F. No. 7-6/DD-Admn/NSQF/2013-II.—In exercise of powers conferred under sub-section (1) of Section 23 read with Section 10 of the All India Council for Technical Education Act 1987 (52 of 1987), the All India Council for Technical Education (AICTE) makes the following Regulations to amend the “All India Council for Technical Education (Grant of Approval for conducting Vocational Education Program, Community College course(s) and Skill Knowledge Provider under National Vocational Education Qualification Framework' Regulations, 2012. Short Title and Commencement: 1. These Regulations may be called All India Council for Technical Education (Grant of Approval for conducting Vocational Education Program, Community College course(s) and Skill Knowledge Provider under National Vocational Education Qualification Framework) (1st Amendment), Regulations, 2014. 2. They shall come into force w.e.f. the date of their publication in the Gazette of India. 3. Clause 1.1 of the “All India Council for Technical Education (Grant of Approval for conducting Vocational Education Program, Community College course(s) and Skill Knowledge Provider under National Vocational Education Qualification Framework' Regulations, 2012 (hereinafter to be called the Principal Regulation) shall stand amended and substituted by the following clause: “1.1 These Regulations may be called the “All India Council for Technical Education (Grant of Approval for conducting Vocational Education Program, Community College course(s) and Skill Knowledge Provider under National Skill Qualification Framework) Regulations, 2014.” 4. Clause 2.9 of the Principal Regulation shall stand amended and substituted by the following clause: “2.9 “Community College" means Institution offering Diploma Education duly approved by the Council to conduct Technical Education Program and /or the college recognized by the Central Statutory Body and/or affiliated by the University or the State Board of Technical Education, as the case may be and conducting Vocational Education under NSQF scheme.” 5. Clause 2.10 of the Principal Regulation shall stand amended and substituted by the following clause:- “2.10 "Community College course" means specialization in a specific sector under NSQF scheme.” 6. Clause 2.11 of the Principal Regulation shall stand amended and substituted by the following clause:- “2.11 “Vocational Course" means specialization in a specific sector under NSQF scheme.” 7. Clause 2.25 of the Principal Regulation shall stand amended and substituted by the following clause:- “2.25 “LEVEL” as specified in NSQF Scheme notified by Ministry of Finance, (Department of Economic Affairs)” 8. Clause 2.26 of the Principal Regulation shall stand amended and substituted by the following clause:- “2.26 "NATIONAL SKILL QUALIFICATION FRAMEWORK" means framework of vocational education program as notified by Ministry of Finance vide No. 8/6/2013-Invt. dated 27th December, 2013.” 9. Clause 2.27 of the Principal Regulation shall stand amended and substituted by the following clause:-¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 5 “2.27 “Vocational Education" means imparting Vocational courses in a certain specialization at a certain level along with General Education under NSQF scheme.” 10. Clause 2.32 of the Principal Regulation shall stand amended and substituted by the following clause:- “2.32 “SKILL KNOWLEDGE PROVIDER" means the competency based knowledge provider which will impart skill based training of Vocational Content under NSQF Scheme.” 11. Clause 4.20 of the Principal Regulation shall stand amended and substituted by the following clause:- “4.20 Institutions and SKP granted Letter of Approval for conduct of VE, Community College Courses and SKP under NSQF shall comply with appointment of teaching staff, coordinator, and Principal/Director as the case may be, as per policy regarding minimum qualifications, pay scales etc., norms prescribed by the Council and other supporting staff & administrative staff as per the schedule prescribed in Approval Process Handbook. Institutions other than minority Institutions shall appoint teaching staff / coordinator / Principal / Director and other supporting staff and administrative staff strictly in accordance with the methods and procedures of the concerned affiliating University / Technical Board particularly in case of selection procedures and selection Committees. The information about these appointments of staff in the prescribed format shall also be uploaded on the web-portal of AICTE as per the schedule prescribed in the Approval Process Handbook. In no circumstances, unless the appointment of all teaching and other staff is in place, the Institution and/or SKP shall start the approved Courses.” 12. Clause 6 of the Principal Regulation shall stand amended and substituted by the following clause:- “6.0 The promoter society / trust / company established under Section 25 of the Companies Act, 1956 of a Education Institution / SKP shall have the land as required and prescribed in its lawful possession with clear ownership title or term lease not less than 30 years in the name of promoter society / trust / Company Act, 1956 on or before the date of submission of application. Provided that it shall be open for the promoter society / trust / company established under Section 25 of the Companies Act, 1956 proposed Institution / SKP to mortgage the land only after the receipt of letter of approval, only for raising the resources for the purpose of development of the Education Institute / SKP situated on the land.” 13. Clause 11.0 of the Principal Regulation shall stand amended and substituted by the following clause:- “11 Penalty An Institution / SKP running any education / skill training under NSQF in violation of these Regulations, shall be liable for initiation of legal civil action including withdrawal of approval, if any, and / or legal criminal action by the Council against the Institution and/or6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III —SEC. 4 its Society/ Trust/ Section 25 Company and Individuals / any other associated as the case may be. Provided further that if any Institution/SKP contravenes any of the provisions of these Regulations, the Council after making such inquiry as it may consider appropriate and after giving Institution / SKP concerned an opportunity to clarify the matter, may take any or all actions as specified below and as the case may be.” 14. Clause 12.1 of the Principal Regulation shall stand amended and substituted by the following clause:- “12.1 An Institution/SKP running any Vocational Educational Program in violation of Regulations or/and Approval Process Handbook, shall be liable for initiation of appropriate Penal Civil action including withdrawal of approval, if any, and / or criminal action by the Council against defaulting Societies/Trusts/Companies / Associated Individuals and / or the Institution / SKP, as the case may be. Provided that, if any Institution/SKP contravenes any of the provisions of concerned regulations, the council after making such inquiry as it may consider appropriate and after giving these Institution/SKP concerned, an opportunity of being heard, under appropriate regulations, withdraw approval to the concerned Institution/SKP. Provide further that in case of such a withdrawal, the operations of the said Institution / SKP shall not be started again before completion of two academic years from the date of such a withdrawal. Provided further that, the students admitted to the Institute/SKP whose approval has been withdrawal, shall be redistributed to other Institutions/SKP in the jurisdiction of the affiliating University or Board by the competent authority of the respective State Governments. Such Institution / SKP where the approval has been withdrawn, the restoration shall be as per the procedure for seeking fresh approval of the council for conduct of courses under NSQF by Institute/SKP.” Dr. AVINASH S.
