.आ. 1507(अ).—केन्द्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ
परित पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) की धारा 3 की ईपधारा (1), ईपधारा (2) के खंड (v) और
खंड (xiv) तथा ईपधारा (3) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, िलू पानेश्वर वन्द्यिीव ऄभयारण्य, गुिरात के
असपास पाररजस्ट्तजथकी संवेदी िोन घोजित करने के जलए भारत के रािपत्र, ऄसाधारण, भाग II, खंड 3, ईपखंड (ii) म ें
सखं यांक का.अ. 1653(ऄ), तारीख 5 मइ, 2016 द्वारा एक ऄजधसूचना िारी की गइ थी;
और केंरीय सरकार की यह राय ह ैदक ईि ऄजधसूचना का संिोधन करना लोकजहत में अवश्यक और समीचीन ह;ै
और पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 का ईप-जनयम (4) यह ईपबंध करता ह ै दक िब भी केंरीय
सरकार को यह प्रतीत होता ह ैदक ऐसा करना लोकजहत में है, तो आसके जलए पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5
के ईप-जनयम (3) के खडं (क) के ऄधीन नोरिस की ऄपेक्षा से ऄजभमुजि दी िा सकती ह;ै
और केन्द्रीय सरकार की यह राय ह ै दक ऄजधसूचना संखयांक का.अ. 1653(ऄ), तारीख 5 मइ, 2016 में संिोधन
करने के जलए पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के खडं (क) के ऄधीन नोरिस की ऄपेक्षा स े
ऄजभमुजि देना लोकजहत म ेंह;ै
ऄतः, ऄब, केन्द्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (4) के साथ परित
पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) की धारा 3 की ईपधारा (1), ईपधारा (2) के खंड (v) और
खंड (xiv) तथा ईपधारा (3) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, भारत सरकार के तत्कालीन पयाावरण और वन

मंत्रालय की भारत के रािपत्र, ऄसाधारण, भाग II, खंड 3, ईपखंड (ii) में संखयांक का.अ. 1653(ऄ), तारीख 5 मइ,
2016 को प्रकाजित ऄजधसूचना, म ेंजनम्नजलजखत संिोधन करती ह,ै ऄथाात:् -
ईि ऄजधसूचना म,ें पैरा 5 के स्ट्थान पर, जनम्नजलजखत पैरा रखे िाएंगे, ऄथाात:् -
“5. जनगरानी सजमजत. – (1) केंरीय सरकार एक जनगरानी सजमजत का गिन करेगी िो जनम्नजलजखत व्यजियों स े
जमलकर बनगे ी, ऄथाात्: -
(i) क लेक्िर, जिला नमादा ऄध्यक्ष, पदेन;
(ii) क्ष ेत्र के संसद सदस्ट्य* सदस्ट् य, पदेन;
(iii) स ंबंजधत जिला पंचायत के ऄध्यक्ष सदस्ट् य, पदेन;
(iv) ग ुिरात सरकार के अददवासी जवकास जवभाग के प्रजतजनजध सदस्ट् य, पदेन;
(v) क्ष ेत्र के वररष्ठ नगर जनयोिक सदस्ट् य, पदेन;
(vi) प याावरण या वन्द्य िीव (जवरासत संरक्षण सजहत) के क्षेत्र में काम करने वाल े सदस्ट् य;
एक गैर-सरकारी संगिन का एक प्रजतजनजध, जिसे प्रत्येक तीन विा के जलए
गुिरात सरकार द्वारा नामजनर्ददष्ट दकया िाएगा।
(vii) प्र जतजष्ठत सस्ट्ं थान या जवश्वजवद्यालय से पाररजस्ट्थजतकी और पयाावरण के क्षेत्र म ें सदस्ट् य;
एक जविेिज्ञ जिसे प्रत्येक तीन विा के जलए गुिरात सरकार द्वारा नामजनर्ददष्ट
दकया िाएगा।
(viii) ग ुिरात सरकार के वन एव ंपयाावरण जवभाग का एक प्रजतजनजध सदस्ट् य, पदेन;
(ix) क्ष ेत्रीय ऄजधकारी, राज्य प्रदिू ण जनयंत्रण बोडा, जिला नमदा ा सदस्ट् य, पदेन;
(x) ई प वन संरक्षक, (िूलपनेश्वर वन्द्यिीव ऄभयारण्य के प्रभारी), नमादा जिला सदस्ट् य सजचव, पदने ।
*गुिरात राज्य सरकार द्वारा ऄन्द्य तथ्यों के साथ-साथ लोक सभा ऄध्यक्ष की ऄनुमजत सजहत प्रासंजगक ऄनुमोदन
प्राप्त करन े के ऄधीन
(2) जनगरानी सजमजत, स्ट्थल जवजिष्ि वास्ट्तजवक पररजस्ट्थजतयों के अधार पर ईन दक्रयाकलापों की िा च करेगी िब दक
भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की तारीख 14 जसतम्बर, 2006 की ऄजध सूचना सं.
का.अ. 1533 (ऄ) की ऄनुसूची में िाजमल ह ैं और पाररजस्ट्थजतकी संवेदी िोन के ऄधीन अती हों, ईसके पैरा 4 के
ऄधीन दी गयी सारणी में यथा जवजनर्ददष् ि जनजि्ध दक्रयाकलापों को ोो़ककर और ईक्त ऄजधसूचना के ईपबंधों के
ऄधीन पयाावरणीय ऄनापजत्त के जलए भारत सरकार के पयाावरण, वन एवं िलवायु पररवतान मंत्रालय या
रािकीय पयाावरण प्रभाव अकलन प्राजधकरण के पास भेि ेगय ेह।ैं
(3) ऐसे दक्रयाकलापों, िो ईप-पैरा (2) में जनर्ददष्ट ऄजधसूचना की ऄनुसूची में िाजमल नहीं ह ै और पाररजस्ट्थजतकी
संवदे ी िोन के भीतर अते ह,ैं आसके पैरा 4 की सारणी में जनजि्ध दक्रयाकलापों को ोो़ककर, की िा च जनगरानी
सजमजत द्वारा स्ट् थल जवजिष्ि वास्ट् तजवक पररजस्ट्थजतयों के अधार पर की िायेगी और आन्द् हें जवजनयामक प्राजधकरणों
के पास भेिा िाएगा।
(4) जनगरानी सजमजत के सदस्ट् य सजचव या संबंजधत कलेक्ि र या सबं ंजधत ईप वन सरं क्षक आस ऄजधसूचना के ईपबंधों
का ईल्ल ंघन करन े वाले दकसी भी यजि के जवरु्ध पयाावरण (संरक्षण) ऄजधजनयम, 1986 की धारा 19 के ऄधीन
जिकायत फाआल करन े के जलए सक्षम होंगे।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : ऄसाधारण 3
(5) जनगरानी सजमजत मामल-े दर-मामले के अधार पर अवश् यकतां के ऄनुसार ऄपन े जवचार-जवमिा म ें सहायता के
जलए संबंजधत जवभाग के प्रजतजनजध या जविेिज्ञ, ईद्योग संघों के प्रजतजनजध या संबंजधत जहतधारकों को अमंजत्रत
कर सकती ह।ै
(6) जनगरानी सजमजत प्रत् येक विा के 31 माचा तक की ऄवजध की ऄपनी गजतजवजधयों की वाषिकिक कारावाइ ररपोिा ईस
विा के 30 िनू तक राज्य के मुखय वन्द् यिीव वाडान को ईपाबंध-III में जनर्ददष्ि प्रो-फामाा में प्रस्ट्त तु करेगी।
(7) केंरीय सरकार ऄपने कायों के प्रभावी जनवाहन के जलए जनगरानी सजमजत को जलजखत रूप म ें ऐसे जनदेि दे सकती
ह,ै िैसा वह ईजचत समझे”।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE
NOTIFICATION
New Delhi, the 28th March, 2025
S.O. 1507(E).— WHEREAS the Central Government, in exercise of the powers conferred by sub-section
(1), clauses (v) and (xiv) of sub-section (2), and sub-section (3) of section 3 of the Environment (Protection) Act, 1986
(29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, issued a notification to
declare an Eco-Sensitive Zone around Shoolpaneshwar Wildlife Sanctuary, Gujarat in the Gazette of India,
Extraordinary, Part-II, Section 3, Sub-section (ii), vide number S.O. 1653(E), dated the 5th May, 2016;
AND WHEREAS the Central Government is of the opinion that it is necessary and expedient in the public
interest to amend the said notification;
AND WHEREAS sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986 provides that whenever
it appears to the Central Government that it is in the public interest to do so, it may dispense with the requirement of
notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986;
AND WHEREAS the Central Government is of the opinion that it is in the public interest to dispense with
the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 for
amending the notification number S.O. 1653(E), dated the 5th May, 2016;
Now, THEREFORE, in exercise of the powers conferred by sub-section (1), clauses (v) and (xiv) of sub-
section (2) and sub-section(3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule
(4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following
amendments in the notification of the Government of India, Ministry of Environment, Forest and Climate Change,
published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide number S.O. 1653(E), dated
the 5th May, 2016, namely:-
In the said notification, for paragraph 5, the following paragraphs shall be substituted, namely: -
“5. Monitoring Committee- The Central Government hereby constitute a monitoring Committee consisting of
the following persons, namely: —
(i) C ollector, Narmada District Chairman, ex-officio;
(ii) M ember of Parliament of the area* Member, ex-officio;
(iii) P resident of Concerned Zila Panchayat Member, ex-officio;
(iv) R epresentative of Tribal Development Department, Government of Member, ex-officio;
Gujarat
(v) S enior Town Planner of the area Member, ex-officio;
(vi) O ne representative of a Non-Governmental Organisation working in the Member;
field of Environment or Wildlife (including heritage conservation) to be4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
nominated by the Government of Gujarat from time to time every three
years
(vii) A n expert in the area of ecology and environment from reputed institution Member;
or University to be nominated by the Government of Gujarat from time to
time every three years.
(viii) A representative of the Department of Forest and Environment, Member, ex-officio;
Government of Gujarat
(ix) R egional Officer, State Pollution Control Board, Narmada District Member, ex-officio;
(x) D eputy Conservator of Forests, (incharge of Shoolpaneshwar Wildlife Member Secretary,
Sanctuary), Narmada District ex- officio.
*Subject to the State Government of Gujarat obtaining relevant approvals inter alia including permission from
the Speaker of Lok Sabha
(2) The Monitoring Committee shall, based on the actual site-specific conditions, scrutinise the activities covered in
the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests,
vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for
the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central
Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact
Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said
notification.
(3) The activities not covered in the Schedule to the notification referred to in sub-paragraph (2) and falling in the
Eco-sensitive Zone, except for the prohibited activities specified in the Table under paragraph 4 thereof, shall be
scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the
concerned regulatory authorities.
(4) The Member-Secretary of the Monitoring Committee or the Collector or the Deputy Conservator of Forests shall
be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person
who contravenes the provisions of this notification.
(5) The Monitoring Committee may invite representative or expert from the Department concerned, representative
from industry associations or stakeholders to assist in its deliberations depending on the requirements on case to
case basis.
(6) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to
the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in proforma
specified in Annexure-III.
(7) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for
effective discharge of its functions.”.
