Amendment in Export Policy of items under HS Codes 27101241,
27101242, 27101243, 27101244, 27101249, 27101941, 27101944 and
27101949 of Chapter 27 of Schedule 2 of the ITC (HS) Export
Policy.
This notification, dated June 30, 2022, from the Ministry of Commerce and Industry, Department of Commerce, Directorate General of Foreign Trade, amends the export policy for specific items under Chapter 27 of Schedule 2 of the ITC HS Export Policy. The items affected are those classified under HS Codes 27101241, 27101242, 27101243, 27101244, 27101249, 27101941, 27101944 and 27101949, specifically concerning motor gasoline conforming to standards IS 2796, IS 17021 or IS 17076 and gas oil.
The export policy for motor gasoline conforming to specified IS standards is "Free," but with the condition that exporters submit a self-declaration to the Customs authority at the time of export, confirming that 50% of the quantity mentioned in the Shipping Bill has been/will be supplied to the domestic market during the current financial year. A quarterly return must also be filed with the Ministry of Petroleum and Natural Gas (MoPNG).
For gas oil and oils obtained from gas, including automotive diesel fuel (not containing biodiesel, conforming to standard IS1460) and high flash high-speed diesel fuel (conforming to standard IS 16864), exporters are required to submit a self-declaration to Customs, confirming that 30% of the quantity mentioned in the Shipping Bill has been/will be supplied to the domestic market during the current financial year. This condition is waived for exports to Bhutan and Nepal, as well as for 100% EOUs and units in SEZs. These exporters are also required to file a quarterly return to MoPNG. The legal basis for this amendment is derived from Section 3 and Section 5 of the Foreign Trade Development and Regulation Act, 1992, and the Foreign Trade Policy, 2015-20.
