## Policy Analysis Report: Amendment Regarding Sri Lankamalleswara Wildlife Sanctuary Eco-Sensitive Zone Monitoring Committee
**1. Executive Summary:**
This report analyzes an amendment to a pre-existing policy regarding the Eco-Sensitive Zone (ESZ) surrounding the Sri Lankamalleswara Wildlife Sanctuary in Andhra Pradesh. The amendment, detailed in Notification S.O. 1721(E) dated April 15, 2025, focuses on reconstituting and defining the functions of the Monitoring Committee responsible for overseeing activities within the ESZ. The key changes involve a revised composition of the Monitoring Committee and a more detailed specification of its functions, particularly regarding the scrutiny of activities within the ESZ and referrals to relevant authorities. These changes aim to enhance the monitoring and regulation of activities within the ESZ.
**2. Introduction:**
This report provides an analysis of Notification S.O. 1721(E), published on April 15, 2025, which amends a previous notification (S.O. 1174(E), dated April 13, 2017) concerning the Eco-Sensitive Zone around the Sri Lankamalleswara Wildlife Sanctuary in Andhra Pradesh. This analysis is based solely on the provided policy text and aims to inform stakeholders about the changes introduced by this amendment, particularly concerning the Monitoring Committee for the ESZ.
**3. Policy Overview:**
This notification amends the original policy established in S.O. 1174(E), dated April 13, 2017, which declared an Eco Sensitive Zone around Sri Lankamalleswara Wildlife Sanctuary. The core objective of the *original policy*, as inferred from the provided text and the nature of an ESZ, is to protect the sanctuary and its surrounding environment by regulating activities within the designated zone. The amendment focuses on improving the effectiveness of this protection through a revised Monitoring Committee structure and its functions.
**4. Background and Rationale:**
The amendment appears to address a need for a more robust and effective monitoring mechanism within the ESZ. The changes introduced, such as the altered composition of the Monitoring Committee and the explicit detailing of its functions related to scrutiny and referrals, suggest that the original Monitoring Committee structure or mandate may have been deemed insufficient. The amendment seeks to improve the oversight and regulation of activities within the ESZ to ensure better environmental protection.
**5. Key Provisions / Changes:**
This amendment specifically substitutes paragraphs 5 and 6 of the original notification S.O. 1174(E). The key changes introduced are:
* **Reconstitution of the Monitoring Committee:**
* **Original Policy:** The structure of the Monitoring Committee was not specified in the provided text of the original policy.
* **New Rule/Provision:** The amendment establishes a specific composition for the Monitoring Committee, including:
* District Collector, Kadappa (Chairman, ex officio)
* Representative of NGO working in the field of environment (Member)
* Expert in ecology and environment (Member)
* Regional Officer, State Pollution Control Board (Member, ex officio)
* Municipal Commissioner or representative of Kadappa Town (Member, ex officio)
* Divisional Forest Officer, Proddatur Wildlife Division (Member, ex officio)
* Representative of the Department of Environment, Government of Andhra Pradesh (Member, ex officio)
* Member-Secretary or Member of the State Biodiversity Board (Member, ex officio)
* Representative of the Department of Urban Development, Government of Andhra Pradesh (Member, ex officio)
* Deputy Conservator of Forests or Divisional Forest Officer, Kadappa Division (Member Secretary, ex officio).
* **Difference/Effect:** This change introduces a more defined and potentially more representative committee structure, incorporating various relevant stakeholders and expertise.
* **Detailed Specification of Monitoring Committee Functions:**
* **Original Policy:** The functions of the Monitoring Committee were not specified in the provided text of the original policy.
* **New Rule/Provision:** The amendment details the functions of the Monitoring Committee:
* Scrutinize activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests, vide S.O. 1533 E, dated the 14th September, 2006, and are falling in the Ecosensitive Zone, except for the prohibited activities specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification.
* Scrutinize activities not covered in the Schedule to the notification referred to in subparagraph 1 and are falling in the Ecosensitive Zone, except for the prohibited activities specified in the Table under paragraph 4 thereof, based on the actual sitespecific conditions and referred to the concerned regulatory authorities.
* The MemberSecretary of the Monitoring Committee or the Collector or the Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment Protection Act, 1986, against any person who contravenes the provisions of this notification.
* Invite representative or expert from the Department, representative from the industry associations or the stakeholders to assist the committee in its deliberations depending on the requirements on case to case basis.
* Submit the action taken report annually of its activities for the period up to the 31st March of every year to the Chief Wildlife Warden of the State by the 30th June of that year in proforma specified in AnnexureIII.
* **Difference/Effect:** This change provides a clear mandate for the Monitoring Committee, specifying its responsibilities regarding the review of activities within the ESZ, referral processes, and reporting requirements. This aims to improve the efficiency and accountability of the monitoring process. It makes the Member Secretary, the Collector or the Deputy Conservator of Forests competent to file complaints against any person who contravenes the provisions of this notification.
**6. Target Audience and Stakeholders:**
Based on the provided text, the primary target audience and stakeholders affected by these changes include:
* Industries and project developers operating or planning to operate within the Eco-Sensitive Zone of the Sri Lankamalleswara Wildlife Sanctuary, as they are subject to the scrutiny of the Monitoring Committee.
* The Andhra Pradesh State Government and its various departments, specifically the Department of Environment, the Department of Urban Development, and the State Biodiversity Board, whose representatives are included in the Monitoring Committee.
* The State Pollution Control Board, represented on the Monitoring Committee.
* Non-Governmental Organizations working in the field of environment within Andhra Pradesh.
* The local community residing within and around Kadappa, as activities within the ESZ can impact their livelihoods and environment.
* The Central Government, specifically the Ministry of Environment, Forest and Climate Change.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The primary responsible body is the Monitoring Committee, as newly constituted by this amendment. The Committee reports to the Chief Wildlife Warden of the State. Other agencies involved include the Andhra Pradesh State Government departments mentioned in the committee composition, the State Pollution Control Board, and the Central Government's Ministry of Environment, Forest and Climate Change and the State Environment Impact Assessment Authority.
* **Timelines/Procedures:** The amendment stipulates that the Monitoring Committee must submit an annual action-taken report to the Chief Wildlife Warden of the State by June 30th of each year, covering activities up to March 31st of that year. It refers to activities covered under S.O. 1533 E, dated 14th September 2006, and the requirement for prior environmental clearances, indicating that existing environmental regulations will continue to apply and that the committee will have a role in ensuring adherence.
**8. Expected Outcomes / Impact of Changes:**
The intended outcome of these amendments is likely to be improved environmental protection within the Sri Lankamalleswara Wildlife Sanctuary's Eco-Sensitive Zone. The specific impact of these changes is expected to include:
* **Enhanced Monitoring:** The reconstituted Monitoring Committee, with its broader representation and clearly defined functions, is expected to provide more comprehensive and effective monitoring of activities within the ESZ.
* **Improved Regulatory Compliance:** The explicit mandate for the Monitoring Committee to scrutinize activities and refer them to relevant authorities should lead to better compliance with environmental regulations.
* **Increased Transparency and Accountability:** The required annual reporting should increase transparency and accountability regarding the monitoring and regulation of activities within the ESZ.
**9. Conclusion:**
Notification S.O. 1721(E) represents a significant amendment to the policy governing the Eco-Sensitive Zone around the Sri Lankamalleswara Wildlife Sanctuary. By reconstituting the Monitoring Committee and detailing its functions, the amendment aims to improve the effectiveness of environmental protection within the ESZ. This change necessitates that industries and other stakeholders operating within the zone understand the revised monitoring process and ensure compliance with all applicable regulations. The amendment underscores the government's commitment to protecting the sanctuary and its surrounding environment through a strengthened regulatory framework.
