Executive Summary & Key Takeaways

What it means

  • The gazette notification restricts the import of Laptops, Tablets, All-in-one Personal Computers, Ultra small form factor Computers, and Servers under HSN 8471, requiring a valid license for restricted imports.
  • Several exemptions are provided, including imports under baggage rules, import of one unit (excluding servers) per consignment, imports for R&D purposes (up to 20 items per consignment), re-import of repaired goods, and when the items are essential parts of capital goods.

Key Changes

  • The import policy for items under HSN 8471, specifically personal computers, microcomputers, large or mainframe computers, other automatic data processing machines, and processing units, has been changed from 'Free' to 'Restricted'.
  • Policy condition No. 4 is added to Chapter 84 of the ITC (HS) 2022, which specifies the restrictions and exemptions related to the import of these items.
  • Import of Laptops, Tablets, All-in-one Personal Computers, and Ultra small form factor Computers and Servers falling under HSN 8741 shall be 'Restricted’ and their import would be allowed against a valid Licence for Restricted Imports.
  • Exemption from Import Licencing requirements is provided for Import of 1 Laptop, Tablet, All-in-one Personal Computer, or Ultra small form factor Computer, including those purchased from e-commerce portals, through post or courier. Imports shall be subject to payment of duty as applicable.
  • Exemption from import licence is provided for up to 20 such items per consignment for the purpose of R&D, Testing, Benchmarking and Evaluation, repair and re-export, Product Development purposes. Given imports shall be allowed subject to condition that the imported goods shall be used for the stated purposes only and will not be sold. Further, after the intended purpose, the products would either be destroyed beyond use or re-exported.
  • Laptops, Tablets, All-in-one Personal Computers, and Ultra small form factor Computers and Servers which are an essential part of a Capital Good shall be exempted from the import licencing requirements.

Impact Analysis

Importers

  • Need to carefully assess whether their imports qualify for any of the exemptions (e.g., baggage rules, R&D, repair/re-export, essential part of capital goods).

E-commerce Portals

  • May need to modify their processes to comply with the new regulations and provide clear information to customers about potential duties and licensing requirements for larger orders.

R&D and Product Development Companies

  • Must maintain accurate records of imported items and their use to demonstrate compliance with the regulations.

Consumers

  • Potential for increased prices due to import restrictions and licensing costs.

Action Items

  • Monitor future amendments to the Foreign Trade Policy and ITC (HS) codes.
