और, केंद्रीय सरकार की यह राय ह ेदक उि अजधसूचना का संिोधन करना लोकजहत में आवश्यक और समीचीन ह;ै और, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 का उपजनयम (4) यह उपबंध करता ह ै दक िब भी केंद्रीय सरकार को यह प्रतीत होता ह ै दक ऐसा करना लोकजहत में है, तो वह पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के उपजनयम (3) के खडं (क) के अधीन सूचना की अपक्षे ा से अजभमुजि िे सकती ह;ै और, केंद्रीय सरकार की यह राय ह ै दक अजधसूचना संख्यांक का.आ. 2633(अ), तारीख 5 अगस्ट्त, 2020 म ें संिोधन करन े के जलए पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के उपजनयम (3) के खडं (क) के अधीन सूचना की 6488 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अपेक्षा से अजभमुजि िने ा लोकजहत में ह;ै अत:, अब, केंद्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के उपजनयम (4) के साथ पठित पयाावरण (सरं क्षण) अजधजनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) और खंड (xiv) और धारा 3 की उपधारा (3) द्वारा प्रित्त िजियों का प्रयोग करते हुए, भारत के रािपत्र, असाधारण, भाग ii, खंड 3, उपखडं (ii) में, संख्या का.आ. 2633(अ), तारीख 5 अगस्ट्त, 2020 द्वारा प्रकाजित, भारत सरकार के पयाावरण, वन और िलवायु पठरवतान मंत्रालय की अजधसूचना में जनम्नजलजखत संिोधन करती है, अथाात ् :-- उि अजधसूचना म,ें पैरा 5 और पैरा 6 के स्ट्थान पर, क्रमिः जनम्नजलजखत पैरे रख े िाएगं ,े अथाता ् :-- “5. मानीटरी सजमजत--(1) केंद्रीय सरकार, जनम्नजलजखत व्यजियों स े जमलकर बनी एक मानीटरी सजमजत का गिन करती ह,ै अथाात् :-- (i) जिला कलेक्टर, पुण े अध्यक्ष, पिेन; (ii) कलेक्टर थान/े रायगढ़ का प्रजतजनजध सिस्ट् य, पिेन; (iii) उप वन संरक्षक (वन्यिीव), पणु े या उसका प्रजतजनजध। सिस्ट् य, पिेन; (iv) उप वन संरक्षक, रायगढ़/थाने या उनका प्रजतजनजध। सिस्ट् य, पिेन; (v) नगर जनयोिन कायाालय थाने/रायगढ़/पणु े का प्रजतजनजध सिस्ट् य, पिेन; (vi) पयाावरण जवभाग, महाराष्ट्र सरकार का प्रजतजनजध। सिस्ट् य, पिेन; (vii) प्रजतजित जवश्वजवद्यालय/संस्ट्थान स े महाराष्ट्र सरकार द्वारा समय- सिस्ट् य; समय पर प्रत्येक तीन वि ा में नामजनर्िाष्ट दकया िान े वाला पाठरजस्ट्थजतकी और पयाावरण के क्षेत्र म ेंएक जविेिज्ञ (viii) महाराष्ट्र राज्य सरकार द्वारा समय-समय पर प्रत्येक तीन वि ामें सिस्ट् य; नामजनर्िाष्ट दकया िाने वाला, वन्यिीव संरक्षक के क्षेत्र में काया करने वाल ेगैर-सरकारी संगिन का एक प्रजतजनजध (ix) उप वन संरक्षक, िुन्नार। सिस्ट् य सजचव, पिने । 6. मानीटरी सजमजत के काय:ा- (1) मानीटरी सजमजत, वास्ट्तजवक स्ट्थलीय-जवजनर्िाष्ट ििाओं के आधार पर, भारत सरकार के तत्कालीन पयाावरण और वन मंत्रालय की अजधसूचना सं. का.आ. 1553(अ), तारीख 14 जसतंबर ,2006 की अनुसूची म ें आन े वाले दक्रयाकलापों की, और िो पाठरजस्ट्थजतकी संवेिी िोन के अंतगता आत े ह,ैं ऐस े दक्रयाकलापों के जसवाय, िो उस अजधसूचना के पैरा 4 के अधीन सारणी में यथा जवजनर्िाष्ट प्रजतजिद्ध गजतजवजधयों के जलए ह,ै संवीक्षा करेगी, और उि अजधसूचना के उपबंधों के अधीन पूव ा पयाावरण जनकासी के जलए, यथाजस्ट्थजत, केन्द्रीय सरकार के पयाावरण, वन और िलवायु पठरवतान मत्रं ालय या राज्य पयाावरण प्रभाव आंकलन प्राजधकरण को जनर्िाष्ट करेगी। (2) ऐसे दक्रयाकलापों की, िो उपपैरा (1) म ें जनर्िाष्ट अजधसचू ना की अनुसूची म ें नहीं आते ह,ैं और िो पाठरजस्ट्थजतकी संवेिी िोन के अंतगता आत े ह,ैं ऐसी प्रजतजिद्ध गजतजवजधयों के जसवाय, िो उस अजधसूचना के पैरा 4 के अधीन सारणी म ें जवजनर्िाष्ट ह,ै वास्ट्तजवक स्ट्थलीय-जवजनर्िाष्ट ििाओं के आधार पर मानीटरी सजमजत द्वारा संवीक्षा की िाएगी और उसे सबं द्ध जवजनयामक प्राजधकरणों को जनर्िाष्ट दकया िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (3) मानीटरी सजमजत का सिस्ट्य-सजचव या संबद्ध कलेक्टर या संबद्ध उप वन संरक्षक, ऐस े व्यजि के जवरुद्ध, िो इस अजधसूचना के दकसी उपबंध का उल्लंघन करता ह,ै पयावा रण (सरं क्षण) अजधजनयम, 1986 (1986 का 29) की धारा 19 के अधीन पठरवाि फाइल करन े के जलए सक्षम होगा। (4) मानीटरी सजमजत, प्रत्येक मामले के आधार पर अपेक्षाओं पर जनभार रहत े हुए, संबद्ध जवभागों के प्रजतजनजधयों या जविेिज्ञों, औद्योजगक संगमों या संबद्ध पणधाठरयों के प्रजतजनजधयों को, अपन े जवचार-जवमिा म ें सहायता के जलए, आमंजत्रत कर सकेगी। (5) मानीटरी सजमजत, प्रत्येक वि ा की 31 माचा तक की अवजध की अपने दक्रयाकलापों की वार्िाक कारावाई ठरपोटा, इस अजधसूचना के साथ संलग्न उपाबधं -V में जवजनर्िाष् ट प्ररुप में, उस विा की 30 िून तक मख्ु य वन्यिीव वाडना को प्रस्ट्तुत करेगी। (6) केंद्रीय सरकार, मानीटरी सजमजत को उसके कृत्यों के प्रभावी जनवाहन के जलए, जलजखत म ें ऐस े जनिेि ि े सकेगी, िो वह उजचत समझे। [फा.सं. 25/97/2015-ईएसिडे -आरई] डॉ. स.ु केरकेट्टा, वैज्ञाजनक ‘’िी’’ ठटप्प ण.- मलू अजधसूचना, भारत के रािपत्र, असाधारण, भाग ।।, खंड 3, उपखंड (ii) में अजधसूचना संख् या का.आ. 2633(अ), तारीख 5 अगस्ट्त, 2020 द्वारा प्रकाजित की गई थी। MINISTRY OF ENVIRONMENT,FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 8th October, 2024 S.O. 4366(E).— WHEREAS, the Central Government, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, issued a notification to declare an Eco-Sensitive Zone around Bhimashankar Wildlife Sanctuary, Maharashtra in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide number S.O. 2633(E), dated the 5th August, 2020; AND WHEREAS, the Central Government is of the opinion that it is necessary and expedient in the public interest to amend the said notification; AND WHEREAS, sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986 provides that whenever it appears to the Central Government that it is in the public interest to do so, it may dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986; AND WHEREAS, the Central Government is of the opinion that it is in the public interest to dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 for amending the notification number S.O. 2633 (E), dated the 5th August, 2020; Now, Therefore, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub- section (2) and sub-section(3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendments in the notification of the Government of India, Ministry of Environment, Forest and Climate Change, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide number S.O. 2633 (E), dated the 5th August, 2020, namely:-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] In the said notification, for paragraphs 5 and 6, the following paragraph shall be respectively substituted, namely: - “5. Monitoring Committee. - (1) The Central Government hereby constitutes a Monitoring Committee consisting of the following persons, namely:- (i) District Collector, Pune Chairman, Ex-officio; (ii) Representative of Collector Thane / Raigad Member, Ex-officio; (iii) Deputy Conservator of Forests (Wildlife), Pune or his Member, Ex-officio; representative. (iv) Deputy Conservator of Forests, Raigad/ Thane or their Member, Ex-officio; representative. (v) Representative of the town planning office Thane / Raigad/ Pune Member, Ex-officio; (vi) Representative of the Department of Environment, Government of Member, Ex-officio; Maharashtra. (vii) One e xpert in the area of ecology and environment from reputed Member university/Institution to be nominated by the Government of Maharashtra from time to time every 3 years. (viii) One re presentative of non-governmental organization working in Member. the field of Wildlife Conservation to be nominated by the State Government of Maharashtra from time to time every three years. (ix) Deputy Conservator of Forests, Junnar. Member Secretary, Ex- Ex officio. 6. Functions of the Monitoring Committee. – (1) The Monitoring Committee shall, based on the actual site-specific conditions, scrutinise the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification. (2) The activities not covered in the Schedule to the notification referred to in sub-paragraph (1) and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 Wildlife Warden in the State in pro-forma specified in Annexure-V.
