(1)/5414 के माध्यम से दिल्ली रािपत्र, असाधारण, भाग IV, संख्या 232 [एनसीर्ीडी संख्या 162] म ेंप्रकाजित दकया गया था जिसमें आजधकाठरक रािपत्र में इसके प्रकािन की जतजथ से तीस दिनों के भीतर इससे प्रभाजित होने की संभािना िाल े सभी व्यजियों से आपजियां और सुझाि आमंजत्रत दकए गए थे| और िबदक, उि अिजध के भीतर कोई आपजि या सुझाि प्राप्त नहीं हुआ;

और िबदक, केंद्र सरकार न े गृह मंत्रालय के दिनांक 17 जसतंबर, 2026 के पत्र संख्या य-ू 11019/6/2026-यूर्ीएल 7577 DG/2026 (1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] के माध्यम से अपना पूिट अनुमोिन िे दिया ह,ै जिसमें जिक्षा मंत्रालय के जिद्यालय जिक्षा एिं साक्षरता जिभाग का दिनांक 17 जसतंबर, 2026 का कायाटलय ज्ञापन संख्या फा.सं. 5-11/2026-यूर्ी संलग्न ह;ै अब इसजलए, दिल्ली जिद्यालय जिक्षा अजधजनयम, 1973 (1973 का 18) की धारा 2 के खंड (क) के साथ पठित धारा 28 की उपधारा (1) द्वारा प्रिि िजियों का प्रयोग करते हुए तथा केंद्र सरकार के पूिट अनुमोिन से राष्ट्रीय रािधानी क्षेत्र दिल्ली के उपराज्यपाल, एतद्द्वारा दिल्ली जिद्यालय जिक्षा जनयमािली, 1973 म ेंआग ेसंिोधन करन ेहते ुजनम्नजलजखत जनयम बनाते ह,ैं अथाटत:् -

1. सजं क्षप्त िीर्कट एि ंप्रारंभ

(1) इन जनयमों को दिल्ली जिद्यालय जिक्षा (सिं ोधन) जनयमािली, 2026 कहा िाए।

(2) ये जनयम आजधकाठरक रािपत्र में अपने प्रकािन की जतजथ से लागू होंगे।

2. जनयम 44 म ेंसिं ोधन दिल्ली जिद्यालय जिक्षा जनयमािली, 1973 के जनयम 44 म ें उप-जनयम (3) के स्ट्थान पर जनम्नजलजखत उप-जनयम को प्रजतस्ट्थाजपत दकया िाएगा, अथाटत्:- “(3) प्रिासक, उप-जनयम (2) के अंतगटत उसे िी गई सूचना में जनर्िटष्ट जििरणों पर जिचार करने के पश्चात तथा ऐसी िााँच करन े के पश्चात, िैसा िह उजचत समझे, उस व्यजि या उन व्यजियों को सूजचत कर सकता ह ैजिनके द्वारा सूचना िी गई थी दक प्रस्ट्ताजित नए जिद्यालय का खोलना िनजहत म ेंहोगा या नहीं।” यह भी उपबंजधत ह ैदक इस उप-जनयम में जनजहत कोई भी बात संस्ट्थागत भूजम िो सरकार या नगर जनगम से ठरयायती िर पर या नीलामी के माध्यम से प्राप्त की गई हो और िो मौििू ा जनयमों और जिजनयमों के अधीन हो, को छोड़कर दकसी जनिी जिद्यालय पर लाग ूनहीं होगी, जिसे दकसी संस्ट्था या साििट जनक न्यास द्वारा जनिी स्ट्िाजमत्ि िाली िाजणजज्यक भूजम पर स्ट्थाजपत करन े का प्रस्ट्ताि हो। आग े यह भी उपबंजधत ह ै दक यदि कोई सोसायर्ी या सािटिजनक रस्ट्र् दकसी नए जनिी जिद्यालय की स्ट्थापना हते ु सरकार या नगर जनगम से ठरयायती िर पर या नीलामी के माध्यम से संस्ट्थागत भूजम खरीिना या प्राप्त करना चाहता है तो उसे ऐसी खरीि या आिंर्न स े पहल े प्रिासक से संबंजधत क्षेत्र म ें प्रस्ट्ताजित जिद्यालय की आि‍यकता के संबंध म ें अजनिायटता प्रमाण पत्र प्राप्त करना होगा। प्रिासक उप-जनयम (2) म ें जनर्िटष्ट जििरणों पर जिचार करने तथा ऐसी िांच करने के पश्चात िैसा िह उजचत समझे, ऐसा प्रमाण पत्र िारी कर सकता ह।ै

3. जनयम 50 म ेंसिं ोधन दिल्ली जिद्यालय जिक्षा जनयमािली, 1973 के जनयम 50 म ेंखडं (ii) का जिलोप कर दिया िाएगा। राष्ट्रीय रािधानी क्षेत्र दिल्ल ी के उपराज्यपाल के आिेि स े तथा उनके नाम पर, डॉ. दिलराि कौर, प्रमुख सजचि (जिक्षा)[PART IV DELHI GAZETTE : EXTRAORDINARY 3 DIRECTORATE OF EDUCATION

NOTIFICATION Delhi, the 30th September, 2026 F. No. DOE-A2/117/2026-PSB-EDUCATION DIRECTORATE-Part(1)/5983.— Whereas a draft of the Delhi School Education (Amendment) Rules, 2026 was published, as required by sub-section (1) of section 28 of the Delhi School Education Act, 1973 (18 of 1973), read with section 23 of the General Clauses Act, 1897 (10 of 1897), vide notification of the Directorate of Education F. No. DOE-A2/117/2026-PSB-EDUCATION DIRECTOR ATE- Part(1)/5414, dated the 10th August, 2026, in the Delhi Gazette, Extraordinary, Part IV, No. 232 [N.C.T.D. No. 162], inviting objections and suggestions from all persons likely to be affected thereby within thirty days from the date of its publication in the Official Gazette;

And whereas no objection or suggestion was received within the said period;

And whereas the Central Government has conveyed its previous approval vide Ministry of Home Affairs letter F. No. U-11019/6/2026-UTL, dated the 17th September, 2026, enclosing Office Memorandum F. No. 5-11/2026-UT, dated the 17th September, 2026, of the Department of School Education and Literacy, Ministry of Education;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 28 read with clause (a) of section 2 of the Delhi School Education Act, 1973 (18 of 1973), and with the previous approval of the Central Government, the Lieutenant Governor of the National Capital Territory of Delhi hereby makes the following rules further to amend the Delhi School Education Rules, 1973, namely:-

1. Short title and commencement

(1) These rules may be called the Delhi School Education (Amendment) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Amendment of rule 44 In the Delhi School Education Rules, 1973, in rule 44, for sub-rule (3), the following sub-rule shall be substituted, namely:- “(3) The Administrator may, after considering the particulars specified in the intimation given to him under sub-rule (2) and after making such inquiries as he may think fit, inform the person or persons by whom the

intimation was given whether or not opening of the proposed new school would be in the public interest:

Provided that nothing contained in this sub-rule shall apply to a private school proposed to be established by a society or public trust on privately owned commercial land, other than institutional land obtained from the Government or a Municipal Corporation at a concessional rate or through auction, subject to extant rules and

regulations:

Provided further that a society or public trust which intends to purchase or otherwise obtain institutional land from the Government or a Municipal Corporation at a concessional rate or through auction for establishing a new private school shall, before such purchase or allotment, obtain from the Administrator an Essentiality Certificate regarding the need for the proposed school in the concerned locality. The Administrator may, after considering the particulars specified in sub-rule (2) and making such inquiries as he may think fit, issue such certificate.”

3. Amendment of rule 50 In the Delhi School Education Rules, 1973, in rule 50, clause (ii) shall be omitted.
