(ii) पर्ाावरण (जवरासत संरक्षण सजहत) के क्षेत्र में काम करने वाल े गैर-सरकारी सिस्ट् र्; संगिनों का एक प्रजतजनजध, जिसे मध्र् प्रिेि सरकार द्वारा हर तीन साल में समर्-समर् पर नामजनर्िाष्ट दकर्ा िाएगा- सिस्ट्र्; (iii) पाररजस्ट्थजतकी और पर्ाावरण के क्षेत्र में मध्र् प्रििे सरकार द्वारा समर्-समर् सिस्ट् र्; पर हर तीन साल में नामजनर्िाष्ट दकर्ा िाने वाला एक जवििे ज्ञ- सिस्ट्र्; (iv) मध्र् प्रिेि प्रििू ण जनर्ंत्रण बोडा का प्रजतजनजध - सिस्ट्र्, पिेन; सिस्ट् र्, पिेन; (x) नगर एवं ग्राम जनर्ोिन जवभाग का जिला अजधकारी- सिस्ट्र्, पिने ; सिस्ट् र्, पिेन; (xi) प्रभागीर् वनाजधकारी, औबेिल्ु लागंि सिस्ट् र् सजचव, पिने । 6. मॉनीिरी सजमजत के कार्:ा- (1) मॉनीिरी सजमजत, वास्ट्तजवक स्ट्थलीर्-जवजनर्िाष्ट ििाओं के आधार पर तत्कालीन पर्ाावरण और वन मत्रं ालर् की अजधसचू ना सं. का.आ. 1533 (अ), तारीख 14 जसतम्बर, 2006 की अनसु ूची में आने वाल े दिर्ाकलापों की, और िो पाररजस्ट्थजतकी संवेिी िोन के अंतगता आते ह,ैं ऐसे प्रजतजसद्ध दिर्ाकलापों के जसवार्, िो उस अजधसचू ना के पैरा 4 के अधीन सारणी में र्था जवजनर्िाष्ट ह,ै संवीक्षा करेगी, और उि अजधसचू ना के उपबंधों के अधीन पवू ा पर्ाावरण अनुज्ञा-पत्र के जलए, केन्द्रीर् सरकार के पर्ावा रण, वन और िलवार्ु पररवतना मंत्रालर् र्ा राज्र् पर्ाावरण प्रभाव आंकलन प्राजधकरण को जनर्िाष्ट करेगी। (2) ऐसे दिर्ाकलापों की, िो उप-परै ा (1) में जनर्िाष्ट अजधसचू ना की अनुसचू ी में नहीं ह ै और पाररजस्ट्थजतकी संवेिी िोन के अंतगता आते ह,ैं ऐसी प्रजतजसद्ध दिर्ाकलापों के जसवार्, िो उस अजधसचू ना के परै ा 4 के अधीन सारणी में जवजनर्िाष्ट ह ै वास्ट्तजवक स्ट्थलीर्-जवजनर्िाष्ट ििाओं के आधार पर मॉनीिरी सजमजत द्वारा संवीक्षा की िाएगी और उसे सम्बद्ध जवजनर्ामक प्राजधकरणों को जनर्िष्टा दकर्ा िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (3) मॉनीिरी सजमजत के सिस्ट् र् सजचव र्ा कलेक् िर र्ा उप वन सरं क्षक, ऐसे व्यजि के जवरुद्ध, िो इस अजधसचू ना के उपबंधों का उल्ल ंघन करता ह,ै पर्ावा रण (संरक्षण) अजधजनर्म, 1986 की धारा 19 के अधीन पररवाि फाइल करने के जलए सक्षम होगा। (4) मॉनीिरी सजमजत, प्रत्र्ेक मामल े के आधार पर अपेक्षाओं पर जनभरा रहते हुए, सजमजत को उसके जवचार-जवमिा म ें सहार्ता के जलए, जवभाग से दकसी प्रजतजनजध र्ा जविेिज्ञ, औद्योजगक संगमों के दकसी प्रजतजनजध र्ा पणधाररर्ों को आमंजत्रत कर सकेगी। (5) मॉनीिरी सजमजत, प्रत्र् के विा के 31 माचा तक की अवजध के अपने दिर्ाकलापों की वार्िका कारावाई ररपोिा, इस अजधसचू ना के साथ संगलग्न उपाबंध-V में जवजनर्िाष्ट प्ररूप में, उस विा की 30 िून तक, मुख र् वन्द् र्िीव वाडान को प्रस्ट्त तु करेगी। (6) केंरीर् सरकार, मॉनीिरी सजमजत को उसके कृत्र्ों के प्रभावी जनवहा न के जलए, जलजखत में ऐसे जनििे िे सकेगी, िैसा वह उजचत समझे।” [फा.सं. 25/35/2016-ईएसिेड-आरई] डॉ. सु. केरकेि्िा, वैज्ञाजनक ‘’िी’’ रिप्प ण.- मलू अजधसूचना, भारत के रािपत्र, असाधारण, भाग ।।, खंड 3, उप खंड (ii) में जवस्ट्तृत का.आ. 2605(अ), तारीख 11 अगस्ट्त, 2017 द्वारा प्रकाजित की गई थी। MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 18th March, 2025 S.O. 1235(E).— WHEREAS the Central Government, in exercise of the powers conferred by sub-section (1) clauses (v) and (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, issued a notification to declare an Eco Sensitive Zone around Ratapani and Singhori Wildlife Sanctuary, Madhya Pradesh in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide number S.O. 2605(E), dated the 11th August, 2017; AND WHEREAS the Central Government is of the opinion that it is necessary and expedient in the public interest to amend the said notification; AND WHEREAS sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986 provides that whenever it appears to the Central Government that it is in the public interest to do so, it may dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986; AND WHEREAS the Central Government is of the opinion that it is in the public interest to dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 for amending the notification number S.O. 2605(E), dated the 11th August, 2017; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) clauses (v) and (xiv) of sub-section (2) and sub-section #(3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendments in the notification of the Government of India in the Ministry of Environment and Forest and Climate Change, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide number S.O. 2605(E), dated the 11th August, 2017, namely:-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] In the said notification, for paragraph 5 and 6, the following paragraph shall be substituted namely: - “5. Monitoring Committee. -The Central Government hereby constitutes a Monitoring committee consisting of the following persons, namely: - (i) Divisional Commissioner, Bhopal– Chairman, ex officio (ii) One representative of Non-Governmental Organizations working in the field of environment (including heritage conservation) to be nominated by the Government of Madhya Pradesh from time to time every three years– Member; (iii) An expert in the area of ecology and environment to be nominated by the Government of Madhya Pradesh from time to time every three years– Member; (iv) Representative of Madhya Pradesh Pollution Control Board – Member , ex officio; (v) An expert in Biodiversity to be nominated by the State Govt of Madhya Pradesh from time to time every three years– Member; (vi) Chief conservator of Forests , Bhopal – Member , ex officio; (vii) District Collector, Raisen– Member, ex officio; (viii) Superintending Engineer, Public Health Dept. Raisen – Member, ex officio; (ix) Chief Executive Officer of Zilla Panchayat, Raisen– Member, ex officio; (x) District Officer of Town and Country planning Department– Member, ex officio; (xi) Divisional Forest Officer, Obedullaganj – Member-Secretary, ex officio. 6. Functions of the Monitoring Committee. – (1) The Monitoring Committee shall, based on the actual site-specific conditions, scrutinise the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification. (2) The activities not covered in the Schedule to the notification referred to in sub-paragraph (1) and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (3) The Member-Secretary of the Monitoring Committee or the Collector or the Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (4) The Monitoring Committee may invite representative or expert from Department concerned, representative from industry associations or stakeholders to assist in its deliberations depending on the requirements on case to case basis. (5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-V.
