## Policy Analysis Report: Amendment to Import Policy Condition for Areca Nut (ITC HS 0802 80 10)
**1. Executive Summary:**
This report analyzes an amendment to the import policy condition for Areca nut (ITC HS 0802 80 10) as outlined in Notification No. 36 (2015-2020) dated September 28, 2022, issued by the Directorate General of Foreign Trade (DGFT). The amendment modifies the import conditions for fresh green Areca nut, specifically concerning imports from Bhutan. Key changes include allowing the import of 17,000 Metric Tonnes of fresh green Areca nut without the Minimum Import Price (MIP) condition, subject to specific conditions related to port of entry and registration. This report details the amendment's background, key changes, affected stakeholders, and expected impact.
**2. Introduction:**
This report aims to provide a comprehensive analysis of the recent amendment to the import policy condition for Areca nut (ITC HS 0802 80 10) based on the provided policy text. The analysis will focus on understanding the changes introduced by the amendment and its potential implications for relevant stakeholders.
**3. Policy Overview:**
* **Original Policy:** The amendment pertains to the Foreign Trade Policy, 2015-2020, specifically modifying the import policy conditions under ITC HS 0802 80 10, which falls under Chapter 08 of ITC HS, 2022, Schedule I Import Policy.
* **Core Objective(s):** The primary objective of the original policy, as inferred from the context of the amendment, is to regulate the import of Areca nut, potentially to protect domestic producers and ensure fair pricing. The amendment aims to modify these regulations with respect to imports from Bhutan.
**4. Background and Rationale:**
The amendment seems to address specific trade relations with Bhutan. The original policy likely imposed restrictions (specifically the MIP) on Areca nut imports that may have hindered trade with Bhutan. This amendment appears to be a measure to facilitate trade with Bhutan by relaxing these restrictions under specific conditions.
**5. Key Provisions / Changes:**
This section focuses on the changes introduced by the amendment:
* **Specific Part of Original Policy Changed:** The amendment directly modifies the "Existing Policy" condition for ITC HS code 08028010, which previously prohibited the import of whole Areca nut unless the CIF value was Rs. 251 and above per Kilogram.
* **New Rule/Provision:** The amendment introduces an exception to the existing policy, allowing the import of 17,000 Metric Tonnes of Fresh green Areca Nut without Minimum Import Price (MIP) condition from Bhutan every year.
* **Difference/Effect of the Change:** The amendment significantly eases import restrictions on fresh green Areca nut from Bhutan, removing the MIP requirement for a specified quantity. This allows for the import of Areca nut from Bhutan at potentially lower prices than previously permitted, potentially increasing the volume of imports from Bhutan. The imports are however, restricted through LCS Jaigaon INJIGB only, and, shall be subject to a valid Registration Certificate issued by DGFT.
**6. Target Audience and Stakeholders:**
Based on the provided text, the following stakeholders are directly affected by this amendment:
* **Importers of Areca nut, particularly those importing from Bhutan:** This amendment directly impacts their ability to import fresh green Areca nut without being subject to the MIP condition.
* **Traders operating through LCS Jaigaon INJIGB:** The amendment specifies this port for imports under the relaxed conditions.
* **Directorate General of Foreign Trade (DGFT):** DGFT is responsible for issuing Registration Certificates, a requirement for availing of the relaxed import conditions.
* **Bhutanese Areca nut producers and exporters:** The amendment provides them with preferential access to the Indian market.
**7. Implementation Aspects (Inferred):**
* **Responsible agency/bodies:** Directorate General of Foreign Trade (DGFT) is responsible for issuing Registration Certificates.
* **Timelines or procedures:** The amendment allows imports of 17,000 MTs of Areca nut from Bhutan every year. Importers must obtain a Registration Certificate from DGFT and route shipments through LCS Jaigaon INJIGB.
* **Implementation of Changes:** Importers seeking to import Areca nut from Bhutan without the MIP condition must adhere to the specific port of entry and registration requirements outlined in the amendment.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of this amendment is to:
* **Increase trade volume with Bhutan:** By removing the MIP condition, the amendment is expected to facilitate increased imports of fresh green Areca nut from Bhutan.
* **Potentially lower prices for consumers (to an extent):** The removal of the MIP may lead to a decrease in the price of Areca nut in the Indian market, although the limited quantity and specific source may limit the overall impact.
* **Strengthen bilateral trade relations with Bhutan:** The amendment can be seen as a gesture of goodwill and a step towards fostering stronger trade relations with Bhutan.
**9. Conclusion:**
The amendment to the import policy condition for Areca nut (ITC HS 0802 80 10) represents a significant change in trade relations with Bhutan. By allowing the import of 17,000 MTs of fresh green Areca nut without the MIP condition, subject to specific conditions, the amendment is expected to boost trade volume between the two countries. This amendment demonstrates the government's commitment to fostering bilateral trade relationships while also regulating the import of agricultural commodities. Stakeholders, particularly importers, should familiarize themselves with the specific requirements outlined in the amendment to ensure compliance.
