और केंरीय सरकार की यह राय ह ैदक ईि ऄजधसूचना का संिोधन करना लोकजहत म ेंअवश्यक और समीचीन ह;ै और पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 का ईपजनयम (4) यह ईपबंध करता ह ै दक िब भी केंरीय सरकार को यह प्रतीत होता ह ै दक ऐसा करना लोकजहत म ें ह,ै तो आसके जलए पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के खंड (क) के ऄधीन नोरटस की ऄपेक्षा से ऄजभमुजि दी िा सकेगी; और केन्द्रीय सरकार की यह राय ह ै दक ऄजधसूचना संखयांक का.अ. 2996(ऄ) द्वारा, तारीख 11 जसतम्बर, 2017 में संिोधन करन े के जलए पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के खंड (क) के ऄधीन नोरटस की ऄपेक्षा से ऄजभमुजि दने ा लोकजहत में ह;ै 2321 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ऄतः, ऄब, केन्द्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (4) के साथ परित पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) की धारा 3 की ईपधारा (1) और ईपधारा (2) के खंड (v) और खंड (xiv) तथा ईपधारा (3) द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, भारत सरकार के पयाावरण, वन और िलवायु पररवतना मंत्रालय की भारत के रािपत्र, ऄसाधारण, भाग II, खंड 3, ईपखंड (ii) म ें संखयांक का.अ. 2996(ऄ) द्वारा, तारीख 11 जसतम्बर, 2017 द्वारा प्रकाजित ऄजधसूचना में जनम्नजलजखत संिोधन करती ह,ै ऄथाात:् - ईि ऄजधसूचना म,ें पैरा 5 और पैरा 6 के स्ट्थान पर, जनम्नजलजखत पैरा रखे िाएगं ,े ऄथाात:् - “5. मानीटरी सजमजत. – केंरीय सरकार एक मानीटरी सजमजत का गिन करेगी, िो जनम्नजलजखत व्यजियों से जमलकर बनेगी, ऄथाात्: - (i) मुखय वन्द्यिीव वाडान, वन और वन्द्यिीव जवभाग, ददल्ली, राष्ट्रीय रािधानी क्षेत्र ददल्ली - ऄध्यक्ष, पदने ; सरकार (ii) राष्ट्रीय रािधानी क्षेत्र ददल्ली सरकार द्वारा समय-समय पर प्रत्येक तीन वि ामें नामजनर्ददष्ट - सदस्ट् य; दकया िाने वाला पाररजस्ट्थजतकी और पयाावरण के क्षेत्र में एक जविेिज्ञ (iii) गैर-सरकारी संगिन (जवरासत संरक्षण सजहत पयाावरण के क्षेत्र में काम करने वाले) का एक - सदस्ट् य; प्रजतजनजध, जिसे राष्ट्रीय रािधानी क्षेत्र ददल्ली सरकार द्वारा प्रत्येक तीन वि ामें समय-समय पर नामजनर्ददष्ट दकया िाएगा (iv) ददल्ली प्रदिू ण जनयंत्रण सजमजत का प्रजतजनजध - सदस्ट् य, पदने ; (v) सदस्ट्य राज्य िैव जवजवधता बोडा - सदस्ट् य, पदने ; (vi) ईप वन संरक्षक (दजक्षण), वन और वन्द्यिीव जवभाग, राष्ट्रीय रािधानी क्षेत्र ददल्ली सरकार - सदस्ट् य सजचव, पदने ।” 6. जनगरानी सजमजत के काय.ा- (1) ईन दियाकलापों की, िो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की ऄजध सूचना सखं यांक का.अ. 1533 (ऄ), तारीख 14 जसतम्बर, 2006 की ऄनुसूची में सजम्मजलत ह,ैं और िो पाररजस्ट्थजतकी संवेदी िोन म ें अत े ह,ैं जसवाय आसके पैरा 4 के ऄधीन सारणी में यथाजवजनर्ददष् ट प्रजतजिद्ध दियाकलापों के मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की िाएगी और ईक्त ऄजधसूचना के ईपबंधों के ऄधीन पूवा पयाावरण ऄनापजत्त के जलए केन्द्रीय सरकार के पयाावरण, वन एव ं िलवायु पररवतान मंत्रालय या यथाजस्ट्थजत, राज्य पयाावरण समाघात जनधाारण प्राजधकारी को जनर्ददष्ट दकया िाएगा। (2) ईन दियाकलापों को, िो ईपपैरा (1) में जनर्ददष्ट ऄजधसूचना की ऄनुसूची में सजम्मजलत नहीं ह ै और पाररजस्ट्थजतकी संवेदी िोन म ें अत े ह,ैं आसके पैरा 4 के ऄधीन सारणी में यथाजवजनर्ददष् ट प्रजतजिद्ध दियाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर संवीक्षा की िाएगी और ईस े संबंद्ध जवजनयामक प्राजधकरणों को जनर्ददष्ट दकया िाएगा। (3) मानीटरी सजमजत के सदस्ट् य सजचव या कलेक्टर या ईप वन संरक्षक आस ऄजधसूचना के ईपबंधों का ईल् लंघन करन े वाल े दकसी भी व् यजि के जवरूद्ध पयाावरण (संरक्षण) ऄजधजनयम, 1986 की धारा 19 के ऄधीन जिकायत फाआल करने के जलए सक्षम होंगे। (4) मानीटरी सजमजत मामल-े दर-मामले के अधार पर ऄपक्षे ाओं पर जनभार रहते हुए जवभाग के प्रजतजनजध या जविेिज्ञ, ओद्धोजगक संगमो या पणधाररयों के प्रजतजनजध को ऄपने जवचार-जवमिा में सहायता के जलए अमंजत्रत कर सकेगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : ऄसाधारण 3 (5) मानीटरी सजमजत प्रत् यके विा के 31 माचा तक की ऄवजध के ऄपन े दियाकलापों की वार्षिक कारावाइ ररपोटा ईस विा के 30 िून तक राज्य के मखु य वन्द् यिीव वाडान को ईपाबंध-lV में जवजनर्ददष्ट जनदिान पत्र में प्रस्ट् ततु करेगी। (6) केंरीय सरकार ऄपने कायों के प्रभावी जनवाहन के जलए मानीटरी सजमजत को जलजखत रूप में ऐस े जनदेि द े सकेगी, िैसा वह ईजचत समझे।” [फा. सं. 25/196/2015-इएसिेड-अरइ] डॉ. स.ु केरकेट्टा वैज्ञाजनक ‘’िी’’ रटप्प ण.-मूल ऄजधसूचना भारत के रािपत्र, ऄसाधारण, भाग ।।, खंड 3, ईप खंड (ii) में ऄजध सूचना संख या का.अ. 2996(ऄ) तारीख 11 जसतम्बर, 2017 द्वारा प्रकाजित की गइ थी। MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 3rd April, 2025 S.O. 1575(E).—WHEREAS the Central Government, in exercise of the powers conferred by sub-section (1) clauses (v) and (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, issued a notification to declare an Eco Sensitive Zone around Asola bhatti Wildlife Sanctuary, Delhi in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide S.O. 2996(E), dated the 11th September, 2017; AND WHEREAS the Central Government is of the opinion that it is necessary and expedient in the public interest to amend the said notification; AND WHEREAS sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986 provides that whenever it appears to the Central Government that it is in the public interest to do so, it may dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986; AND WHEREAS the Central Government is of the opinion that it is in the public interest to dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 for amending the notification number S.O. 2996(E), dated the 11th September, 2017; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1), clauses (v) and (xiv) of sub- section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendments in the notification of the Government of India in the Ministry of Environment and Forest and Climate Change, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide S.O. 2996(E), dated the 11th September, 2017, namely: - In the said notification, for paragraphs 5 and 6, the following paragraphs shall be substituted, namely: - ―5. Monitoring Committee. - The Central Government hereby constitutes a Monitoring Committee, consisting of the following persons, namely :- (i) Chief Wildlife Warden, Department of forests and Wildlife, Delhi, Government of National Capital Territory of Delhi– Chairman, ex officio; (ii) An expert in the area of ecology and environment to be nominated by the Government of National Capital Territory of Delhi from time to time every three years– Member; (iii) One representatives of Non-Governmental Organisation (Working in the field of environment including heritage Conservation) to be nominated by the Government of National Capital Territory of Delhi from time to time every three years – Member; (iv) Representative of Delhi Pollution Control Committee– Member, ex officio; (v) Member State Biodiversity Board– Member, ex officio;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (vi) Deputy Conservator of Forests (South), Department of Forests and Wildlife, Government of National Capital Territory of Delhi – Member Secretary, ex officio. 6. Functions of Monitoring Committee.–(1)The Monitoring Committee shall, based on the actual site-specific conditions, scrutinise the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification. (2) The activities not covered in the Schedule to the notification referred to in sub-paragraph (1) and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (3) The Member-Secretary of the Monitoring Committee or the Collector or the Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986, against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite a representative or expert from the Department, a representative from the industry associations or the stakeholders to assist the committee in its deliberations depending on the requirements on case to case basis. (5) The Monitoring Committee shall submit the action taken report annually of its activities for the period up to the 31st March of every year to the Chief Wildlife Warden of the State by the 30th June of that year in pro-forma specified in Annexure-IV. (6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions.‖. [F. No. 25/196/2015-ESZ/RE] Dr. S.
