L.-33004/99 सी.जी.-डी.एल.-अ.-23012024-251569 CG-DxLx-xEG-I2D3H0x1x2x0 24-251569 xxxGIDExxx ऄसाधारण EXTRAORDINARY भाग II—खण् ड 3—ईप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 51] नइ ददल्ली, मगं लवार, जनवरी 23, 2024/माघ 3, 1945 No. 51] NEW DELHI, TUESDAY, JANUARY 23, 2024/MAGHA 3, 1945 सड़क पररवहन और राजमाग गमत्रं ालय ऄजधसचू ना नइ ददल्ली, 19 जनवरी, 2024 सा.का.जन. 57(ऄ).—केंद्र सरकार, मोटर यान ऄजधजनयम, 1988 (1988 का 59) की धारा 56 द्वारा प्रदत्त िजियों का प्रयोग करत े हुए केंद्रीय मोटर यान जनयमावली, 1989 म ें और संिोधन करन े के जलए जनम न जलजखत प्रारूप जनयम, जजस े बनाने का प्रस्ट्ताव करती ह,ै जजनको ईि ऄजधजनयम की धारा 212 की ईप-धारा (1) के द्वारा यथा अवश्यक आसके द्वारा प्रभाजवत होन े की संभावना वाले सभी व्यजियों की जानकारी के जलए एतदद्वारा प्रकाजित दकया जाता ह;ै और एतदद्वारा नोरटस ददया जाता ह ै दक प्रारूप जनयमों को ईस तारीख स े तीस ददन की ऄवजध समाप्त होने के बाद जवचाराथ ग स्ट्वीकार कर जलया जाएगा जजस तारीख स े सरकारी राजपत्र म ें यथा प्रकाजित आस ऄजधसूचना की प्रजतयां जनता के जलए ईपलब्ध करायी जाती ह;ैं आन प्रारूप जनयमों के प्रजत अपत ज तयों एव ं सुझावों, यदद कोइ हो, को ऄपर सजचव (पररवहन), सड़क पररवहन और राजमागग मंत्रालय, पररवहन भवन, संसद मागग, नइ ददल्ली-110001 या इमेल: comments-morth@gov.in, के माध यम स े भेजा जा सकता ह।ै जवजनर्ददष्ट ऄवजध समाप्त होन े के पहल े ईक त प्रारूप जनयमों के संबंध म ें दकसी भी व्यजि स े प्राप्त होन े वाली अपजत्तयों या सुझावों पर केंद्र सरकार द्वारा जवचार दकया जाएगा। 508 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] प्रारूप जनयम 1. संजिप्त िीर्कग एव ं प्रारंभ - (1) आन जनयमों को केन्द्द्रीय मोटर यान (वाहन स्ट्रैपपग सुजवधा केंद्र का पंजीकरण और काय)ग संिोधन जनयमावली, 2024 कहा जाएगा। (2) यह सरकारी राजपत्र म ेंईनके प्रकािन की तारीख स ेलाग ूहोंगे। 2. मोटर यान (वाहन स्ट्रैपपग सुजवधा केंद्र का पंजीकरण और काय)ग जनयमावली, 2021 और आसके संिोधन, 2022 (आसके बाद ईि जनयमों के रूप म ें ईजल्लजखत) म,ें जनयम 5 के ईप-जनयम (ख) म ें जनम्नजलजखत को प्रजतस्ट्थाजपत दकया जाएगा, ऄथागत: - ''(ख) संस्ट्था को ईस राज्य या संघ राज्य ित्रे के प्रदर्ू ण जनयत्रं ण बोडग स े (सीटीइ) स्ट्थाजपत करने की सहमजत के जलए ऄनुमोदन प्राप्त करना होगा जजसम ें पंजीकृत वाहन स्ट्रैपपग सुजवधा केंद्र को स्ट्थाजपत करन े का आरादा ह।ै '' 3. ईि जनयमों के जनयम 5 के ईपजनयम (च) के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकया जाएगा, ऄथागत :- ''संस्ट्था को प्रदर्ू ण जनयंत्रण बोडग स े संचालन की सहमजत (सीटीओ) प्राप्त करनी होगी या संचालन िरूु होन े की तारीख स े कम स ेकम 60 ददन पहले आसके जलए अवेदन करना होगा।'' 4. ईि जनयमों के जनयम 5 के ईप-जनयम (छ) म,ें "नारंगी श्रेणी का" िब्द का जवलोपन दकया जाएगा। 5. ईि जनयमों के जनयम 6 के ईप-जनयम (6) म,ें िब्दों "ऄनुमोददत माना जाएगा" के बाद, जनम्नजलजखत िब्द जोड़ े जाएंगे: - "यदद 60 वां ददन गैर-काय ग ददवस पर पड़ता ह,ै तो ऄगल े काय गददवस पर जवचार दकया जाएगा।“ 6. ईि जनयमों के जनयम 7 के ईपजनयम (5) को का जवलोपन दकया जाएगा। 7. ईि जनयमों के जनयम (10) के ईप-जनयम (1) के खंड (viii) म,ें "रसीद प्राप्त करें" िब्दों के बाद, "(वास्ट्तजवक / जडजजटल)" िब्द ऄंतःस्ट्थाजपत दकया जाएगा। 8. ईि जनयमों के जनयम (10) के ईपजनयम (1) के खंड (xii) म,ें "जारी करन े की तारीख स े दो वर्ग" िब्दों के स्ट्थान पर "जारी करने की तारीख से तीन वर्ग" िब्द प्रजतस्ट्थाजपत दकए जाएंगे। 9. ईि जनयमों के जनयम (10) के ईपजनयम (1) के खंड (xiii) म,ें जनम्नजलजखत परंतुक ऄतं ः स्ट्थाजपत दकया जाएगा: बिगते , सरकारी स्ट्वाजमत्व वाले वाहनों या दकसी प्रवतगन एजेंसी द्वारा सौंपे गए जब्त वाहनों के जखलाफ जारी जमा प्रमाणपत्र (सीडी) पर कोइ प्रोत्साहन ईपलब्ध नहीं होगा। ऐसी सीडी आलेक्ट्रॉजनक रूप स े व्यापार योग्य नहीं होंगी। 10. ईि जनयमों के जनयम (14) के ईपजनयम (1) और (2) के स्ट्थान पर जनम्नजलजखत प्रजतस्ट्थाजपत दकए जाएंग,े ऄथागत :- "पंजीकृत स्ट्रैपर केंद्रीय मोटर यान जनयमावली, 1989 के जनयम 126 के तहत जनर्ददष्ट दकसी भी एजेंसी द्वारा पंजीकृत वाहन स्ट्रैपपग सुजवधा केंद्र के ऑजडट का समय पर करवाना सुजनजित करेगा। क. जनयामक और ऄनपु ालन लखे ा परीिा; और ख. पंजीकृत वाहन स्ट्रैपपग सुजवधा केंद्र द्वारा प्रपत्र -3 म ें रख े गए मास फ्लो स्ट्टेटमेंट की लेखा परीिा। ईि जनयमों के जनयम 14 के ईप-जनयम (3), (4), (5) और (6) को ईप-जनयम (2), (3), (4) और (5) पढा जाएगा। 11.ईि जनयमों के प्रपत्र 2 में मद संख्या (1) के ईप-मद (ड.) म,ें "पैन" िब्द के बाद, जनम्नजलजखत िब्द जोड़े जाएंग:े - "या टैन (केवल सरकारी वाहनों के जलए)। 12. ईि जनयमों के प्रपत्र 2 म ें मद संख्या (1) के ईप-मद (च) म,ें "बैंक खाता" िब्दों के बाद, जनम्नजलजखत िब्द जोड़े जाएंगे: - "(सरकारी स्ट्वाजमत्व वाले वाहनों के जलए, बैंक खाता भारत ओि या संबंजधत सरकारी जवभाग या जनकाय द्वारा जनर्ददष्ट कोइ ऄन्द्य खाता हो सकता ह।ै )" [स.ं अरटी-23013/01/2018-टी] महमूद ऄहमद, ऄपर सजचव[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 नोटः मूल जनयम भारत के राजपत्र, ऄसाधारण, भाग- II, खंड 3, ईप धारा (i) म ें ऄजधसूचना संख्या सा.का.जन. 653(ऄ), ददनांक 23 जसतंबर, 2021 के माध य म स े प्रकाजित दकए गए थ े और जपछली बार ऄजधसचू ना संख या सा.का.जन 695(ऄ), ददनांदकत 13 जसतंबर 2022 द्वारा संिोजधत दकया गया। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 19th January, 2024 G.S.R. 57(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 56 (2) of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification, as published in the Official Gazette, are made available to the public; Objections and suggestions to these draft rules, if any, may be sent to the Additional Secretary (Transport), email: comments-morth@gov.in, Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001. The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government. DRAFT RULES 1. Short title and commencement. - (1) These rules may be called the Central Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Amendment Rules, 2024. (2) They shall come into force on the date of their publication in the official Gazette. 2. In the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021 and its amendments, 2022, (hereinafter referred as the said rules), in sub-rule (b) of rule 5, the following shall be substituted, namely: - ―b) The entity shall have an approval for consent to establish (CTE) from the Pollution Control Board of the State or Union territory in which the Registered Vehicle Scrapping Facility is intended to be located‖. 3. For sub-rule (f) of rule 5 of the said rules, the following shall be substituted, namely: - ―The entity shall have obtained Consent to Operate (CTO) from Pollution Control Board, or shall have applied for the same, at least 60 days prior to the date of commencement of operations.‖ 4. In sub-rule (h) of rule 5 of the said rules, the words ―the orange category of‖ shall be omitted. 5. In sub-rule (6) of rule 6 of the said rules, after the words ―would be deemed approved‖, the words - ―If the 60th day falls on a non-working day, the following working day shall be considered.‖ shall be added. 6. The sub rule (5) of rule 7 of the said rules, shall be omitted. 7. In Clause (viii) of sub-rule (1) of rule (10) of the said rules, after the words ―obtain a receipt‖, the words ―(physical/ digital)‖ shall be inserted. 8. In Clause (xii) of sub rule (1) of rule (10) of the said rules, for the words ―two years from the date of issuance‖ the words ―three years from the date of issuance.‖ shall be substituted. 9. In Clause (xiii) of sub rule (1) of rule (10) of the said rules, the following proviso shall be inserted: ―Provided that no incentives shall be available on Certificate of Deposit (CD) issued against government- owned vehicle (s) or impounded vehicle (s) handed over by an enforcement agency. Such CDs shall not be electronically tradeable.‖ 10. For sub rule (1) and (2) of rule (14) of the said rules, the following shall be substituted, namely: - ―The Registered Scrapper shall ensure timely conduct of audit of the Registered Vehicle Scrapping Facility by any of the agencies specified under rule 126 of the Central Motor Vehicles Rules, 1989 to undertake – (a) regulatory and compliance audit; and (b) audit of the mass flow statement as maintained in Form-3 by the Registered Vehicle Scrapping Facility.‖ Sub-rules (3), (4), (5) and (6) of rule 14 of the said rules, may be read as sub-rules (2), (3), (4) and (5).4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 11. In sub-item (E) of Item Number (1) in Form 2, of the said rules, after the word ―PAN‖, the following words shall be added: - ―or TAN (for Government Vehicles only).‖ 12. In sub-item (F) of Item Number (1) in Form 2, of the said rules, after the words ―Bank Account‖, the following words shall be added: - ―(for Government owned vehicles, the bank account may be Bharat Kosh or any other account specified by the concerned Government department or body.)‖ [No. RT-23013/01/2018-T] MAHMOOD AHMED, Addl.
