(1) इन जनयमों को भारतीय पुजलस सेिा (िेतन) संिोधन जनयमािली, 2023 कहा िाएगा। (2) इन्‍दह ें1 िनिरी 2016 स े प्रभािी हुआ माना िाएगा। 2. भारतीय पुजलस सेिा (िेतन) जनयमािली, 2016 के जनयम 5 म ें उप जनयम (9) के जलए जनम्न जलजखत उप जनयम प्रजतस्ट् थाजपत दकए िाएंग;े अथाति ्:- “(9) सेिा म ें एक ग्रेड स े िसू रे ग्रेड म ें पिोन्नजत होन े पर सेिा के सिस्ट्य के पास उच्च पि के िेतन स्ट्तर म ें अपनी पिोन्नजत की जतजथ स े या उपरोि संगत उप-जनयम म ें दिए गए प्रािधान के अनुसार जनचले स्ट्केल म ें जिस जतजथ को िह िेतन िृजि (इन्‍दरीमेंट) अर्िित करता ह ै उस जतजथ स े अपने िेतन को जनयत करिाने का जिकल्प होगा; बाि के मामल े म,ें पिोन्नजत की तारीख पर सेिा के सिस्ट्य को उस स्ट्तर म ें अगल े उच्चतर सले म ें रखा िाएगा जिसम ें 7501 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] जनचल े स्ट्केल म ें अगल े िेतन िजृ ि की तारीख अथाित ् िुलाई की पहली तारीख या िनिरी की पहली तारीख स े उपयुिि सगं त उप-जनयम में दिए गए प्रािधानों के अनुसार दकए िाने िाल े अगले पुनः जनयतन के साथ उस े पिोन्नत दकया िाता ह।ै [फा. स.ं 14021/1/2023-अ.भा.स.े-II] ि.े अिोक कुमार, जनििे क व्याख्यात्मक ज्ञापन: केंर सरकार ने भारतीय पुजलस सेिा (िेतन) जनयमािली 2016 के जनयम 5 के उप-जनयम 9 म ें संिोधन करन े का जनणिय जलया ह ै िो भा.पु.स े के अजधकाररयों के उनके एक ग्रेड स े िसू रे म ें पिोन्नजत पर िेतन जनयतन का उपबंध करता ह।ै तद्नुसार भारतीय पुजलस सेिा (िेतन) जनयमािली, 2016 को 01 िनिरी, 2016 स े संिोजधत दकया िा रहा ह।ै यह प्रमाजणत दकया िाता ह ै दक भारतीय पुजलस सेिा का कोई सिस्ट्य इन जनयमों के भूतलक्षी प्रभाि स े प्रजतकूल रूप म ेंप्रभाजित नहीं होन े िा रहा ह।ै रटप्पणी: प्रधान जनयमािली को भारत के रािपत्र, असाधारण म ें दिनांक 23 जसतम्बर, 2016 की अजधसूचना संख्या सा का जन 910 (अ) के माध्यम स े प्रकाजित दकया गया था और अंजतम संिोधन 30 दिसंबर, 2021 की अजधसूचना संख्या सा.का.जन. 915(अ) के माध्यम स े दकया गया था। MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS (Department of Personnel and Training) NOTIFICATION New Delhi, the 5th December, 2023 G.S.R. 874(E).—In exercise of the powers conferred by sub-sections (1) and (1A) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government hereby makes the following rules further to amend the Indian Police Service (Pay) Rules, 2016, namely: ─ 1. (i) These rules may be called the Indian Police Service (Pay) Amendment Rules, 2023. (ii) They shall be deemed to have come into force on the 1st day of January, 2016. 2. In the Indian Police Service (Pay) Rules, 2016, in rule 5, for sub-rule (9), the following sub-rule shall be substituted, namely:- “(9) On promotion from one grade to another in the Service, a member of the Service shall have an option to get his pay fixed in the Level of the higher post either from the date of his promotion or from the date on which he subsequently earns an increment in the lower scale in the manner provided in the relevant sub-rule above; in the latter case, on the date of promotion, a member of Service shall be placed at the next higher cell in the Level to which he or she is promoted with further re-fixation to be done in the manner provided in relevant sub-rule above with effect from the 1st day of January or the 1st day of July, the date of accrual of the next increment in the lower scale.” [F. ASHOK KUMAR, Director Explanatory Memorandum: The Central Government has decided to amend sub-rule 9 of rule 5 of the Indian Police Service (Pay) Rules, 2016 which provides for the fixation of pay of IPS officers on their promotion from one grade to another. The Indian Police Service (Pay) Rules, 2016 are being amended accordingly with effect from the 1st January, 2016. It is certified that no member of the Indian Police Service is likely to be adversely affected by giving retrospective effect to these rules. Note: The principal rules were published in the Gazette of India, Extraordinary, vide notification number GSR 910 (E) dated the 23rd September, 2016 and last amended vide notification number GSR 915(E) dated the 30th December, 2021.
