प्रस्ट्ताव करती ह,ै म ें और अजधक संिोधन करते हुए जनम्नजलजखत प्रारूप कजतपय जनयमों को इस अजधजनयम की धारा 212 की उप-धारा (1) के द्वारा यथावश्यक इसके द्वारा प्रभाजवत होने की संभावना वाले सभी व्यजियों की िानकारी के जलए एतिद्वारा प्रकाजित दकया िाता ह;ै और एतिद्वारा नोरटस दिया िाता ह ै दक उि प्रारूप जनयमों को उस तारीख स े तीस दिन की अवजध समाप्त होने के पश्चात् जवचाराथग स्ट्वीकार कर जलया िाएगा, जिस तारीख से सरकारी रािपत्र में यथा प्रकाजित इस अजधसूचना की प्रजतयां िनता के जलए उपलब्ध करायी िाती ह;ैं उपरोि अवजध समाप्त होने के पहले उक्त प्रारूप जनयमों के संबंध म ें दकसी भी व्यजि स े प्राप्त होने वाली दकन् हीं आपजत्तयों या सुझावों पर केंद्र सरकार द्वारा जवचार दकया िाएगा। 3. इन प्रारूप जनयमों के प्रजत आपज‍ तयों एवं सुझावों, यदि कोई हो, को अपर सजचव (एमवीएल, पररवहन और सड़क सुरक्षा), ईमेल: की तारीख स े प्रवृ‍ त होंगे। 2. केन्द्रीय मोटर यान जनयमावली, 1989 (इसमें आगे उि जनयमों के रूप म ें उजल्लजखत) के जनयम 2 म,ें खंड (आईिी) के पश्चात ् जनम्नजलजखत खंड अंतःस्ट्थाजपत दकए िाएंगे, अथातग ्:- (आईएच) "श्रेणी एल1-1" स े ता‍पय ग तीन पजहयों वाली मोपेड अजभप्रेत ह,ै जिसम:ें i. थर्मगक इंिन के मामले म ें इंिन क्षमता 50 सीसी स े अजधक नहीं होनी चाजहए या इलेजक्रक पावर रेन के साथ दिट ह,ै तो अजधकतम िजि 4 दकलोवाट स े अजधक नहीं होनी चाजहए; तथा ii. अजधकतम जडजाइन वाहन गजत 45 दकमी/घंटा स े अजधक नहीं होनी चाजहए; तथा iii. कबग विन 270 दकलोग्राम स े अजधक नहीं (रैक्िन बैटररयों के द्रव्यमान को छोड़कर); तथा iv. अजधकतम िो बैठने के स्ट्थानों स े सुसजित, जिसमें चालक के बैठने का स्ट्थान (75 दकग्रा) भी िाजमल ह।ै (ii) "श्रेणी एल1-1एम" स े श्रेणी एल1-1 वाहन अजभप्रेत ह,ै िो अपनी तकनीकी जविेर्ताओं के आधार पर याजत्रयों को ले िाने के जलए ह;ै (ij) "श्रेणी एल1-1एन" श्रेणी एल-1-1 वाहन स े अजभप्रेत ह,ै िो अपनी तकनीकी जविेर्ताओं के कारण समय- समय पर यथासंिोजधत माल ले िाने के जलए ह;ै 3. उि जनयम के जनयम 2 के उप-जनयम (प) म ें जवद्यमान परन्तुक के पश्चात ् जनम्नजलजखत परन्तुक अंतःस्ट्थाजपत दकया िाएगा, अथागत्:- बिते दक एआईएस-178 म ें यथापररभाजर्त राइसाइदकल को मोटर वाहन नहीं माना िाएगा, यदि एआईएस- 178 के भाग ग की सभी ितों को जनयम 126 म ें जनर्िगष्ट परीक्षण एिेंसी द्वारा स‍याजपत और प्राजधकृत दकया गया हो। 4. उि जनयम म,ें जनयम 16 म,ें उप-जनयम (6) के पश्चात ् जनम्नजलजखत उप-जनयम अंतःस्ट्थाजपत दकया िाएगा, अथागत्:- “(7) दिव्यांगिनों को िारी दकए गए लाइसेंस के मामले म,ें 3.5 टन िीवीडब्ल्यू और एन1 से नीच े श्रेणी एम1 के रूपांतररत वाहन चलाने के जलए, दिव्यांगता के प्रकार का उल्लेख प्रपत्र 7 में दकया िाएगा। प्रपत्र 7 में पररभाजर्त दिव्यांगता का प्रकार जनम्नजलजखत ताजलका के अनुसार होगा: क्र. स. ं िारीररक दिव्यागं ता का प्रकार (लोकोमोटर दिव्यागं ता) दिव्यागं ता के जलए सजं क्षप्त नाम (1) (2) (3) 1. िोनों स्ट्थान पर जनम्नजलजखत खंड (II) और सारणी प्रजतस्ट्थाजपत की िाएगी, अथागत्:- (II) जतपजहया वाहन श्रेणी एल5 एम/एल5 एन, ई-ररक्िा/ई-काटग और तीन पजहयों वाली मोपेड सारणी[भाग II—खण् ड 3(i)] भारत का रािपत्र : वाली मोपडे (एल1-1 श्रणे ी) 1.0 2.8 1.8 6. उि जनयमों म,ें जनयम 96 के उप-जनयम (1) म ें तथा उप-जनयम (1) के पश्चात ् परंतुक म,ें "अमान्य कैरेि" िब्िों के स्ट्थान पर, "रूपांतररत वाहन" िब्ि प्रजतस्ट्थाजपत दकए िाएंगे। 7. उि जनयम म,ें जनयम 96 के उप-जनयम (1) के प्रथम परन्तुक के पूवग जनम्नजलजखत परन्तुक अंत:स्ट्थाजपत दकए िाएंगे, अथागत्:- “बिते दक 3.5 टन िीवीडबल्यू और एन1 स े कम श्रेणी एम1 के रूपांतररत वाहन को सर्वगस ब्रेक स े सुसजित दकया िाएगा, जिसे पैर या हाथ से संचाजलत दकया िा सकता है। एम1, एन1 श्रेजणयों के रूपांतररत वाहनों के जलए ब्रेककंग आवश्यकताएँ समय-समय पर यथासंिोजधत एआईएस-169 के अनुरूप होंगी।” 8. इन जनयमों के रािपत्र में प्रकािन की तारीख से एक वर्ग के पश्चात,् उि जनयमों म,ें जनयम 98 म,ें उप-जनयम (3) में, अंजतम परंतुक के पश्चात,् जनम्नजलजखत परंतुक अंतःस्ट्थाजपत दकया िाएगा, अथागत्:- “बिते इसके अजतररि, यह भी प्रावधान ह ै दक, श्रेणी एम1 और एन1 के रूपांतररत वाहनों के जलए स्ट्टीयररंग प्रयास आवश्यकताएं समय-समय पर यथासंिोजधत एआईएस-169 के अनुरूप होंगी।” 9. उि जनयम म,ें जनयम 112-क म,ें उप-जनयम 2 के पश्चात् जनम्नजलजखत उप-जनयम अंतःस्ट्थाजपत दकया िाएगा, अथागत्:- “(3). रूपांतररत वाहन i. 3.5 टन स े कम िीवीडबल्यू और एन1 श्रेणी के वाहन, जिन्ह ें 1 अक्टूबर 2025 को और उसके बाि रूपांतररत वाहनों के रूप म ें उपयोग के जलए पररवर्तगत दकया गया ह,ै वे समय-समय पर यथासंिोजधत एआईएस-169:2021 के अनुरूप होंगे ह।ै ii. 1 अक्टूबर 2025 को और उसके बाि रूपांतररत वाहनों के रूप म ें उपयोग के जलए पररवर्तगत दकए गए एल1, एल2 और एल5एम श्रेणी के वाहन, समय-समय पर यथासंिोजधत एआईएस-178 के अनुसार होंगे। 10. मूल जनयमों के जनयम 115 म,ें उप-जनयम (19) के खंड (i) में जवद्यमान िीर्गक के स्ट्थान पर जनम्नजलजखत िीर्गक प्रजतस्ट्थाजपत दकया िाएगा, अथागत्:- “1 अप्रैल 2020 और उसके बाि जनर्मगत िोपजहया वाहन मॉडल और 1 अक्टूबर 2025 के बाि जनर्मगत श्रेणी एल1-1 के वाहनों के जलए भारत स्ट्टेि-VI के उ‍सिगन मानक नीच े िी गई सारणी के अनुसार होंगे:- ख. सारणी 1 का िीर्गक, उप-जनयम (19) के खंड (i) के पश्चात, जवद्यमान िीर्गक के स्ट्थान पर जनम्नजलजखत िीर्गक प्रजतस्ट्थाजपत दकया िाएगा, अथागत्:- “पीआई और सीआई इंिन वाले िोपजहया वाहनों और पीआई इंिन वाले एल1-1 श्रेणी के वाहनों के जलए सीमा मान: बीएस-VI” ग. सारणी 1 म,ें उप-जनयम (19) के खंड (i) के पश्चात,् सारणी की प्रथम प्रजवजष्ट के ऊपर जनम्नजलजखत अंतःस्ट्थाजपत दकया िाएगा:- वाहन बीएस-VI क्षमता ≤ 50 सेमी 3और होना भाग 1 गमग की जस्ट्थजत में गजत वीअजधकतम ≤ 25 दकमी/घंटा 50% कम होगी। उप -वग ग2-0 जनम्नजलजखत जवजनिेिों को पूरा करने वाले वाहन वग ग 0-2 के अंतगगत आत ेहैं : इंिन क्षमता ≤ 50 सेमी 3 और 25 दकमी/घंटा < वीअजधकतम ≤ 45 दकमी/घंटा 11. उि जनयमों म,ें जनयम 117 के उप-जनयम (1) म,ें “अमान्य कैरेि” िब्िों के स्ट्थान पर “िोपजहया और जतपजहया रूपांतररत वाहन” िब्ि प्रजतस्ट्थाजपत दकए िाएंगे। 12.उि जनयमों म ें जनयम [125-थ] के पश्चात ् जनम्नजलजखत जनयम अंतःस्ट्थाजपत दकया िाएगा, अथागत्:- “[125-ि] रूपांतररत वाहन iii. “1 अक्टूबर 2025 को और उसके बाि जनर्मगत 3.5 टन िीवीडब्ल्यू स े नीच े एम1 और एन1 श्रेजणयों के रूपांतररत वाहन समय-समय पर यथासंिोजधत एआईएस-169:2021 के अनुरूप होंगे। बिते दक पूव ग प्रदक्रया या केंद्र सरकार या राज्य सरकार द्वारा िारी जवजभन्न परामिों के अनुसार पूवोि वाहन श्रेजणयों के हाथ या पैर स े जनयंत्रण म ें पररवतगन या वाहन अनुकूलन के जलए दिए गए मौिूिा अनुमोिन एआईएस-169:2021 के कायागन्वयन के बाि भी वैध रहेंगे। iv. 1 अक्टूबर 2025 को और उसके बाि जनर्मगत एल1, एल2 और एल5एम श्रेजणयों के रूपांतररत वाहन समय-समय पर यथासंिोजधत एआईएस-178 के अनुरूप होंगे। 13. उि जनयम म,ें जनयम [125-ि] के पश्चात ् जनम्नजलजखत नया जनयम [125-ध] अंतःस्ट्थाजपत दकया िाएगा, अथागत्: "[125-ध] 1 अक्टूबर 2025 को और उसके बाि, सभी "एल1-1 श्रेणी" के वाहन समय-समय पर यथासंिोजधत एआईएस 183:2023 म ें जनर्िगष्ट आवश्यकताओं के अनुरूप होंगे।" 13. उि जनयम म,ें प्रारूप 7 म,ें मिीन पठनीय क्षत्रे (केवल स्ट्माटग काडग का जवकल्प चुनने पर लागू) िीर्गक के अंतगगत, लाइसेंस जववरण के जलए क्रम स.ं 2 म,ें िब्ि “अमान्य कैरेि वाहन पंिीकरण संख्या”, “अमान्य कैरेि जद्वतीय वाहन[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 पंिीकरण संख्या, यदि कोई हो”, और “अमान्य गाड़ी तृतीय वाहन पंिीकरण संख्या, यदि कोई हो” को िब्िों के स्ट्थान पर “दिव्यांगता का प्रकार” प्रजतस्ट्थाजपत दकया िाएगा। 14. उि जनयमों म,ें प्रारूप 22 ङ म,ें - िब्ि, आंकड़ े और कोष्ठक, “[जनयम 47ख(2) िेख]ें ” के स्ट्थान पर, िब्ि, आंकड़ े और कोष्ठक, “[जनयम 47ख(2), 125ध िेख]ें ” प्रजतस्ट्थाजपत दकए िाएंगे। 15. उि जनयमों म,ें प्रारूप 22छ म,ें - िब्िों, आंकड़ो और कोष्ठकों, “[(जनयम 47ख (3), 112क (2), 126) िेख]ें ” के स्ट्थान पर, िब्ि, आंकड़े और कोष्ठक, “[(जनयम 47ख (3), 112क (2), 125ध, 126) िेख]ें ” प्रजतस्ट्थाजपत दकए िाएंगे। [िा. सं. आरटी-11036/32/2025 -एमवीएल] 416(E).— The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Gazette of India, are made available to the public; The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government. 3. Objections and suggestions to these draft rules, if any, may be sent to the Additional Secretary (MVL, Transport & Road Safety), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001 or on the email: comments-morth@gov.in; Draft Rules 1. Short title and commencement. — (1) these rules may be called as the Central Motor Vehicles (………. Amendment) Rules, 2025. (2) Save as otherwise provided in these rules, they shall come into force on the date of their final publication in the Official Gazette. 2. In the Central Motor Vehicle Rules, 1989 (herein after referred as the said rules), in rule 2, after clause (ig), the following clauses shall be inserted, namely: - (ih) “Category L1-1” means a moped with three wheels having: i. Engine capacity not exceeding 50 cc in case of thermic engines or Maximum net power not exceeding 4 kW if fitted with electric power train; and ii. Maximum design vehicle speed not exceeding 45km/h; and iii. Kerb weight not exceeding 270 kg (excluding mass of traction batteries); and iv. Equipped with a maximum of two seating positions, including the seating position for the driver (75 kg). (ii) “Category L1-1M” means a category L1-1 vehicle on account of its technical features intended to carry passengers; (ij) “Category L1-1N” means a category L-1-1 vehicle on account of its technical features intended to carry goods, as amended from time to time;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. In the said rules, in rule 2, in sub-rule (u), the following proviso shall be inserted after existing proviso, namely: - Provided that Tricycles, as defined in AIS-178, shall not be deemed to be a motor vehicle if all the conditions of Part C of AIS-178 are verified and authorized by a testing agency specified in rule 126. 4. In said rules, in rule 16, after sub-rule (6), the following sub-rule shall be inserted, namely: - “(7) In case of License issued to person with disability, for driving Adapted Vehicles of categories M1 below 3.5-ton GVW and N1, the type of disability shall be mentioned in Form 7. The type of disability defined in Form 7 shall be as per the following Table: Sr. No. Type of Physical Disability (Locomotor disability) Abbreviation for Disability (1) (2) (3) 1. For short stature person AVDR” Note: Person with short stature is as specified in Person with Disability Act 2016. 5. In the said rules, in rule 93, in sub-rule (1) (A), for clause (II) and Table under it, following clause (II) and Table shall be substituted, namely: - (II)Three wheeler Category L5 M/ L5 N, E-rickshaw/E-cart and Moped with three wheels TABLE Serial Category of Vehicle Width Length Height Number (Meters) (Meters) (Meters) (1) (2) (3) (4) (5) 1. In the said rules, in rule 96, in sub-rule (1) and in the proviso after sub-rule (1), for the words “Invalid carriage” the words “Adapted Vehicle” shall be substituted. 7. In the said rules, in rule 96 in sub-rule (1), before the first proviso, following provisos shall be inserted, namely: - “Provided that Adapted Vehicle of category M1 below 3.5 ton GVW and N1, shall be equipped with service brake which can be either foot or hand operated. The braking requirements for adapted vehicles of categories M1, N1 shall conform to AIS-169, as amended from time to time.” 8. On and after one year from date of publication of these rules in the Official Gazette, in the said rules, in rule 98, in sub-rule (3), after last proviso, following proviso shall be inserted, namely: - “Provided further that, steering effort requirements for adapted vehicles of categories M1 and N1 shall conform to AIS-169, as amended from time to time.” 9. In the said rules, in rule 112-A, after sub-rule 2 following sub-rule shall be inserted, namely: - “(3). Adapted Vehicles[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 Vehicles of categories M1 below 3.5-ton GVW and N1 altered on and after 1st October 2025, for use as an Adapted Vehicles shall be in accordance with AIS-169:2021, as amended from time to time. ii. Vehicles of categories L1, L2 and L5M altered on and after 1st October 2025, for use as an Adapted Vehicles shall be in accordance with AIS-178, as amended from time to time. 10. In rule 115 of the principal rules, A. Clause (i) of sub-rule (19), for the existing title following title shall be substituted namely:- “The Emission Standards for Bharat Stage-VI for two-wheelers vehicle models manufactured on and after 1st April 2020 and vehicles of category L1-1 manufactured after 1st October 2025 shall be as per Tables below:- B.
