और केंरीय सरकार की यह राय ह ैदक ईि ऄजधसूचना का संिोधन करना लोकजहत में अवश्यक और समीचीन है; और पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 का ईप-जनयम (4) यह ईपबंध करता ह ै दक जब भी केंरीय सरकार को यह प्रतीत होता ह ै दक ऐसा करना लोकजहत में है, तो आसके जलए पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईप-जनयम (3) के खंड (क) के ऄधीन नोरिस की ऄपेक्षा से ऄजभमुजि दी जा सकती ह;ै और केन्द्रीय सरकार की यह राय ह ै दक ऄजधसूचना संखयांक का.अ. 3028(ऄ), तारीख 13 जसतम्बर, 2017 का संिोधन करन े के जलए पयाावरण (सरं क्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के खंड (क) के ऄधीन नोरिस की ऄपेक्षा से ऄजभमुजि दने ा लोकजहत में ह;ै 2224 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ऄतः, ऄब, केन्द्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (4) के साथ परित पयाावरण (सरं क्षण) ऄजधजनयम, 1986 (1986 का 29) की धारा 3 की ईपधारा (1) और ईपधारा (2) के खंड (v) और खंड (xiv) और ईपधारा (3) द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की भारत के राजपत्र, ऄसाधारण, भाग II, खंड 3, ईपखंड (ii) में संखयांक का.अ. 3028(ऄ), तारीख 13 जसतम्बर, 2017 द्वारा प्रकाजित ऄजधसूचना, जनम्नजलजखत संिोधन करती ह,ै ऄथाता ्:- ईि ऄजधसूचना म,ें पैरा 5 और 6 के स्ट्थान, जनम्नजलजखत परै ा रखें जाएंग,े ऄथाात:् - “5. मानीिरी सजमजत.– केंरीय सरकार एक मानीिरी सजमजत का गिन करेगी जो जनम्नजलजखत व्यजियों से जमलकर बनेगी, ऄथाात्: - (i) संभागीय अयुि संभाग, रीवा ऄध्यक्ष, पदेन; (ii) जजला कलेक्िर ससगरौली जजला सदस्ट् य, पदेन; (iii) ऄधीक्षण आंजीजनयर लोक जनमााण जवभाग, रीवा सदस्ट् य, पदेन; (iv) ऄधीक्षण आंजीजनयर लोक स्ट्वास्ट््य जवभाग, रीवा सदस्ट् य, पदेन; (v) मुखय कायापालक ऄजधकारी, जजला पंचायत ससगरौली सदस्ट् य, पदेन; (vi) नगर एवं ग्राम जनयोजन जवभाग का प्रजतजनजध; सदस्ट् य, पदेन; (vii) प्रदिू ण जनयंत्रण बोड ा ससगरौली के प्रजतजनजध सदस्ट् य, पदेन; (viii) ससगरौली के होिल और लॉज एसोजसएिन का एक प्रजतजनजध सदस्ट् य, पदेन; (ix) सदस्ट्य, राज्य जैव जवजवधता बोड ा सदस्ट् य, पदेन; (x) पयाावरण के क्षेत्र म ेंकाम करन ेवाले गरै सरकारी संगिन का एक प्रजतजनजध, सदस्ट् य; जजसे मध्य प्रदिे सरकार द्वारा समय-समय पर प्रत्येक तीन वि ा में नामांदकत दकया जाएगा (xi) राज्य में जवश्वजवद्यालय के एक प्रजतजित संस्ट्थान से पाररजस्ट्थजतकी और सदस्ट् य; पयाावरण के क्षेत्र म ेंएक जविेिज्ञ, जजसे मध्य प्रदेि सरकार द्वारा समय-समय पर प्रत्येक तीन वि ा में नामांदकत दकया जाएगा (xii) फील्ड डायरेक्िर संजय िाआगर ररजवा जजला, ससधी सदस्ट् य सजचव, पदने । 6. मानीिरी सजमजत के काय.ा- (1) मानीिरी सजमजत, स्ट्थल जवजनर्ददष्ट वास्ट्तजवक पररजस्ट्थजतयों के अधार पर परै ाग्राफ 4 के ऄधीन दी गयी सारणी में जवजनर्ददष् ि प्रजतजिद्ध दक्रयाकलापों के जसवाय ईन दक्रयाकलापों की संवीक्षा करेगी जो भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की तारीख 14 जसतम्बर, 2006 की ऄजध सूचना सं. का.अ. 1533 (ऄ) की ऄनुसूची में समाजवष्ट ह ैं और पाररजस्ट्थजतकी सवं ेदी जोन के ऄंतगात अती हों, और ईक्त ऄजधसूचना के ईपबंधों के ऄधीन पयाावरणीय जक्लयरेंस के जलए भारत सरकार के पयाावरण, वन एवं जलवायु पररवतान मंत्रालय या राज्य पयाावरण समाघात जनधाारण प्राजधकरण को जवजनर्ददष्ट करेगी।[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3 (2) आसके पैरा 4 की सारणी म ें जवजनर्ददष्ट प्रजतजिद्ध दक्रयाकलापों के जसवाय, ऐस े दक्रयाकलापों, जो ईप-पैरा (1) म ें जनर्ददष्ट ऄजधसूचना की ऄनुसूची में समाजवष्ट नहीं ह ैऔर पाररजस्ट्थजतकी संवेदी जोन के भीतर अत े हैं, की छानबीन मानीिरी सजमजत द्वारा स्ट् थल जवजनर्ददष्ट वास्ट् तजवक पररजस्ट्थजतयों के अधार पर की जायगे ी और आन्द् हें सम्बद्ध जवजनयामक प्राजधकरणों को जनर्ददष्ट दकया जाएगा। (3) मानीिरी सजमजत के सदस्ट् य सजचव या कलेक्ि र या ईप वन सरं क्षक आस ऄजधसूचना के ईपबधं ों का ईल् लघं न करन े वाले दकसी भी व् यजि के जवरुद्ध पयाावरण (संरक्षण) ऄजधजनयम, 1986 की धारा 19 के ऄधीन जिकायत दजा करन े के जलए सक्षम होंगे। (4) मानीिरी सजमजत मामले-दर-मामले के अधार पर ऄपेक्षाओं के ऄनुसार ऄपन े जवचार-जवमिा म ें सजमजत की सहायता के जलए, ईद्योग संघों या जहतधारकों को अमंजत्रत कर सकती ह।ै (5) मानीिरी सजमजत प्रत् येक विा के 31 माचा तक की ऄवजध के ऄपने दक्रयाकलापों की वार्षिक कारावाइ ररपोिा ईस वि ा के 30 जून तक राज्य के मुखय वन् यजीव वाडान को ईपाबंध-।।। में जनर्ददष्ि रूपजवधान में प्रस्ट् ततु करेगी। (6) केंरीय सरकार ऄपने कायों के प्रभावी जनवाहन के जलए मानीिरी सजमजत को जलजखत रूप में ऐसे जनदेि दे सकती ह,ै जैसा वह ईजचत समझे।” [फा. स.ं 25/83/2015-इएसजेड-अरइ] डॉ. स.ु केरकेि्िा, वैज्ञाजनक ‘’जी’’ रिप्प णी.-मुखय ऄजधसूचना भारत के राजपत्र, ऄसाधारण, भाग II, खंड 3, ईप खंड (ii) में जवस्ट्तृत का.अ. 3028(ऄ), तारीख 13 जसतम्बर, 2017 द्वारा प्रकाजित की गइ थी। MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 28th March, 2025 S.O. 1515(E).—WHEREAS, the Central Government, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, issued a notification to declare an Eco-Sensitive Zone around Bagdara Wildlife Sanctuary, Madhya Pradesh in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide number S.O.3028(E), dated the 13th September, 2017; AND WHEREAS, the Central Government is of the opinion that it is necessary and expedient in the public interest to amend the said notification; AND WHEREAS, sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986 provides that whenever it appears to the Central Government that it is in the public interest to do so, it may dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986; AND WHEREAS, the Central Government is of the opinion that it is in the public interest to dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 for amending the notification number S.O. 3028(E), dated the 13th September, 2017; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub- section (2) and sub-section(3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendments in the notification of the Government of India, Ministry of Environment, Forest and Climate Change, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide number S.O. 3028(E), dated the 13th September, 2017, namely:- In the said notification, for paragraph 5 and 6 the following paragraphs shall be substituted, namely: - ―5. Monitoring Committee. - (1) The Central Government hereby constitutes a monitoring committee of the following persons, namely: - (i) Divisional Commissioner Division, Rewa – Chairman, ex officio; (ii) District Collector Singrauli District –Member, ex officio; (iii) Superintending Engineer PWD, Rewa –Member, ex officio;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (iv) Superintending Engineer Public Health Department, Rewa – Member; ex officio; (v) Chief Executive Officer, District Panchayat Singrauli – Member, ex officio; (vi) Representative of the Town and Country Planning Department – Member, ex officio; (vii) Representative of the Pollution Control Board Singrauli – Member, ex officio; (viii) A representative of the Association of Hotels and Lodges of – Member, ex officio; Singrauli (ix) Member, State Biodiversity Board – Member, ex officio; (x) One representative of Non Governmental Organization working in –Member; the field of environment to be nominated by the Government of Madhya Pradesh from time to time every three years (xi) One expert in area of ecology and environment from a reputed – Member; institution of University in the State to be nominated by the Government of Madhya Pradesh from time to time every three years (xii) Field Director Sanjay Tiger Reserve District, Sindhi – Member Secretary, ex officio. 6. Functions of Monitoring Committee.–(1)The Monitoring Committee shall, based on the actual site-specific conditions, scrutinise the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification. (2) The activities not covered in the Schedule to the notification referred to in sub-paragraph (1) and falling in the Eco-sensitive Zone, except for the prohibited activities specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the regulatory authorities concerned. (3) The Member-Secretary of the Monitoring Committee or the Collector or the Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986, against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite a representative or expert from the Department, a representative from the industry associations or stakeholders to assist the Committee in its deliberations depending on the requirements on a case to case basis. (5) The Monitoring Committee shall submit the action taken report of its activities annually for the period up to the 31st March of every year to the Chief Wildlife Warden by the 30th June of that year in pro forma specified in Annexure-Ill. (6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions. ‖. [F. No. 25/83/2015-ESZ/RE] Dr. S.
