1. सजं क्षप्त िीर् गएव ंप्रारंभ - (1) इन जनयमों का संजक्षप् त नाम केन्द्द्रीय मोटर यान (........सिं ोधन) जनयमावली, 2026 ह।ै

(2) परंतु इन जनयमों म ें अन्द् यर्ा यर्ा उपबंजधत के जसवाय, य े आजधकाररक रािपत्र म ें अपन े प्रकािन की तारीख से प्रवृत्त होंगे।

2.केंद्रीय मोटर यान जनयमावली, 1989 (जिसे इसके बाि उि जनयम कहा गया ह)ै म,ें जनयम 4 के स्ट्र्ान पर जनम्नजलजखत जनयम प्रजतस्ट्र्ाजपत दकया िाएगा, अर्ातग ्— “4. पता, आय ुऔर पहचान की सत्यता के सबं धं म ेंसाक्ष्य-

(1) इस अध्याय के अंतगगत अनज्ञु जप्त (लाइसेंस) िारी करन ेके जलए प्रत्येक आवेिक को अपने पते के प्रमाण के रूप म ें जनम्नजलजखत िस्ट्तावेिों में से कोई एक या अजधक मूल िस्ट्तावेि या उनके प्रासंजगक अंि स्ट्व-सत्याजपत करके प्रस्ट्ततु करने होंगे, अर्ागत्— (क) आधार काड,ग (ख) मतिाता फोटो पहचान पत्र (ईपीआईसी काडग), (ग) पासपोटग, (घ) ई-रािन काड,ग (ड.) केंद्र सरकार या राज्य सरकार या सावगिजनक क्षेत्र के उपक्रम या दकसी अन्द्य जनयामक या वैधाजनक जनकाय द्वारा िारी दकया गया सेवा (सर्वगस) फोटो पहचान पत्र, (च) पेंिनभोगी फोटो पहचान पत्र या स्ट्वतंत्रता सेनानी फोटो पहचान पत्र अर्वा केंद्र सरकार या राज्य सरकार या सावगिजनक क्षेत्र के उपक्रम या दकसी अन्द्य जनयामक अर्वा वैधाजनक जनकाय द्वारा िारी पेंिन भुगतान आिेि, (छ) जबिली का जबल, िो आवेिन िमा करने की तारीख से तीन माह से अजधक परु ाना न हो। (ि) घरेल ूगैस जबल, िो आवेिन करने की जतजर् से तीन माह से अजधक परु ाना न हो। (झ) कोई अन्द्य िस्ट्तावेि, िो राज्य सरकार द्वारा अजधजनयम की धारा 28 के खंड (के) के अधीन जवजनर्िगष् ट दकए िाए,ं (ञ) जविेिी नागररकों के मामल ेमें जनवास प्रमाण के अजतररि भारत में कानूनी रूप से उपजस्ट्र्त रहन ेका प्रमाण।

(2) इस अध्याय के अंतगगत लाइसेंस िारी करन े के जलए आविे न करने वाल े प्रत्येक आवेिक को अपनी आय ु या िन्द्मजतजर् के प्रमाण स्ट्वरूप जनम्नजलजखत िस्ट्तावेिों म ेंस ेकोई एक या अजधक मलू िस्ट्तावेि या उनके प्रासंजगक अिं स्ट्व-सत्याजपत रूप में प्रस्ट्तुत करने होंग,े अर्ागत—् (क) पासपोटग, (ख) केंद्र सरकार या राज्य सरकार द्वारा स्ट्र्ाजपत या मान्द्यता प्राप्त दकसी मान्द्यता प्राप्त जवद्यालय जिक्षा बोडग, जवश्वजवद्यालय, माजनत (डीम् ड) जवश्वजवद्यालय, उच्च जिक्षा संस्ट्र्ान या औद्योजगक प्रजिक्षण संस्ट्र्ान द्वारा िारी प्रमाण पत्र की अंकसूची (माकगिीट), जिसमें आवेिक की िन्द्मजतजर् अंदकत हो।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (ग) िन्द्म एवं मृत्य ु पंिीकरण अजधजनयम, 1969 और उसके अंतगतग बनाए गए जनयमों के तहत िारी दकया गया िन्द्म प्रमाण पत्र, (घ) केंद्र सरकार या राज्य सरकार अर्वा सावगिजनक क्षेत्र के उपक्रम या दकसी अन्द्य जनयामक जनकाय या वैधाजनक जनकाय द्वारा िारी दकया गया सर्वगस फोटो पहचान पत्र, (ड.) पेंिनभोगी फोटो पहचान पत्र या स्ट्वतंत्रता सेनानी फोटो पहचान पत्र अर्वा केंद्र सरकार या राज्य सरकार या दकसी सावगिजनक क्षेत्र के उपक्रम या दकसी अन्द्य जनयामक या वैधाजनक जनकाय द्वारा िारी पेंिन भगु तान आिेि, (च) कोई अन्द्य िस्ट्तावेि, िो राज्य सरकार द्वारा अजधजनयम की धारा 28 के खंड (के) के अधीन जवजनर्िगष् ट दकए िाएं।

(3) इस अध्याय के अंतगगत लाइसेंस िारी करने के जलए प्रत्यके आवेिक को अपनी पहचान के प्रमाण के रूप म ें जनम्नजलजखत िस्ट्तावेिों में से कोई एक या अजधक मूल िस्ट्तावेि या उनके प्रासंजगक अंि स्ट्व-सत्याजपत करके प्रस्ट्ततु करने होंगे, अर्ागत्— (क) आधार काड,ग (ख) वैध भारतीय पासपोटग, (ग) ई-रािन काड,ग (घ) केंद्र सरकार या राज्य सरकार अर्वा सावगिजनक क्षेत्र के उपक्रम या दकसी अन्द्य जनयामक या वैधाजनक जनकाय द्वारा िारी दकया गया सर्वगस फोटो पहचान पत्र, (ड.) पेंिनभोगी फोटो पहचान पत्र या स्ट्वतंत्रता सेनानी फोटो पहचान पत्र अर्वा केंद्र सरकार या राज्य सरकार या सावगिजनक क्षेत्र के उपक्रम अर्वा दकसी अन्द्य जनयामक या वैधाजनक जनकाय द्वारा िारी पेंिन भुगतान आिेि, (च) स्ट्र्ायी खाता सख्ं या (पनै )।"

3. उि जनयमों म ेंसे जनयम 6 का लोप दकया िाएगा।

4. उि जनयमों के जनयम 11 म,ें —

(i) उप-जनयम (1) म,ें — (क) िब्िों “सात दिन” के स्ट्र्ान पर “पद्रं ह दिन” िब्िों को प्रजतस्ट्र्ाजपत दकया िाएगा; (ख) िब्िों “सुरजक्षत ड्राइववंग पर एक ट्यूटोररयल को पूरा करना होगा” के पश् चात् िब्ि “जिसकी अवजध तीस जमनट से कम नहीं होगी” अंत:स्ट् र्ाजपत दकए िाएंग;े

(ii) उप-जनयम (3) म,ें “जनयम 10 के तहत आवेिन प्रस्ट्ततु करने के” िब्िों और अंकों के स्ट्र्ान पर, “उप-जनयम (1) म ें उजल्लजखत ऐस ेट्यूटोररयल को पूरा करने से” िब्ि और अंक प्रजतस्ट्र्ाजपत दकए िाएंगे;

(iii) उप-जनयम (4) म,ें िब्िों और अंकों “60 प्रजतित” के स्ट्र्ान पर “75 प्रजतित” िब्ि और अंक प्रजतस्ट्र्ाजपत दकए िाएंगे;

(iv) उप-जनयम (5) में खडं (ग) और (घ) का लोप दकया िाएगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

5. उि जनयमों के जनयम 14 म,ें —

(i) उप-जनयम (1) म,ें िब्ि और अंक “प्रपत्र 4” के स्ट्र्ान पर िब्ि और अंक “प्रपत्र 2” प्रजतस्ट्र्ाजपत दकए िाएगं े;

(ii) उप-जनयम (2) म,ें— (क) खडं (ग) और (घ) का लोप दकया िाएगा; (ख) खडं (ड.) म,ें िब्िों “के वैध प्रमाण” के पूवग िब्ि “भारतीय” अंत:स्ट्र् ाजपत दकया िाएगा।

6. उि जनयमों के जनयम 16 म,ें —

(i) उप-जनयम (1) के स्ट्र्ान पर जनम्नजलजखत उप-जनयम प्रजतस्ट्र्ाजपत दकया िाएगा, अर्ागत्,— “(1) लाइसेंवसंग प्राजधकरण द्वारा िारी या नवीनीकृत प्रत्यके ड्राइववंग लाइसेंस, प्रपत्र 7 में लैजमनेटेड या पॉलीजवनाइल क्लोराइड (पीवीसी) काड गके रूप म ेंहोगा और प्रपत्र म ेंभारतीय नागररकों तर्ा जविेिी नागररकों के जलए िारी या नवीनीकृत ड्राइववंग लाइसेंस के जलए अलग-अलग प्रारूप होंगे, िो अनलु ग्नक XI में जनधागररत जवजनिेिों के अनरूु प होंगे।”

(ii) उप-जनयम (6) का लोप दकया िाएगा।

7. उि जनयमों के जनयम 16 के पश् चात ् जनम्नजलजखत जनयम अतं :स्ट्र् ाजपत दकया िाएगा, अर्ातग ्,— “16क. ड्राइववंग लाइसेंस म ेंजववरण म ेंपररवतनग —

(1) ड्राइववंग लाइसेंस म ें िि ग जववरणों म ें पररवतनग िि ग करन े के जलए ऐस े ड्राइववंग लाइसेंस धारक द्वारा प्रपत्र 2क में आवेिन पोटगल पर दकया िाएगा, जिसके सार् सही जववरणों का वैध प्रमाण भी संलग्न होगा।

(2) उप-जनयम (1) म ें प्रस्ट्ततु दकए गए आवेिन को सूचना प्रौद्योजगकी अजधजनयम, 2000 (2000 का 21) के प्रावधानों के तहत जनर्िगष्ट ई-हस्ट्ताक्षर के माध्यम से आवेिक की पहचान सत्याजपत करने के बाि प्रमाजणत दकया िा सकता ह ैया केंद्र सरकार द्वारा अजधसूजचत हस्ट्ताक्षर या सत्यापन के दकसी अन्द्य तरीके से सत्याजपत दकया िा सकता ह।ै

(3) उप-जनयम (1) के तहत आवेिन प्राप्त होने के पंद्रह दिनों के भीतर, लाइसेंवसंग प्राजधकारी ड्राइववंग लाइसेंस म ें जववरणों में पररवतगन को मंिूरी िेगा या जलजखत रूप में ििग दकए िाने वाले कारणों के सार् उसे अस्ट्वीकृत करेगा, जिसकी सूचना आवेिक को इलक्े रॉजनक माध्यमों सजहत िी िाएगी। बिते दक यदि पते म ें पररवतगन के जलए उप-जनयम (1) के तहत कोई आवेिन तीस दिनों की अवजध के भीतर न तो स्ट्वीकार दकया िाता ह ैऔर न ही अस्ट्वीकार दकया िाता ह,ै तो आवेिन स्ट्वीकृत माना िाएगा।

8. उि जनयमों म,ें जनयम 17क में,—

(i) उप-जनयम (1) म,ें “आवेिक द्वारा धाररत ड्राइववंग लाइसेंस” िब्िों के पश् चात ् “और जनयम 32 म ें जनर्िगष्ट उजचत िुल्क” िब् िों का लोप दकया िाएगा;

(ii) उप-जनयम (2) के स्ट्र्ान पर जनम्नजलजखत उप-जनयम प्रजतस्ट्र्ाजपत दकया िाएगा, अर्ागत,्— “(2) उप-जनयम (1) के तहत आवेिन प्राप्त होन ेके सात दिनों के भीतर, जिस श्रेणी या श्रेजणयों के जलए आवेिन दकया गया ह,ै वह मोटर वाहन आवेिक के ड्राइववंग लाइसेंस से स्ट्वतः ही हटा दिया िाएगा।”

(iii) उप-जनयम (3) के पश् चात ् जनम्नजलजखत उप-जनयम अतं :स्ट् र्ाजपत दकया िाएगा, अर्ागत्,—[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5

(4) कोई भी व्यजि िो ड्राइववगं लाइसेंस से दकसी श्रणे ी या श्रजे णयों को स्ट्र्ायी रूप स े अभ् यर्पगत (सरेंडर) कर िेता ह,ै वह सरेंडर की तारीख स े एक वर्ग की अवजध के जलए उस श्रेणी या श्रेजणयों के जलए जिक्षार्ी अनुज्ञजप्त (लनगर लाइसेंस) या ड्राइववंग लाइसेंस प्राप्त करन े के जलए पात्र नहीं होगा।

9.उि जनयमों म,ें जनयम 32 म,ें —

(i) परंतुक के पश् चात्, जनम्नजलजखत परंतुक अंत:स्ट् र्ाजपत दकया िाएगा, अर्ागत,् — “बिते, यदि कोई सेवा ऑनलाइन आधार प्रमाणीकरण के माध्यम से प्राप्त की िाती है, तो कोई िुल्क नहीं जलया िाएगा।”

(ii) ताजलका म,ें क्र.सं. 13 पर,— (क) स्ट्तंभ (2) म,ें "ड्राइववगं लाइसेंस में िि गपत ेया दकसी अन्द्य जववरण िैस ेपता आदि म ेंपररवतगन" िब्िों के स्ट्र्ान पर, "ड्राइववंग लाइसेंस धारक के नाम या दकसी अन्द्य जववरण म ें पररवतगन िो ड्राइववंग लाइसेंस में िि ग है" िब्ि प्रजतस्ट्र्ाजपत दकए िाएंग;े (ख) स्ट्तंभ (3) म,ें “िो सौ रुपये” िब्िों के स्ट्र्ान पर, “कोई िुल्क नहीं लगाया िाएगा” िब्ि अंत:स्ट्र् ाजपत दकए िाएंगे;

(ग) स्ट्तंभ (4) में अंक, ऐजक्ससर और कोष्ठक “16क (1), 17क (1)” अंत:स्ट्र् ाजपत दकए िाएगं े;

(iii) क्र.सं. 13 और उससे संबंजधत प्रजवजष्टयों के पश् चात ् जनम्नजलजखत को अंत:स्ट् र्ाजपत दकया िाएगा, अर्ागत,् — क्रम प्रयोिन धनराजि जनयम धारा संख्या “13क ड्राइववंग लाइसेंस में पते म ेंपररवतगन या मोबाइल नंबर या ईमले कोई िुल्क नहीं जलया िाएगा 16क” आईडी का अद्यतन।

10. उि जनयमों के जनयम 81 म,ें क्र.सं. 7 म,ें स्ट्तंभ (3) म,ें "क्र.सं. 4 के सामने उजल्लजखत िुल्क का आधा। नोट: जनवास स्ट्र्ान पररवतगन के जलए 'अनापजत्त प्रमाण पत्र' प्रस्ट्तुत करने में जवलंब होने की जस्ट्र्जत में, मोटर साइदकलों के मामले में प्रत्येक माह या उसके भाग के जवलंब के जलए तीन सौ रुपये और अन्द्य वाहनों के मामल े में प्रत्येक माह या उसके भाग के जवलंब के जलए पांच सौ रुपय ेका अजतररि िल्ु क लगाया िाएगा" िब्िों और अंकों के स्ट्र्ान पर "कोई िल्ु क नहीं लगाया िाएगा" िब्ि प्रजतस्ट्र्ाजपत दकए िाएंगे।

11. उि जनयमों म,ें प्रपत्र 1क म,ें —

(i) िीर् ग म,ें कोष्ठक, िब्ि और अंक “[जनयम 5(1), (3), 7, 10(ए), 14(घ) और 18(घ) िेख]ें” के स्ट्र्ान पर कोष्ठक, िब्ि और अंक “[जनयम 5(1), 5(3), 7, 10(ए), 14(घ) और 18(घ) िेखें]” प्रजतस्ट्र्ाजपत दकए िाएंग;े

(ii) ऊपरी िाजहनी ओर, "पासपोटग आकार की तस्ट्वीर (फोटो) के जलए स्ट्र्ान" िब्िों के पश्च ात्, कोष्ठक, िब्ि और अंक "[ऑनलाइन आवेिन के जलए 1 एमबी से अजधक आकार की फोटो अपलोड न करें। चेहरा फ्रेम के 70% भाग में होना चाजहए। पयागप्त रोिनी के सार् सािे श्वेत पृष्ठभूजम का उपयोग करें। जडजिटल रंगीन फोटो का ररजॉल्यिू न 900 x 1200 जपक्सल और 2250 x 3000 जपक्सल के बीच होना चाजहए।]" अंत:स्ट्र् ाजपत दकए िाएंग;े

(iii) क्रम संख्य ाओं 1, 1क, 1ख और 1ग के स्ट्र्ान पर जनम्नजलजखत क्रम संख्य ाएं प्रजतस्ट्र्ाजपत की िाएंगी, अर्ागत—् “6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

1. क्या आवेिक मौिूिा लाइसेंस धारक ह?ै हां/नहीं 1क. ड्राइववंग लाइसेंस नंबर (क्रम संख्या 1 म ेंिहां “हा”ं अंदकत ह,ै वहां भरें) 1ख आधार काडग, उपलब्ध ह ैया नहीं हां/नहीं 1ग. आवेिक का नाम 1घ. का पुत्र/पत्नी/पुत्री 1ड.. पता 1च. िन्द्म जतजर् ”;

(iv) प्रजवजष्ट (छ) के स्ट्र्ान पर जनम्नजलजखत प्रजतस्ट्र्ाजपत दकया िाएगा, अर्ागत,् — “(छ) आवेिक का रि समूह (ब्ल ड ग्रपु ) और आरएच कारक (फैक्ट र)”;

(v) प्रजवजष्ट (छ) के पश् चात,् जनम्नजलजखत रटप्पण को अंत:स्ट् र्ाजपत दकया िाएगा, अर्ागत,् — "रटप्पण:

1. िहां आवेिक ने क्र.सं. 1 म ें “हा”ं अंदकत दकया ह ै और क्र.सं. 1क म ें ड्राइववंग लाइसेंस नंबर दिया है, वहां क्र.सं.

1ग, 1घ, 1ड. और 1च में जनर्िगष्ट जववरण सारर्ी पोटगल से स्ट्वतः प्राप्त कर जलए िाएगं े।

2. िहां आवेिक ने क्र.सं. 1 म ें“नहीं” अंदकत दकया ह,ै वहां क्र.स.ं 1ख, 1ग, 1घ और 1ड. में जनर्िगष्ट जववरण आवेिक द्वारा भरे िाएगं े।

3. इन जनयमों म ें दकसी बात के जसवाय, यदि कोई आवेिक आधार संख्या प्राप्त करन े के जलए पात्र है, लेदकन उसके पास आधार संख्या नहीं ह,ै तो ऐसे आवेिक के हस्ट्ताक्षर दकसी ऐसे गवाह द्वारा सत्याजपत दकए िाएंगे, जिसके पास ड्राइववंग लाइसेंस हो और िो आधार संख्या धारक हो और यह सत्यापन दकसी जचदकत्सक की उपजस्ट्र्जत म ें दकया िाएगा।

4. यदि कोई आवेिक क्र.सं. 1ख में “नहीं” का चयन करता ह,ै तो आवेिक को जनम्नजलजखत स्ट्क्र ीन के नीचे की ओर (ड्रॉप-डाउन) संिेि दिया िाएगा: “आपके हस्ट्ताक्षर, ड्राइववंग लाइसेंस धारक और आधार नंबर धारक गवाह द्वारा जचदकत् सक की उपजस्ट्र्जत म ें सत्याजपत दकए िाएंगे।”

(vi) जचदकत्सा दफटनेस प्रमाणपत्र िीर्ग में, "अनुकूजलत (एडेप् टेड) वाहन के अलावा दकसी अन्द्य वाहन को चलाने के जलए" िब्िों के पश् चात्, "आवेिक जनम्नजलजखत कारणों स े लाइसेंस रखन े के जलए जचदकत्सकीय रूप स े दफट नहीं है:- ………………" िब्िों और जवराम जचह्नों का लोप दकया िाएगा;

(vii) प्रजवजष्ट “अभ् यर्ी के हस्ट्ताक्षर या अगं ूठे का जनिान” के स्ट्र्ान पर प्रजवजष्ट “अभ् यर्ी के हस्ट्ताक्षर/जडजिटल हस्ट्ताक्षर/ई- हस्ट्ताक्षर” को प्रजतस्ट्र्ाजपत दकया िाएगा;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7

(viii) “अभ् यर्ी के हस्ट्ताक्षर/जडजिटल हस्ट्ताक्षर/ई-हस्ट्ताक्षर” िब्िों और जवराम जचह्नों के पश् चात्, जनम्नजलजखत िब्ि और जवराम जचह्न अतं :स्ट्र् ाजपत दकए िाएंगे, अर्ागत्— “यदि अभ् यर्ी के पास आधार सख्ं या नहीं ह,ै तो ऐसे अभ् यर्ी के हस्ट्ताक्षर दकसी गवाह द्वारा सत्याजपत दकए िाएंगे।” गवाह का नाम: __________________________ गवाह का ड्राइववंग लाइसेंस नंबर:___________ ………….

(गवाह के हस्ट्ताक्षर)

12. उि जनयमों म,ें प्रपत्र 2 म,ें—

(i) िीर् ग म,ें— (क) िब्िों और अंकों “[जनयम 10, 14, 17 और 18 िेख]ें” के स्ट्र्ान पर “[जनयम 10 और 14 िेख]ें ” िब्ि और अंक प्रजतस्ट्र्ाजपत दकए िाएंग;े (ख) “वाहन की नई श्रणे ी को िोड़न ेया ड्राइववंग लाइसेंस के नवीनीकरण या डुजप्लकेट ड्राइववंग लाइसेंस िारी करन े या पते या नाम जववरण में पररवतगन” िब्िों का लोप दकया िाएगा;

(ii) ऊपर िाजहनी ओर, "पासपोटग आकार की फोटो के जलए स्ट्र्ान (ऑनलाइन आवेिन के जलए 50 केबी स ेअजधक आकार की फोटो अपलोड न करें)" िब्िों, कोष्ठकों और अंकों के स्ट्र्ान पर "पासपोटग आकार की फोटो के जलए स्ट्र्ान (ऑनलाइन आवेिन के जलए 1 एमबी से अजधक आकार की फोटो अपलोड न करें। चेहरा फ्रेम के 70% भाग में होना चाजहए। पयागप्त रोिनी के सार् सािे श्वेत पृष्ठभूजम का उपयोग करें। जडजिटल रंगीन फोटो का ररजॉल्यूिन 900 x 1200 जपक्सल और 2250 x 3000 जपक्सल के बीच होना चाजहए।)" िब्ि, अंक और कोष्ठक प्रजतस्ट्र्ाजपत दकए िाएंगे;

(iii) “आवेिन की िान े वाली सवे ाएं” िीर्ग वाली ताजलका म,ें— (क) “आवेिन की िाने वाली सवे ाएं (िहां लागू हो, कृपया एक या एकाजधक सेवा के सामने सही का जनिान लगाएं)” िीर्ग के स्ट्र्ान पर “आवेिन की िाने वाली सेवाएं (िहां लागू हो, कृपया एक या एकाजधक सेवा का चयन करें)” िीर्ग प्रजतस्ट्र्ाजपत दकया िाएगा;

(viii) क्रम सिंख्या 5 म ेंतापलका का लोप दकया जाएगा;

(ix) क्रम सिंख्या 6 म ेंतापलका का लोप दकया जाएगा;

(x) क्रम सिंख्या 7 को क्रम सिंख्या 4 के रूप म ें पर्ु ः क्रमािंककत ककया जाएगा;

(2) कोई आ ेदक जो प्रश्न (क), (ग), (घ), (ङ), (च), (छ) और (ि) म ें से ककसी का भी उत्तर "हा"िं म ें दते ा ह ैया प्रश्न (ख) का उत्तर "र्हीं" म ें देता ह,ै तो उसे अपर्े उत्तरों को पूण न प स्तार के सार् स्पि करर्ा होगा, और उसके सिंबिंध म ेंऔर अजधक िानकारी देर् े की आ श्यकता हो सकती ह।ै ”;

NOTIFICATION New Delhi, the 16th October, 2026 G.S.R. 902(E).— The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by sub-sections (b), (c), (da),

(db), (e), (h), (ff), (i), (k) and (q) of section 27, clause (a) of sub-section (1) of section 139, and section 211A of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Gazette of India, are made available to the public;

The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government.

Draft Rules

1. Short title and commencement-(1) These rules may be called the Central Motor Vehicles (…. Amendment) Rules,

2026.

(2) Save as otherwise provided in these rules, they shall come into force on the date of their final publication in the Official Gazette.

2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), for rule 4, the following rule shall be substituted, namely,— “4. Evidence as to the correctness of address, age and identity.—

(1) Every applicant for the issue of a licence under this Chapter shall produce as evidence of his address, any one or more of the following documents in original or relevant extracts thereof duly self attested, namely,—

(a) Aadhaar Card,

(b) Elector Photo Identity Card (EPIC Card),

(c) Passport,

(d) e-Ration card,

(e) Service Photo Identity Card issued by Central Government or State Government or a Public Sector Undertaking or any other regulatory or statutory body,

(f) Pensioner Photo Identity Card or Freedom Fighter Photo Identity Card, or Pension Payment Order issued by Central Government or State Government or a Public Sector Undertaking or any other regulatory or statutory body,

(g) Electricity bill, not older than three months from the day of making the application,

(h) Household gas bill, not older than three months from the day of making the application,

(i) Any other document or documents as may be prescribed by the State Government under clause (k) of Section 28 of the Act,

(j) Proof of legal presence in India in addition to proof of residence in case of foreigners.

(2) Every applicant for the issue of a licence under this Chapter shall produce as evidence of his age or date of birth, any one or more of the following documents in original or relevant extracts thereof duly self attested, namely,—

(a) Passport,

(b) Mark-sheet of certificate issued by a recognised Board of School Education, university, a deemed- to-be university, higher educational institution or Industrial Training Institute established or recognised by the Central Government or a State Government, containing the date of birth of the applicant,

(c) Birth Certificate issued under the Registration of Births and Deaths Act, 1969 and the rules made thereunder,[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 31

(d) Service Photo Identity Card issued by Central Government or State Government or a Public Sector Undertaking or any other regulatory body or statutory body,

(e) Pensioner Photo Identity Card or Freedom Fighter Photo Identity Card, or Pension Payment Order issued by Central Government or State Government, or a Public Sector Undertaking or any other regulatory or statutory body,

(f) Any other document or documents as may be prescribed by the State Government under clause (k) of Section 28 of the Act.

(3) Every applicant for the issue of a licence under this Chapter shall produce as evidence of his identity, any one or more of the following documents in original or relevant extracts thereof duly self attested, namely,—

(a) Aadhaar Card,

(b) Valid Indian Passport,

(c) e-Ration Card,

(d) Service Photo Identity Card issued by Central Government or State Government or a Public Sector Undertaking or any other regulatory or statutory body,

(e) Pensioner Photo Identity Card or Freedom Fighter Photo Identity Card, or Pension Payment Order issued by Central Government or State Government or a Public Sector Undertaking or any other regulatory or statutory body,

(f) Permanent Account Number (PAN).”.

3. In the said rules, rule 6 shall be omitted.

4. In the said rules, in rule 11,—

(i) in sub-rule (1), —

(a) for the words “seven days”, the words “fifteen days” shall be substituted;

(b) after the words “shall complete a tutorial on safe driving”, the words "having a duration of not less than thirty minutes” shall be inserted;

(ii) in sub-rule (3), for the words and figures “of submitting an application under Rule 10”, the words and figures “from completing such tutorial referred to in sub-rule (1)” shall be substituted;

(iii) in sub-rule (4), for the words and figures “60 per cent”, the words and figures “75 per cent” shall be substituted;

(iv) in sub-rule (5), clauses (c) and (d) shall be omitted.

5. In the said rules, in rule 14,—

(i) in sub-rule (1), for the words and figures “Form 4”, the words and figures “Form 2” shall be substituted;

(ii) in sub-rule (2),—

(a) clauses (c) and (d) shall be omitted;

(b) in clause (e), after the words “valid proof of”, the word “Indian” shall be inserted.

6. In the said rules, in rule 16,—

(i) for sub-rule (1), the following sub-rule shall be substituted, namely,— “(1) Every driving licence issued or renewed by a licensing authority shall be in form of a laminated or Polyvinyl Chloride (PVC) card in Form 7, and the Form shall contain separate formats for driving licences issued or renewed for Indian nationals and foreign nationals, respectively, conforming to the specifications stipulated in Annexure XI.”;

(ii) sub-rule (6) shall be omitted.

7. In the said rules, after rule 16, the following rule shall be inserted, namely,— “16A. Change in particulars in the driving licence. —

(1) An application for recording a change in the particulars recorded in the driving licence shall be made on the Portal by the holder of such driving licence in Form 2A, accompanied by such valid evidence of correct particulars.32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(2) An application submitted in sub-rule (1) may be authenticated after verifying the identity of the applicant through e-signature as specified under the provisions of the Information Technology Act, 2000 (21 of 2000) or verified by any other mode of signature or verification as notified by the Central Government.

(3) Within fifteen days from the receipt of the application under sub-rule (1), the licensing authority shall approve the change in particulars in the driving licence or reject with reasons to be recorded in writing which shall be communicated to the applicant, including through electronic means:

Provided that where an application under sub-rule (1) for change of address is neither accepted nor rejected within a period of thirty days, the application shall be deemed to be approved.”.

8. In the said rules, in rule 17A,—

(i) in sub-rule (1), after the words “driving licence held by the applicant”, the words “and appropriate fee as specified in rule 32” shall be omitted;

(ii) for sub-rule (2), the following sub-rule shall be substituted, namely,— “(2) Within seven days from the receipt of the application under sub-rule (1), the class or classes of motor vehicle for which the application has been made shall be automatically deleted from the applicant’s driving license.”;

(iii) after sub-rule (3), the following sub-rule shall be inserted, namely,— “(4) Any person who permanently surrenders a class or classes from a driving license shall not be eligible to obtain a learner’s license or a driving license for such class or classes, for period of one year from the date of such surrender.”.

9. In the said rules, in rule 32,—

(i) after the proviso, the following proviso shall be inserted, namely,— “Provided further where any service is availed through online Aadhaar authentication, no fee shall be charged.”;

(ii) In the TABLE, in serial number 13,—

(a) in column (2), for the words “change in address or any other particulars recorded in the driving licence e.g. address etc.”, the words “change in name or any other particulars of the holder of driving licence recorded in the driving licence” shall be substituted;

(b) in column (3), for the words “Two hundred rupees”, the words “No fee shall be levied” shall be inserted;

(c) in column (4), the figures, letters and brackets “16A (1), 17A (1)” shall be inserted;

(iii) after Serial Number 13 and the entries relating thereto, the following shall be inserted, namely,— Sl. No. Purpose Amount Rules Section “13A Change in address in the driving licence or updation of mobile number No fee shall be 16A”.

10. In the said rules, in rule 81, in Serial Number 7, in column (3), for the words and figures "Half of the fee mentioned against Serial No. 4. Note: In case of delay in submitting ‘No Objection Certificate’ for change of residence, an additional fee of rupees three hundred for delay of each month or part thereof in case of motor cycles and five hundred rupees for each month of delay or part thereof for other vehicles shall be levied", the words “No fee shall be levied” shall be substituted.

11. In the said rules, in Form 1A,—

(i) in the heading, for the brackets, words and figures “[See Rules 5(1), (3), 7, 10(a), 14(d) and 18(d)]”, the brackets, words and figures “[See rules 5(1), 5(3), 7, 10(a), 14(d) and 18(d)]” shall be substituted;

Notwithstanding anything contained in these rules, where an applicant is eligible to obtain an Aadhaar number but is not an Aadhaar number holder, the signature of such applicant shall be attested by a witness, who holds a Driving Licence and is an Aadhaar number holder, in the presence of medical practitioner.

4. If an applicant selects “No” in serial numbers 1B, the following drop-down message shall be given to the

applicant: “Your signature shall be attested by a witness, who holds a Driving Licence and is an Aadhaar number holder, in the presence of medical practitioner.”;

(vi) In the heading, Certificate of Medical Fitness, after the words “to drive a vehicle other than an adapted vehicle.”, the words and punctuation mark “The applicant is not medically fit to hold a licence for the following reasons:- ………………” shall be omitted;

(vii) for the entry “Signature or thumb impression of the candidate”, the entry “Signature/Digital signature/ E-signature of the candidate” shall be substituted;

17. In the said rules, in Form 8,—

(i) After the words “To The Licensing Authority”, the words “I hereby apply for permanent surrender of the following class or classes of vehicles from my driving license, as applicable: a. Motor cycle without gear; b. Motor cycle with gear; c. Adapted Vehicle; d. Light Motor Vehicle; e. Transport Vehicle; f. Others, which is not covered in any of the above categories.” shall be omitted;

(ii) After the entry “Name of the Applicant”, entries “Address” and “Date of Birth” shall be omitted;

(iii) After the entry “Driving Licence Number”, the following shall be inserted, namely,— “Class(es) of vehicles for which permanent surrender is being sought (Please tick mark against the class or classes of vehicles) a. Motor cycle without gear b. Motor cycle with gear c. Adapted Vehicle d. Light Motor Vehicle e. Transport Vehicle f. e-rickshaw g. e-cart h. Others, which is not covered in any of the above categories.

(iv) for the words “Signature/Thumb impression of Applicant”, the words “Signature of Applicant” shall be substituted.

18. In the said rules, in Annexure XI,—

(i) in Part I,—

(a) in the heading, the words “or Smart Card type” shall be omitted;

(b) for clauses (a) to (h), the following clause shall be substituted, namely,— “(a) The Laminated Card shall be compliant to ISO/IEC 7810 ID-1.”;

(c) clauses (i) and (j) shall be re-numbered as clauses (b) and (c), respectively;

(ii) in Part II,—

(a) in clause (a), at the end, the following clause shall be inserted, namely,— “The card shall measure 85.6 mm x 54.02 mm, subject to the tolerances applicable to ID-1 cards under ISO/IEC 7810, and the thickness of the card shall not be less than 0.7 mm.”;

(b) in clause (b), the words and punctuations “For measuring the maximum and minimum thicknesses, the contact chip shall also be considered. Thus, no point of the entire IC contact surface shall be higher than 0.10 mm above or lower than 0.10 mm below the adjacent surface of the card.” shall be omitted;

(c) in clause (c), for the words and punctuations “The card construction shall be made of bonded materials with inserts of the ISO7816-2 compliant contact chip (for ICC) if provided, or with inserts of the ISO144443 compliant contactless chip with associated antenna (for PICC), if provided.”, the words and punctuations “The card construction shall be bonded or multi-layered plastic construction suitable for visual personalisation.” shall be substituted;

(d) in clause (d), in sub-clause (i),—

(1) in paragraph (1), the figure and brackets “(1)” shall be omitted;

(2) in the same paragraph, for the words and punctuations “For carrying out the bending stiffness test, the cards shall be exercised in the following four configurations, namely:—”, the words and punctuations “The test shall be applicable to the plastic card as a whole.” shall be substituted;

(3) sub-paragraphs (a), (b), (c) and (d) and paragraph (2) shall be omitted;

(e) in clause (e),—

(1) for the words and punctuations “The cards shall continue to work electronically after the test is performed with 250 bending each along axis A and axis B and with card contacts facing upwards as well as downwards.”, the words and punctuations “The test shall be performed with 250 bending each along axis A and axis B, with each face of the card presented upwards as well as downwards.” shall be substituted;

(2) sub-clauses (iii) and (iv) shall be omitted;

(f) in clause (f), sub-clauses (iii) and (iv) shall be omitted;

(g) in clause (g), in sub-clause (ii),—

(1) paragraph (d) shall be omitted;

(2) paragraph (e) shall be re-numbered as paragraph (d);

(h) clauses (i), (j) and (k) shall be omitted;

(iii) in Part III, in clause (a), for the words and punctuations “personalisation - electronic as well as visual on the card surfaces. Typically, dye sublimation printing is used for visual personalisation.”, the words and punctuations “visual personalisation on the card surfaces. Colour dye sublimation printing may be used for the visual personalisation of PVC, ABS or PetG cards, and laser engraving may be used for visual personalisation of polycarbonate cards, consistent with the applicable card constructions.” shall be substituted.
