Amendment in Policy Condition No. 7(ii) of Chapter 27 of ITC (HS), 2022, Schedule I (Import Policy) Implementation of Coal Import Monitoring System (CIMS)
## Report on Amendment to Coal Import Monitoring System (CIMS) Policy
**1. Executive Summary:**
This report analyzes an amendment to Policy Condition No. 7(ii) of Chapter 27 of Schedule I Import Policy of ITC (HS), 2022, which concerns the implementation of the Coal Import Monitoring System (CIMS). The amendment modifies the timeframe for registration applications, requiring importers to apply no later than 5 days (previously 15 days) before the expected arrival date of the consignment. This change aims to refine the import registration process. All other aspects of the CIMS policy, including the 75-day validity of the Automatic Registration Number, remain unchanged. The report provides an overview of the amendment and its likely impact on importers and customs procedures.
**2. Introduction:**
This report provides an informative analysis of an amendment to the Coal Import Monitoring System (CIMS) policy, specifically focusing on the changes introduced by the notification published on November 7, 2022. The analysis is based solely on the provided policy text and aims to inform stakeholders of the revised procedures.
**3. Policy Overview:**
* **Original Policy:** This report analyzes an amendment to Policy Condition No. 7(ii) of Chapter 27 of Schedule I Import Policy of ITC (HS), 2022, related to the Coal Import Monitoring System (CIMS).
* **Core Objective(s):** Based on the text, the core objective of CIMS is to monitor and regulate coal imports, which includes tracking and registering shipments. This is evidenced by the amendment focusing on the importer registration process.
**4. Background and Rationale:**
* **Amendment Rationale:** The amendment appears to be driven by a need to refine the efficiency of the registration process. The change from 15 days to 5 days for the latest date to register before arrival suggests a potential desire to expedite customs clearance or address issues related to the previous timeframe, such as delayed registration or processing bottlenecks. There is no indication as to *why* the time frame changed, but that it did.
**5. Key Provisions / Changes:**
This section focuses specifically on the change introduced by the amendment.
* **Specific Part of Original Policy Changed:** Policy Condition No. 7(ii) of Chapter 27 of Schedule I Import Policy of ITC (HS), 2022.
* **New Rule/Provision:** The amendment modifies the registration application timeframe. The revised condition states: "The importer can apply for registration not earlier than 60th day and not later than 5 days before the expected date of arrival of import consignment."
* **Difference/Effect of Change:** The key difference is the reduction of the latest possible registration application date from 15 days to 5 days before the expected arrival of the import consignment. This effectively reduces the window for last-minute registration applications. The policy regarding the validity of the registration (75 days) remains unchanged.
**6. Target Audience and Stakeholders:**
Based on the text, the primary target audience and stakeholders directly affected by this amendment are:
* **Coal Importers:** They are directly impacted by the changes to the registration application timeframe.
* **Customs Officials:** They are responsible for enforcing the CIMS regulations and will need to adapt to the revised registration timeframe.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Directorate General of Foreign Trade (DGFT), Ministry of Commerce and Industry.
* **Timelines/Procedures:** The amendment modifies the timeline for registration. Importers must now apply for registration no later than 5 days before the expected arrival date. The procedure of entering the Registration Number and expiry date in the Bill of Entry remains unchanged.
* **Amendment-Specific Implementation:** Customs officials will need to update their procedures to reflect the revised registration timeframe. Importers must be made aware of the new deadline to ensure compliance.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of this change is to streamline the coal import process by encouraging importers to register earlier. This may lead to:
* **Reduced Delays:** Earlier registration potentially allows for smoother customs clearance and reduces delays associated with last-minute applications.
* **Improved Monitoring:** A more controlled registration timeframe could enhance the effectiveness of the CIMS by providing customs officials with earlier visibility on incoming coal shipments.
**9. Conclusion:**
The amendment to Policy Condition No. 7(ii) of Chapter 27 of Schedule I Import Policy of ITC (HS), 2022, represents a refinement of the Coal Import Monitoring System (CIMS). By reducing the registration application window, the amendment aims to improve efficiency and reduce potential delays in the import process. Stakeholders, particularly coal importers, should take note of this change and adjust their registration practices accordingly.
