**Report on Amendment to Import Policy Condition No. 07 i of Chapter 27 of Schedule-I Import Policy of ITC (HS), 2022 Regarding Coal Import Monitoring System (CIMS)**
**1. Executive Summary:**
This report analyzes an amendment to Import Policy Condition No. 07 i of Chapter 27 of Schedule-I Import Policy of ITC (HS), 2022, which concerns the Coal Import Monitoring System (CIMS). The core purpose of this amendment is to modify the registration fee structure for obtaining an Automatic Registration Number under CIMS. The key finding is a change in how the registration fee is calculated, referencing a new Appendix 2K, thus altering the financial burden on importers utilizing the CIMS.
**2. Introduction:**
This report aims to provide a clear and concise overview of the recent amendment to the Import Policy concerning the Coal Import Monitoring System (CIMS), as detailed in the provided government notification. The analysis is based solely on the information presented within the given text.
**3. Policy Overview:**
* **Original Policy Being Amended:** Import Policy Condition No. 07 i of Chapter 27 of Schedule-I Import Policy of ITC (HS), 2022, notified vide Notification No. 34/2023 dated 04.10.2023.
* **Core Objective(s) (Inferred):** The original policy likely aimed to monitor and regulate coal imports by requiring importers to submit advance information through an online system. The objective, based on the initial condition, likely includes tracking the quantity and value of coal imports.
**4. Background and Rationale:**
The provided text suggests the amendment is being implemented to refine the registration fee structure for the Coal Import Monitoring System (CIMS). The change indicates a potential reassessment of the existing fee structure (Rs. 1 per thousand, subject to minimum of Rs. 500 and maximum of Rs. 1 Lakh, on CIF value) possibly in response to feedback from importers, administrative considerations, or a need to adjust the cost burden associated with the CIMS. The amendment indicates that the older version needed revision of the registration fees.
**5. Key Provisions / Changes:**
This amendment specifically alters the registration fee structure for obtaining an Automatic Registration Number under the Coal Import Monitoring System (CIMS).
* **Specific Part of the Original Policy Being Changed:** The method of registration fee calculation for the CIMS. The original policy stated: "fee of Rs. 1 per thousand, subject to minimum of Rs. 500 and maximum of Rs. 1 Lakh, on CIF value".
* **New Rule/Provision:** The revised policy replaces the earlier formula with "registration fee as per Appendix 2K".
* **Difference/Effect of the Change:** The new rule entirely replaces the older way of calculating the registration fee. The exact impact of the change is unknown without the contents of Appendix 2K. However, it clearly signals a change in the cost structure associated with CIMS registration. This potentially affects the financial planning of businesses that import coal.
**6. Target Audience and Stakeholders:**
The primary target audience and stakeholders directly affected by this amendment are:
* Importers of coal who are required to use the Coal Import Monitoring System (CIMS).
* The Directorate General of Foreign Trade (DGFT), as the implementing and regulatory body.
* The Ministry of Commerce and Industry, responsible for overall policy oversight.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Directorate General of Foreign Trade (DGFT) is responsible for implementing the amended policy.
* **Timelines/Procedures:** The amendment takes effect "with immediate effect," implying immediate implementation. The procedure for registration remains the same, but the fee calculation will now be based on Appendix 2K.
* **Specific Changes in Implementation:** Importers will now need to refer to Appendix 2K to determine the registration fees payable under CIMS. The online registration system will need to be updated to reflect this change.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of this amendment is a revised and (potentially) a more equitable or efficient fee structure for the CIMS. Without Appendix 2K, the effect of the change on the finances of the importers is unknown. It could lower costs, increase costs, or redistribute the cost burden across importers.
**9. Conclusion:**
This report details the amendment to the Import Policy concerning the Coal Import Monitoring System (CIMS), specifically addressing the registration fee structure. The amendment replaces the prior method of calculation with a reference to Appendix 2K. The change necessitates that importers consult Appendix 2K to determine the new fee structure. The significance of this amendment lies in its potential to alter the financial implications for businesses involved in coal imports and highlights the government's ongoing efforts to refine trade regulations.
