Executive Summary & Key Takeaways

What it means

  • The notification amends the Central Civil Services (Leave) Rules, 1972, concerning paternity and child adoption leave for central government employees.
  • The amendment includes provisions for leave related to pre-adoption foster care.

Key Changes

  • Paternity Leave (Rule 43AA): A male government employee with fewer than two surviving children is eligible for 15 days of paternity leave if they accept a child in pre-adoption foster care or legally adopt a child under one year old. This leave must be taken within six months from the date of accepting the child in pre-adoption foster care or valid adoption.
  • If the pre-adoption foster care does not lead to valid adoption, the paternity leave already taken will be deducted from any other leave available to the employee's account.
  • Child Adoption Leave (Rule 43B): A female government employee with fewer than two surviving children is eligible for 180 days of child adoption leave if they accept a child in pre-adoption foster care or legally adopt a child under one year old. The leave can be granted immediately after accepting the child in pre-adoption foster care or on valid adoption.
  • Similar to paternity leave, if the pre-adoption foster care does not lead to valid adoption, the child adoption leave already taken will be deducted from any other leave available to the employee's account.

Impact Analysis
