हुए, केंद्र सरकार ने पिओंु के प्रजत क्रूरता जनिारण (पि ु क्रूरता जनिारण सोसाइटी की स्ट्थापना और जिजनयमन) जनयम, 2001, में सामाजजक न्याय और अजधकाररता मंत्रालय, भारत सरकार द्वारा भारत के राजपत्र, असाधारण के भाग II, खंड 3, उपखंड (ii) में तारीख 26 माचच, 2001 को सा. आ. सं. 271 (अ.) द्वारा भारत के राजपत्र असाधारण में प्रकाजित पिओंु के प्रजत क्रूरता जनिारण (पिु क्रूरता जनिारण सोसाइटी की स्ट्थापना और जिजनयमन) जनयम, 2001 में इस तरह के अजधक्रमण से पहल े दकए गए या छोडे गए कायों को छोडकर संिोधन करन े का जनणचय जलया है, केन् द्रीय सरकार, भारत के राजपत्र म ें इन मसौदा जनयमों को इनके प्रकािन के तीस ददनों के भीतर सािचजजनक रटप् पजणयों हते ु प्रकाजित कर रही ह।ै जो भी व्यजि इन मसौदा जनयमों के संबंध म ें कोई सुझाि या आपजत्त देना चाहता ह,ै िह उपरोि जनर्ददष्ट अिजध म ें संयुि सजचि (पिु कल्याण), पिुपालन और डेयरी जिभाग, मत्‍स्ट्यपालन, पिुपालन और डेयरी मंत्रालय, कमरा स.ं 245, कृजि भिन, डॉ. राजेंद्र प्रसाद रोड, नई ददल्ली 110001 को केंद्र सरकार के जिचार के जलए अग्रेजित कर सकता ह।ै । 1. िीिकच और जिस्ट्त ार - (1) इन जनयमों को पिु क्रूरता जनिारण सोसाइटी जनयम, 2023 कहा जायेगा। (2) य ेआजधकाररक राजपत्र म ेंप्रकािन की तारीख से लाग ूहोंगे। 4739 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. पररभािाएँ – (क) "अजधजनयम" से पिओंु के प्रजत क्रूरता जनिारण अजधजनयम, 1960 (1960 का 59) अजभप्रते ह;ै (ख) "पिु कल्याण संगठन” स े पिुओं के कल्याण के जलए काम करने िाला एक सगं ठन, जो 1860 के सोसाइटी रजजस्ट् रीकरण अजधजनयम (1860 का 21) या उस समय के जलए लागू होने िाले कानून के तहत पंजीकृत और जजसे भारतीय जीि जन् तु कल्याण बोड च की मौजूदा नीजत के अधीन मान्यता प्राप्त ह,ै अजभप्रेत ह;ै (ग) "बोडच" स े धारा 4 के तहत स्ट्थाजपत और इस अजधजनयम की धारा 5क के तहत समय-समय पर पुनगचरठत भारतीय जीि जन् तु कल्याण बोड च अजभप्रेत ह;ै (घ) "केस संपजत्त पि"ु स े इस अजधजनयम या उसके अधीन बनाए गए जनयमों के उपबंधों के अधीन जब्त दकया गया कोई पिु अजभप्रेत ह;ै (ङ) "इन्फमचरी" स े इस अजधजनयम की धारा 35(1) के अधीन राज्य सरकार या संघ िाजसत प्रदेि द्वारा जिजधित अजधसूजचत एक क्षत्रे या संस्ट्था जजसका उपयोग बेघर और/या केस संपजत्त पिओंु के उपचार, देखभाल और देखभाल के स्ट्थान के रूप म ेंदकया जाता ह,ै अजभप्रेत ह;ै (च) "क्षेत्राजधकार पिु जचदकत्‍सा अजधकारी" स े राज्य सरकार या केंद्र सरकार द्वारा क्षेत्र म ें जनयोजजत पिु जचदकत्‍सक ह ै जो दकसी मान्यता प्राप्त पि ु जचदकत्‍सा महाजिद्यालय से जडग्री धारक ह ै और राज्य पि ु जचदकत्‍सा पररिद या भारतीय पि ु जचदकत्‍सा पररिद स े पंजीकृत ह।ै (छ) "स्ट्थानीय प्राजधकरण" स े इस अजधजनयम की धारा 2 (ङ) के तहत पररभाजित स्ट्थानीय प्राजधकरण अजभप्रेत ह।ै (ज) "एसपीसीए" स े राज्य सरकार द्वारा आजधकाररक राजपत्र म ें जिजधित अजधसूजचत दकसी भी जजले म ें स्ट्थाजपत पिु क्रूरता जनिारण सोसाइटी ह।ै और इसमें पिुओं के प्रजत क्रूरता जनिारण (पि ु क्रूरता जनिारण सोसाइटी की स्ट्थापना और जिजनयमन) जनयम, 2001 के तहत स्ट्थाजपत और कायचरत मौजूदा एसपीसीए िाजमल होंग,े अजभप्रेत ह;ै (झ) "राज्य बोडच" स े पिओंु के प्रजत क्रूरता जनिारण के प्रयोजन के जलए गरठत राज्य पि ु कल्याण बोड,च जजसे राज्य सरकार द्वारा राजपत्र म ेंजिजधित अजधसूजचत दकया गया ह,ै अजभप्रेत ह।ै 3. पि ु क्रूरता जनिारण सोसाइटी की स्ट्थापना - प्रत्‍येक राज्य सरकार, आजधकाररक राजपत्र म ें अजधसूचना द्वारा, इन जनयमों के प्रारंभ होने की तारीख से छह महीन े के भीतर राज्य के प्रत्‍येक जजले के जलए पिओंु के प्रजत क्रूरता जनिारण के जलए एक सोसाइटी की स्ट्थापना करेगी, जब तक दक पिओंु के प्रजत क्रूरता जनिारण (पिु क्रूरता जनिारण सोसाइटी की स्ट्थापना और जिजनयमन) जनयम 2001 के तहत ऐसी सोसाइटी पहल े स े ही स्ट्थाजपत नहीं की गई ह ै । पिुओं के प्रजत क्रूरता जनिारण (पि ु क्रूरता जनिारण सोसाइटी की स्ट्थापना और जिजनयमन) जनयम 2001 के तहत अजधसूजचत ऐसी सोसाइटी उनके आचरण म ें इन जनयमों द्वारा िाजसत एि ं संचाजलत होंगी। बिते दक, जजला मजजस्ट्रेट या जजला कलेक्टर एसपीसीए को सोसाइटी पंजीकरण अजधजनयम, 1860 के तहत पंजीकृत करिाएंग े और सोसाइटी हमेिा के जलए काम करेगी। परन्त ु राज्य सरकार यह सुजनजित करेगी दक राज्य के दकसी भी जजले म ें 'पिुओं के प्रजत क्रूरता जनिारण सेासाइटी' के नाम स े संचाजलत कोई भी गरै -सरकारी संगठन इन जनयमों की अजधसूचना के साठ ददनों के भीतर अपने नाम म ेंआिश्यक पररितचन करेगा। 4. एसपीसीए के उपजनयम- (1) एसपीसीए समय-समय पर बोडच द्वारा प्रकाजित मॉडल बायलॉज को अपनाएगा। एसपीसीए अपने उपयिु प्रिासन और अपने कायों को परू ा करने के जलए अजतररि उपजनयमों को भी िाजमल कर सकता ह।ै (2) प्रत्‍येक राज्य म ें सभी जजला एसपीसीए के उपजनयमों को संबंजधत राज्य बोडच की िेबसाइट पर या संबंजधत राज्य के पिुपालन जिभाग की िेबसाइट पर अपलोड दकया जाएगा। 5. पि ुक्रूरता जनिारण सोसाइटी की प्रबधं न सजमजत का गठन - (1) सोसाइटी की प्रबंधन सजमजत में जनम्नजलजखत सदस्ट्य होंग:े (क) अध्यक्ष – उपायुक् त या जजला मजजस्ट्रेट या जजला कलेक्टर, पदेन;[भाग II—खण ड् 3(i)] भारत का राजपत्र : असाधारण 3 (ख) उपाध्यक्ष - पुजलस अधीक्षक या पुजलस आयुक् त, पदेन; (ग) सजचि एिं नोडल अजधकारी - जजले का मुख्य पिु जचदकत्‍सा अजधकारी या जजला पिुपालन अजधकारी या कोई अन् य प्रभारी पिुपालन अजधकारी या जजस भी नाम से जाना जाता ह,ै पदने ; (घ) सदस्ट्य - क्षेत्रीय अजधकारी, राज्य प्रदिू ण जनयंत्रण बोड,च पदेन; (ङ) सदस्ट्य - नाजमत अजधकारी खाद्य सुरक्षा, पदेन; (च) सदस्ट्य - प्रजतजनजध, जजला िन जिभाग (छ) सदस्ट्य - जजला मुख्यालय के िहरी स्ट्थानीय जनकाय का प्रजतजनजध (ज) सदस्ट्य - प्रजतजनजध, जजला पंचायत (झ) सदस्ट्य - प्रजतजनजध, राज्य बोडच (ञ) सदस्ट्य - जजला अजभयोजन अजधकारी (ट) सदस्ट्य - साथी पिुओं के कल्याण के जलए कायचरत पिु कल्याण संगठनों का प्रजतजनजधत्‍ि करने िाले दो व्यजि राज्य सरकार या स्ट्थ ानीय प्राजधकरण द्वारा नाजमत । (ठ) सदस्ट्य - बडे पिुओं के कल्याण के जलए कायचरत पि ु कल्याण संगठनों का प्रजतजनजधत्‍ि करन े िाल े दो व्यजि राज्य सरकार या स्ट्थ ानीय प्राजधकरण द्वारा नाजमत । (ड) सदस्ट्य - जजल ेमें पिु कल्याण म ेंलगे तीन प्रजतजित व्यजि राज्य सरकार या जजला स्ट् थानीय प्राजधकरण द्वारा नाजमत । (2) बोड चको दकसी भी एसपीसीए की प्रबंधन सजमजत में एक सदस्ट्य को नाजमत करने का जििके ाजधकार होगा, यदद िह चाह े तो। इसका कारण जलजखत रूप में दजच दकया जा सकता ह।ै (3) अतं राचष्ट्रीय सीमा िाले प्रत्‍येक जजल े को एसपीसीए के जलए अधचसैजनक बल या सीमा सुरक्षा बल या सीमा पर तनै ात गृह मंत्रालय के दकसी अन्य व्यजि से एक नामांकन प्राप्त करना होगा। 6. एसपीसीए की प्रबधं न सजमजत का कायकच ाल - एसपीसीए की प्रबंधन सजमजत के गरै -सरकारी सदस्ट्यों का कायचकाल इसके गठन की जतजथ से तीन िि च की अिजध के जलए होगा। कायकच ाल की समाजप्त के तीस ददनों के भीतर, राज्य सरकार या स्ट् थानीय प्राजधकरण गरै -सरकारी सदस्ट्यों के जलए नए जसरे स ेनामांकन करेगा। 7. एसपीसीए की उप-सजमजतया-ं (1) प्रबंध सजमजत, एसपीसीए के कायों के जनिचहन के जलए जजतनी उपसजमजत िह ठीक समझे उतनी उप-सजमजतयों का गठन कर सकती ह।ै (2) एक उप-सजमजत में प्रबंधन सजमजत के अध्यक्ष द्वारा नाजमत कोई अन्य व्यजि िाजमल हो सकते ह।ैं 8. एसपीसीए (सामान्य जनकाय) की सदस्ट्यता– (1) एसपीसीए की सामान् य सभा का सदस्ट्य बनन े का इच्छुक कोई भी व्यजि पहली अनुसूची म ें ददए गए प्रारूप म ें एसपीसीए के सजचि को आिेदन करेगा। सजचि, आिेदनों को पुजलस सत्‍यापन के अधीन रखते हुए, आिेदन प्राप्त होने के साठ ददनों के भीतर अध्यक्ष के समक्ष जिचाराथच प्रस्ट्तुत करेंगे। (2) जजल े म ें कायचरत कोई भी पिु कल्याण संगठन दसू री अनसु ूची में ददए गए प्रारूप में एसपीसीए की सदस्ट्यता की मांग कर सकता ह।ै (3) सामान्य जनकाय के सदस्ट्य एसपीसीए की दकसी भी गजतजिजध के जलए स्ट्िेच्छा से सहायता कर सकत े ह,ैं जजसमें इन्फमचरी का रखरखाि, एसपीसीए हल्े पलाइन नंबर का प्रबंधन, या सजचि द्वारा पहचानी गई ऐसी कोई अन्य गजतजिजध िाजमल ह,ैं लेदकन यह इन्हीं तक सीजमत नहीं ह।ै 9. एसपीसीए के अजधकारी और कमचच ारी: राज्य सरकार, जैसा दक आिश् यक समझे, एसपीसीए के कामकाज के जलए अजधकाररयों और कमचचाररयों की जनयुजि कर सकती ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 10. प्रत्‍य के जजल ेम ेंइन्फमरच ीज की स्ट्थापना- (1) सोसाइटी के अध्यक्ष, प्रबंधन सजमजत के परामि च स,े एक इन्फमचरी (ओं) की स्ट्थापना के जलए पररसर की पहचान करेंग,े जहां जजले के बीमार या घायल, आिारा या केस संपजत्त पिओंु का इलाज और देखभाल और पररत्‍यि या बूढ़ े पिओंु का रखरखाि और उपचार दकया जाएगा। (2) तत्‍पिात ् ऐसे इन्फमरच ी (ओं) की अजधसूचना का प्रस्ट्ताि राज्य सरकार को प्रस्ट्तुत दकया जायेगा। राज्य सरकार इस तरह के प्रस्ट्ताि की प्राजप्त के साठ ददनों के भीतर इन्फमरच ी को अजधसूजचत करेगी। (3) राज्य सरकार इन्फमचरी (ओं) की स्ट्थापना, प्रिासन और बुजनयादी ढांच े के सुधार और संचालन के जलए बजट आिंरटत करेगी। (4) अस्ट्पताल म ें बडे पिओंु , केनल, एजियरी और अन्य प्रजाजतयों के जलए िेड होंग े और बेघर पिओंु और केस प्रॉपटी पिुओं के जलए उपयिु आिास स्ट्थान होगा। (5) इन्फमचरी के पास घायल या बीमार जानिरों के जलए बाडे होंगे। (6) सोसाइटी पिुओ को जखलाने और उनकी देखभाल करन े और इन्फमचरी पररसर की स्ट्िच्छता बनाए रखने के जलए एक पिु कल्याण संगठन भी जनयुि कर सकती ह ै या ऐस े इन्फमरच ी को अपन े स्ट्िय ं के संसाधनों स े चला सकती ह ै जजसके जलए समाज अपनी स्ट्िय ं की रसद आिश्यकताओं की व्यिस्ट्था करने के जलए उत्तरदायी होगा। (7) जजल े के सभी पुजलस थानों को जनदेि ददया जायेगा दक ि े इस अजधजनयम के अधीन अजभगृहीत पिओंु को इन्फमचरी म ें लायें तथा उन्ह ें न्याजयक दंडाजधकारी के अगले आदेि तक इन्फमचरी म ें रखा जायेगा। इन्फमचरी म ें सभी केस संपजत्त पिुओं का ररकॉडच एसपीसीए द्वारा बनाए रखा जाएगा (8) यदद एसपीसीए द्वारा चलाए जा रही इन्फमरच ी म ें जगह की कमी ह,ै तो पिओंु को पि ु कल्याण संगठन, गौिाला, या पपजरापोल, जैसा भी मामला हो, ले जाया जा सकता ह।ै 11. जजला पि ु क्रूरता जनिारण सोसाइटी के काय-च एसपीसीए की प्रबधं न सजमजत राज्य बोडच या बोड च द्वारा सौंपे गए जनम्नजलजखत एिं अन् य कायों का जनष्पादन करेगी: (क) इस अजधजनयम या जनयमों के उपबंधों के दकसी भी उल्लघं न या दकसी अन्य कानून के अधीन दडं नीय पि ु क्रूरता, जैसा भी मामला हो, कानून प्रितचन एजेंजसयों या दकसी अन्य उपयिु प्राजधकरण को जनयजमत रूप से ररपोटच करना। (ख) अजधजनयम और जनयमों के प्रितचन म ें कानून प्रितचन एजेंजसयों की सहायता एिं पिु क्रूरता के मामलों के प्रभािी अजभयोजन पक्ष का समथचन करने एिं सहायता के जलए। (ग) अजधजनयम और उसके अधीन बनाए गए जनयमों म ें अपन े कतचव्यों के जनिचहन म ें राज्य बोड च और बोड च की सहायता और मदद के जलए। (घ) जजले में कायचरत पिु कल्याण संगठनों के कायच को बढ़ािा देना, समन्िय करना और सहयोग करना। (ङ) पिओंु के प्रजत क्रूरता के सबं ंध में ररपोटच या सूचना प्राप्त करने के जलए, या चोट या बीमारी के कारण संकट में दकसी पि ु की ररपोटच करने के जलए एक 24x7 हल्े पलाइन नंबर स्ट्थाजपत करना; ऐसी हल्े पलाइन का व्यापक प्रचार-प्रसार दकया जाएगा। ऐसी हल्े पलाइन पर सभी कॉल प्राप्त की जाएंगी और एसपीसीए द्वारा उनका ररकॉडच रखा जाएगा। (च) बीमार, घायल या रोगग्रस्ट्त और बघे र पिओंु के जलए एक एम्बुलेंस सेिा संचाजलत करन ेके जलए। (छ) आपदा तैयाररयों में जजला आपदा प्रबंधन प्राजधकरण की सहायता और मदद करना; पिुपालन जिभाग के कर्ममयों के साथ समय-समय पर प्रजिक्षण अभ्यास और कायचक्रम आयोजजत करना और आपदा जस्ट्थजतयों के दौरान पिओंु के बचाि और राहत कायों में सहायता करना। (ज) जजले म ेंपि ु जन्म जनयंत्रण कायचक्रमों के कायाचन्ियन में सहायता और मदद करना। (झ) जजले के जिक्षण संस्ट्थानों में पिुओं के कल्याण को बढ़ािा देने के जलए कायचिालाओं, सेजमनारों और जागरूकता कायचक्रमों का आयोजन करना। (ञ) जजल े में कायचरत सरकारी जिभागों और स्ट्थानीय प्राजधकरणों के जलए संिेदीकरण और क्षमता जनमाचण कायचिालाओं का संचालन करना।[भाग II—खण ड् 3(i)] भारत का राजपत्र : असाधारण 5 (ट) जजले म ें पिु कल्याण के बारे में सािचजजनक आउटरीच कायचक्रमों जैसे होर्डडग्स, पोस्ट्टरों और दकसी भी अन्य माध्यम स े या सािचजजनक आउटरीच के माध्यम से जागरूकता पैदा करना। (ठ) कल्याणकारी गजतजिजधयों जैसे आिारा पिुओं और पजक्षयों के जलए पानी के कटोरे के प्रािधान के माध्यम से पिओंु के मानिीय उपचार के प्रजत जनमत के गठन को बढ़ािा देना और प्रोत्‍साजहत करना; आिारा पिुओं के जलए नाजमत फीपडग जोन का जनमाचण, बचाए गए साथी पिुओं को गोद लेने को बढ़ािा देना, िैक्षजणक संस्ट्थानों में करुणा क्लब या दया क्लब का गठन और ऐसी कोई अन्य गजतजिजधयां जो प्रबंधन सजमजत द्वारा तय की जा सकती ह।ैं (ड) जजल े में स्ट्थाजपत इन्फमचरी या इन्फमचरी (ओं) या पांजारापोल या पिु िरणगृह या गौिाला के संचालन और प्रबंधन म ें सहायता और मदद के जलए। (ढ) पि ु क्रूरता के संबंध म ें जजले के पुजलस थानों म ें दजच मामलों की संख्या एकजत्रत करना और एसपीसीए ररकॉड च में प्रत्‍यके की जस्ट्थजत को अद्यतन करना। 12. जजला पि ुक्रूरता जनिारण सोसाइटी की बठै कें- (1) एसपीसीए की प्रबंधन सजमजत न्यूनतम नौ सजमजत सदस्ट्यों की गणपूर्मत के साथ तीन महीने में कम से कम एक बार बैठक करेगी, (2) एसपीसीए के सदस्ट्य एसपीसीए की आगामी बैठक में जिचार के जलए सजचि को एजडें ा पबद ुप्रस्ट्तुत कर सकत े ह।ैं प्रत्‍येक बैठक के जलए अंजतम एजेंडा, प्रबंधन सजमजत के सभी सदस्ट्यों को कम स े कम सात ददन पहले पररचाजलत दकया जाना चाजहए, और बैठक के कायचिृत्त को जिजधित ररकॉडच और पररचाजलत दकया जाएगा। (3) प्रत्‍येक बैठक म,ें जपछली बैठक में जलए गए जनणचयों की कारचिाई की ररपोटच सजचि द्वारा प्रस्ट्तुत की जाएगी। (4) िार्मिक ररपोटच लेखापरीजक्षत खातों के साथ सजचि द्वारा िार्मिक सामान् य बैठक में प्रस्ट्तुत की जाएगी। (5) अध्यक्ष दकसी भी एसपीसीए बैठक के जलए आिश्यक होने पर, सडक पररिहन अजधकारी, दकसी भी स्ट्थानीय प्राजधकरण के प्रजतजनजधयों सजहत उजचत अजधकाररयों, लेदकन इन्हीं तक सीजमत नहीं ह,ैं को आमंजत्रत कर सकता ह ै (6) प्रबंधन सजमजत का कोई भी सदस्ट्य तीसरी अनुसूची में ददए गए प्रारूप म ें एक आपातकालीन बैठक का प्रस्ट्ताि द े सकता ह;ै अध्यक्ष ऐसे प्रस्ट्ताि पर प्राजप्त के सात ददनों के भीतर जिचार करेगा। बिते दक, यदद आपातकालीन बैठक नहीं बुलाई जा सकती ह,ै तो अध्यक्ष प्रबंधन सजमजत के सदस्ट्य को व्यजिगत सुनिाई की अनुमजत दगे ा। 13. पि ुक्रूरता जनिारण सोसाइटी हते ु जनजध – (1) एसपीसीए जनम्नजलजखत स्रोतों से सोसाइटी के बैंक खाते म ेंजनजधयॉं प्राप्त कर सकता ह:ै (क) राज्य बोड च या भारतीय जीि जन् तु कल्याण बोडच से सहायता अनुदान; (ख) जजला प्रिासन से सहायता अनदु ान; (ग) एसपीसीए के सामान् य जनकाय की सदस्ट्यता के जलए सदस्ट्यता िुल्क या कोई अन य् िल्ु क (घ) दकसी संस्ट्था, संघ, कॉपोरेट या व्यजि द्वारा प्रदत्‍ त योगदान, दान, जिरासत और उपहार इत्‍य ादद (2) सोसाइटी के खाते चाटचडच एकाउंटेंट या कानून द्वारा अजधकृत दकसी अन्य जनकाय द्वारा िार्मिक लेखा परीजक्षत होन े चाजहएं। इस तरह की एक लेखा परीजक्षत ररपोट,च लाभ और हाजन खातों के साथ सकता ह ै और सुधाराथ च जनदेि द े सकता ह ैया एसपीसीए की गजतजिजधयों के संबंध में अजतररि जानकारी मांग सकता ह।ै (3) एसपीसीए के कामकाज के संबंध में जिकायत राज्य बोडच को की जा सकती है; जिकायत प्राप्त होने के section 38 of the Prevention of Cruelty to Animals Act, 1960 (59 of 1960), the Central Government has decided to amend the Prevention of Cruelty to Animals (Establishment and Regulation of Societies for Prevention of Cruelty to Animals) Rules, 2001, in supersession of the Prevention of Cruelty to Animals (Establishment and Regulation of Societies for Prevention of Cruelty to Animals) Rules, 2001, published vide notificationS.O.271 (E) by the Government of India, Ministry of Social Justice and Empowerment number in the Gazette of India, Extraordinary, Part II, Section 3, Sub Section (ii) dated the 26th March, 2001 except as respect of things done or omitted to be done before such suppression, the Central Government is proposing to publish draft rules for public comments within thirty days from the date of publication of this draft rules in the Gazette of India; Any Person desiring to make any suggestions or objections in respect of the this draft rules may forward the same for the consideration of the Central Government, with the period specified above to the Joint Secretary (Animal Welfare), Department of Animal Husbandry and Dairying, Ministry of Fisheries, Animal Husbandry and Dairying, Room No. 245, Krishi Bhawan, Dr. Rajendra Prasad Road, New Delhi 110001. 1. Title and extent.–(1)These rules may be called the Society for Prevention of Cruelty to Animals Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.– (a) ―Act‖ means the Prevention of Cruelty to Animals Act, 1960 (59 of 1960); (b) ―Animal Welfare Organisation‖ means an organisation working for welfare of animals which is registered under the Societies Registration Act of 1860 (21 of 1860) or any corresponding law for the time being in force and which is recognized by the Animal Welfare Board of India as per the extant policy of the Board;; (c) ―Board‖ means the Animal Welfare Board of India established under Section 4 and as reconstituted from time to time under section 5A of this Act. (d) ―Case property animal‖ means any animal seized under the provisions of this Act or the Rules made thereunder (e) ―Infirmary‖ means an area or institution used as a place of treatment, care and upkeep of homeless and/or case property animals, duly notified by the concern State Government or Union Territory under Section 35(1) of this Act.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (f) ―Jurisdictional Veterinary Officer‖: means veterinarian employed by the state government or central government in the area who holds a degree from a recognized veterinary college and is registered with the State Veterinary Council or Veterinary Council of India. (g) ―Local Authority‖ means local authority as defined under section 2 (e ) of the Act. (h) ―SPCA‖ means Society for Prevention of Cruelty to Animals established in any district duly notified by the State Government in official gazette. And shall include the existing SPCA established and functioning under the Prevention of Cruelty to Animals (Establishment and Regulation of Societies for Prevention of Cruelty to Animals) Rules, 2001; (i) ―State Board‖ means the State Animal Welfare Board constituted for the purpose prevention of cruelty to animals which is duly notified by the State Government in official gazette; 3. Establishment of Society for Prevention of Cruelty to Animals.– Each State Government shall, by notification in official gazette, establish a Society for Prevention of Cruelty to Animals for every district in the state within six months from the date of commencement of these Rules, unless such a Society has already been established under the Prevention of Cruelty to Animals (Establishment and Regulation of Societies for Prevention of Cruelty to Animals) Rules 2001. The Societies notified under the Prevention of Cruelty to Animals (Establishment and Regulation of Societies for Prevention of Cruelty to Animals) Rules 2001shall be governed in their conduct by these Rules. Provided that, the District Magistrate or District Collector shall cause the SPCA to be registered under the Societies Registration Act, 1860, and the society shall operate in perpetuity. Provided that the State Government shall ensure that any non-government organisation operating in the name of ‗Society for Prevention of Cruelty to Animals‘ in any District of the State shall made necessary changes in its name within sixty days of notification of these Rules. 4. By-laws of the SPCA.– (1) The SPCA shall adopt the Model By-laws published by the Board from time to time. The SPCA may also include additional by-laws as it may think fit for the administration of its affair and carrying out its functions. (2) The by-laws of all District SPCA in each State shall be uploaded on the website of the relevant State Board or in the website of the Animal Husbandry Department of the concerned state. 5. Constitution of the Management Committee of the Society for Prevention of Cruelty to Animals.– (1) The Management Committee of the Society shall have the following members: (a) Chairperson – Deputy Commissioner or District Magistrate or District Collector, ex officio; (b) Vice Chairperson - Superintendent of Police or Commissioner of Police, ex officio; (c) Secretary and Nodal Officer - Chief Veterinary Officer of the District or District Animal Husbandry Officer or any district in charge of animal husbandry department or whatever name called, ex officio; (d) Member - Regional Officer, State Pollution Control Board, ex officio; (e) Member - Designated Officer Food Safety, ex officio; (f) Member - Representative of the District Forest Department (g) Member - Representative of the Urban Local body of the District headquarters (h) Member - Representative of the District Panchayat (i) Member - Representative of the State Board (j) Member - District Prosecution Officer (k) Member - Two persons representing Animal Welfare Organisations working for the welfare of companion animals to be nominated by the State Government or the local Authority of the District. (l) Member - Two persons representing Animal Welfare Organisations working for the welfare of large animals to be nominated by the State Government or the local Authority of the District. (m) Member - Three eminent persons engaged in animal welfare in the district to be nominated by the State Government or the local authority of the District.[भाग II—खण ड् 3(i)] भारत का राजपत्र : असाधारण 13 (2) The Board shall have the discretion to nominate a member to the management committee of any SPCA, if it so desires. The reason for the same may be recorded in writing. (3) Every District having international borders shall seek one nomination for the SPCA from the para- military force or Border Security Force or any other person from Ministry of Home Affairs deployed at the Border. 6. Term of the Management Committee of the SPCA.–The term of the non-government members of the Management Committee of SPCA shall be three years from the date of its notification. The State Government or the local authority of the district shall make fresh nominations for the non-government members within thirty days of the expiry of their term. 7. Sub-committees of the SPCA.– (1) The Management Committee may constitute as many sub-committees as it may thinks fit for discharging the functions of the SPCA. (2) A sub-committee may consist of the members of the Management Committee or any other persons nominated by the Chairperson. 8. Membership of the SPCA (General Body).– (1) Any person desirous of becoming a member of the General Body of the SPCA shall make an application to the Secretary of the SPCA in the format provided in the First Schedule. The Secretary shall, subject the applications to a police verification, present them before the Chairperson for consideration within sixty days of receipt of application. (2) Any animal welfare organisation operating in the District may seek membership of the SPCA in the format provided in the Second Schedule. (3) The Members of the General Body may volunteer assistance to any activity of the SPCA, including but not limited to maintenance of the infirmary, management of SPCA helpline number, or any other such activity identified by the Secretary. 9. Officer and employees of SPCA: The State Government may appoint officers and employees as it may think necessary for the functioning of the SPCA. 10. Establishment of infirmaries in every district.– (1) The Chairperson of the Society, in consultation with the Management Committee, shall identity the premises for setting of an Infirmary (ies) where the treatment and care of sick or injured animals and up- keeping and maintenance of the abandoned or old or stray or case property animals of the district. (2) Thereafter, the proposal of notification of such infirmary (ies) shall be submitted to the State Government. The State Government shall notify the infirmary within sixty days of receipt of such proposal. (3) The State Government shall allocate budget for establishment, administration and improvement of infrastructure and operation of the infirmary (ies). (4) Infirmary shall have sheds for large animals, kennels, aviaries and other species-appropriate housing space for homeless animals and case property animals. (5) The Infirmaries shall have enclosures for injured or diseased animals. (6) The Society may also appoint an animal welfare organisation for feeding & care of animals and maintaining sanitation of the infirmary premises or may run such infirmaries out of their own resources for which the society shall liable to arrange their own logistical requirements. (7) All police stations in the District shall be directed to bring animals seized under this Act, to the infirmary and they shall be kept in the infirmary till further orders of the judicial Magistrate. The Record of all the case property animals in the Infirmary shall be maintained by the SPCA (8) In case there is shortage of space at the infirmary run by the SPCA, the animals may be taken to an animal welfare organisation, gaushala, or pinjrapole as the case may be. 11. Functions of District Society for Prevention of Cruelty to Animals.–The Management Committee of the SPCA shall perform the following functions and any other functions delegated to it by the State Board or the Board:14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (a) To regularly report to law enforcement agencies or to any other appropriate authority as the case may be, any violations of the provisions of this Act or Rules thereunder or cruelty to animals punishable under any other law in force. (b) To aid and assist the law enforcement agencies in enforcement of the Act, and the Rules framed thereunder, and to support effective prosecution of cases of animal cruelty. (c) To aid and assist State Board and the Board in the discharge of their duties under the Act, and the Rules framed thereunder. (d) To promote, coordinate and cooperate with the work of animal welfare organisations operating in the District. (e) To establish a 24x7 helpline number for receiving reports or information regarding cruelty to animals, or reporting any animal in distress due to injury or disease; such a helpline shall be given wide publicity. All calls to such a helpline shall be received, and record of the same shall be maintained by the SPCA. (f) To operate an Ambulance Service for sick, injured or diseased homeless animals. (g) To aid and assist the District Disaster Management Authority in disaster preparedness; to conduct periodical training exercises and drills with the personnel of the Animal Husbandry Department and assist in rescue and relief operations for animals during disaster situations. (h) To aid and assist the implementation of Animal Birth Control programs in the District. (i) To organise workshops, seminars and awareness programs for promotion of welfare of animals in educational institutions in the District. (j) To conduct sensitization and capacity building workshops for Government departments and local authorities functioning in the District. (k) To create awareness regarding animal welfare in the District through Public Outreach programme including, hoardings, posters and any other means of public outreach. (l) To promote & encourage formation of public opinion towards humane treatment of animals through welfare activities such as provision of water bowls for street animals and birds; creation of designated feeding zones for street animals, promotion of adoption of rescued companion animals, formation of Karuna Clubs or Kindness Clubs in educational institutions and any other such activities as may be decided by the Management Committee. (m) To aid and assist in the operation and management of the infirmary or infirmaries or pinjrapole or animal shelter or Gaushala established in the District. (n) To collate the number of cases registered in police stations of the District regarding animal cruelty and update the status of each in the SPCA records. 12. Meetings of the District Society for Prevention of Cruelty to Animals.– (1) The Management Committee of the SPCA shall meet at least once in three months, with a minimum quorum of nine Committee Members. (2) The Members of the SPCA may submit agenda points to the Secretary for consideration in the upcoming meeting of the SPCA. The finalised agenda for each meeting must be circulated at least seven days in advance, to all the members of the Management Committee, and the Minutes of Meeting shall be duly recorded and circulated. (3) At each meeting, an action-taken report for the decisions taken in the previous meeting shall be presented by the Secretary. (4) The Annual Report alongwith the Audited Accounts shall be presented at the Annual General Meeting by the Secretary. (5) The Chairperson may invite appropriate authorities including but not limited to the Road Transport Officer, representatives of any local authority, as and when required for any SPCA meeting. (6) Any Member of the Management Committee may propose an emergency meeting in the format provided in the Third Schedule; the Chairperson shall consider such a proposal within seven days of receipt. Provided that, if an emergency meeting cannot be called, the Chairperson shall grant personal hearing to the Management Committee Member.[भाग II—खण ड् 3(i)] भारत का राजपत्र : असाधारण 15 13. Funds for the Society for Prevention of Cruelty to Animals.– (1) The SPCA may receive funds in the bank account of the Society from the following sources: (a) Grant-in-aid from the State Board or Animal Welfare Board of India; (b) Grant-in-aid from the District Administration; (c) Membership fees for membership to the General Body of SPCA or any other fees (d) Contributions, donations, bequests, gifts and the likes made to it by any institution, association, Corporate or individual. (2) The accounts of the Society must be subjected to annual audit by a chartered accountant or any other body authorised by law. Such an audited report, along with the profit and loss accounts must be published in the Annual Report for its presentation at the Annual General Meeting. 14. Records to be maintained by the Secretary.– (1) The following records must be maintained by the Secretary of the SPCA: (a) With regard to activities of the SPCA- (i) Log book for the SPCA helpline number (ii) Books of Accounts and audit reports (iii) Ambulance log book (iv) Meeting agenda and minutes (v) Action taken reports (vi) Annual Reports (b) With regard to the infirmary: (i) Daily Inventory record of the number of animals in the infirmary, categorised by species; (ii) In-patient register of all animals in the infirmary, in the format provided in the Fourth Schedule (iii) Release record of all animals released/discharged from the infirmary (iv) Record of death certificate, post mortem certificate, veterinary record as the case may be for each animal in the infirmary (v) Feed stock book (vi) Medicine Stock Book (vii) General Stock Book (viii) Volunteer attendance record (2) The Secretary shall submit the Annual Report of the SPCA to the State Board and provide any additional information as may be sought by the State Board from time to time. The annual report of each SPCA in the State shall be uploaded on the website of the State Board or the website of the Department of Animal Husbandry of the respective state. 15. Regulation of Society for Prevention of Cruelty to Animals– (1) The State Board shall review the annual report and audited accounts of the SPCA and may give directions for improvement to the Management Committee in the interest of efficient discharge of the SPCA‘s functions. (2) The Board may seek annual reports and audited accounts of any SPCA and give directions for improvement or seek additional information regarding the activities of the SPCA. (3) A complaint regarding the functioning of the SPCA may be made to the State Board; after providing an opportunity of hearing to the complainant and the SPCA within 30 days of receipt of the complaint, the State Board shall dispose of the complaint with necessary directions. (4) An appeal against the directions of the State Board may be made to the Board; the Board shall provide an opportunity for personal hearing to the complainant as well as the Secretary of the SPCA.
