” shall be inserted.TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY 93 PART-X. AMENDMENTS TO THE TAMIL NADU OPEN UNIVERSITY ACT, 2002. Tamil Nadu Act 24. In section 9 of the Tamil Nadu Open University Act, 2002 Amendment of 27 of 2002. (hereafter in this Part referred to as Tamil Nadu Act 27 of 2002), in section 9. sub-section (1), for the expression “Education”, the expression “Higher Education” shall be substituted. 25. In section 20 of Tamil Nadu Act 27 of 2002,— Amendment of section 20. (1) in sub-section (2), under the heading “Class I—Ex-officio members.”, after item (a), the following item shall be inserted, namely:— “(aa) The Secretary to Government in-charge of Finance;”; (2) after sub-section (2), the following sub-section shall be inserted, namely:— “(2-A) In case the Secretary to Government in-charge of Finance, is unable to attend the meetings of the Syndicate, for any reason, he may depute any officer of his department, not below the rank of Deputy Secretary to Government to attend the meetings. The officer so deputed shall have the right to take part in the discussions of the meeting and shall have the right to vote.”. PART–XI. AMENDMENTS TO THE THIRUVALLUVAR UNIVERSITY ACT, 2002. Tamil Nadu Act 26. In section 11 of the Thiruvalluvar University Act, 2002 (hereafter Amendment of 32 of 2002. in this Part referred to as Tamil Nadu Act 32 of 2002), in sub-section section 11. (1), for the expression “Education”, the expression “Higher Education” shall be substituted. 27. In section 23 of Tamil Nadu Act 32 of 2002,— Amendment of section 23. (1) in clause (b), after item (1), the following item shall be inserted, namely:— “(1-A) The Secretary to Government in-charge of Finance;”; (2) after clause (c), the following clause shall be inserted, namely:— “(cc) In case the Secretary to Government in-charge of Finance, is unable to attend the meetings of the Syndicate, for any reason, he may depute any officer of his department, not below the rank of Deputy Secretary to Government to attend the meetings.
