(1) इन जनयमों का संजिि नाम केंद्रीय मोटर वाहन (बारहवााँ संिोधन) जनयम, 2026 ह।ै 6110 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) य े रािपत्र म ें इनके प्रकािन की तारीख को प्रवृि होंगे। 2. केंद्रीय मोटर वाहन जनयम, 1989 (इसके इसम ें इसके पश्चात उक्त जनयम कहा गया ह)ै के जनयम 93 के उप-जनयम (1) के खंड (क) म,ें छठे परंतुक के बाि, उप-खडं (vi) म ेंसारणी के नीचे, जनम्नजलजखत परंतुक अतं :स्ट्थाजपत दकया िाएगा, अथागत्:- “परंत ु यह और दक रटपर और डम्पर के मामल े म,ें जनयम 138ख के िसू रे परंतुक म ें दिए गए उपबंधों के अनुसार, लोड बॉडी को घेरने के जलए लगाई गई प्रणाली को मोटर वाहनों की कुल ऊंचाई मापने म ेंध्यान म ेंनहीं रखा िाएगा।“ 3. उक्त जनयमों म,ें जनयम 93 के उप-जनयम (1) के खडं (ख) म,ें उप-खडं (i) के स्ट्थान पर जनम्नजलजखत उप-खंड रखा िाएगा, अथागत:् - "(i) मोटर वाहनों की कुल ऊंचाई मापने म ें ररयर-व्यू जमरर या अप्रत्यि िजृ ि के जलए उपकरण, या गाडग रेल या दििा संकेतक रबर-रेल (रबर बीडडंग) जिसकी बॉडी के प्रत्येक तरफ अजधकतम मोटाई 20 जमलीमीटर हो या साइड फुट स्ट्टेप, या रटपर और डम्पर पर लोड बॉडी को घेरने के जलए जनयम 138ख के िसू रे परंतुक म ें दिए गए उपबंधों के अनुसार लगाई गई प्रणाली को ध्यान म ेंनहीं रखा िाएगा।" 4. उक्त जनयमों म,ें जनयम 138ख म,ें प्रथम परंतुक के बाि, जनम्नजलजखत परंतुक अतं :स्ट्थाजपत दकया िाएगा, अथागत:् - “परंतु यह और दक 1 अप्रलै , 2027 को या उसके बाि, सभी डम्पर और रटपरों के मामल े म,ें लोड बॉडी को ऊपर स ेढकन े के जलए जवद्युत, जवद्युत-यांजत्रक, ड्राउजलक या यांजत्रक रूप स े सचं ाजलत प्रणाली स े सुसजित दकया िाएगा, जिसस े वाहन के सड़क पर चलते समय लोड बॉडी पूरी तरह स े बंि रह।े ऊपर जवजनर्िगि प्रणाली लोड बॉडी की छत को ढकने के जलए दकसी भी उपयुक्त सामग्री का उपयोग कर सकती ह।ै इसके अजतररक्त, चालक के केजबन म ें एक ऑजडयो-जविुअल अलटग जसस्ट्टम प्रिान दकया िाएगा जिससे वाहन के चलन े के िौरान लोड बॉडी का कवर खुला या असुरजित होने पर चालक को चते ावनी िी िा सके।” [फा. स.ं आरटी-11028/02/2026-एमवीएल-भाग(1)] महमूि अहमि, अपर सजचव रटप्पण : मलू जनयम भारत के रािपत्र, असाधारण, भाग, खंड 3, उप-खडं (i) म ें सा.का.जन. 590(अ), तारीख 2 िून, 1989 को प्रकाजित दकए गए थ ेऔर अंजतम बार सा.का.जन. 542 (अ) तारीख 30 िून, 2026 द्वारा संिोजधत दकए गए थे। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 28th July, 2026 G.S.R. 712(E).— Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R 214 (E), dated the 20th March, 2026, published in the Gazette of India, Extraordinary, Part II, Section (3), Sub-section (i), dated the 27th March, 2026, inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public; And whereas, the copies of the said Gazette notification of the said draft rules were made available to the public on 27th March, 2026; And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government. Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:— 1. Short title and commencement. - (1) These rules may be called the Central Motor Vehicles ( Twelfth Amendment) Rules, 2026.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicle Rules, 1989 (hereinafter referred to as the said rules), in rule 93, in sub-rule (1), in clause (A), after the sixth proviso, below the table in sub-clause (VI), the following proviso shall be inserted, namely:— “Provided also that in case of tippers and dumpers, the system fitted to enclose the load body, as per the provisions given in the second proviso to rule 138B, shall not be taken into consideration in measuring the overall height of motor vehicles.”. 3. In the said rules, in rule 93 in sub-rule (1), in clause (B), for sub-clause (i), the following sub-clause shall be substituted, namely:— “(i) A rear-view mirror or device for indirect vision, or guard rail or a direction indicator rub-rail (rubber beading) having maximum thickness of 20 millimeter on each side of the body or side foot step, or the system fitted on tippers and dumpers to enclose the load body as per the provision given in second proviso to rule 138B, shall not be taken into consideration in measuring the overall height of motor vehicles.”. 4. In the said rules, in rule 138B, after the first proviso, the following proviso shall be inserted, namely:— “Provided further that on and after the 1st day of April, 2027, in case of all dumper and tippers, the load body shall be fitted with an electrically or electro-mechanical or hydraulic or mechanically operated system to cover the load body from top, to fully enclose the load body while the vehicle is plying on the road. The system specified above may use any suitable material for covering the roof of the load body. Additionally, an audio-visual alert system shall be provided in the driver’s cabin to warn the driver if the load body cover is open or unsecured during vehicle movement:". [F.
