(1) इन जनयमों का संजक्षप्त नाम केन्द्रीय जसजिल सेिा (अिकाि) (संिोधन) जनयम, 2024 ह ै। (2) य ेरािपत्र म ेंउनके प्रकािन की तारीख से प्रिृत्त होंग े। 2. केन्द्रीय जसजिल सेिा (अिकाि) जनयम, 1972 (जिसे इसमें इसके पश्चात् उि जनयम कहा िाएगा) के जनयम 43 के उपजनयम (5) के पश्चात ्जनम्नजलजखत उपजनयम अतं ःस्ट्र्ाजपत दकया िाएगा, अर्ाित ् :- “(6) सरोगेसी की ििा म,ें सरोगटे के सार् अजधष्ठाता माता जिसके िो से कम िीजित बच्चे हैं, एक अर्िा िोनों के सरकारी सेिक होने की ििा में, 180 दिन का मातृत्ि अिकाि अनुित्त दकया िा सकेगा । 3. उि जनयमों के जनयम 43 क के उपजनयम (5) के पश्चात ्जनम्नजलजखत उपजनयम अंतःस्ट्र्ाजपत दकया िाएगा, अर्ाित्:- 3614 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “(6) सरोगेसी के माध्यम से प्राप्त बच्चे की ििा में अजधष्ठाता जपता, िो सरकारी सेिक है, जिसके िो से कम िीजित बच्च े ह,ैं को बच्चे के िन्द्म की तारीख से 6 मास की कालािजध के भीतर 15 दिन का जपतृत्ि अिकाि अनुित्त दकया िा सकेगा । 4. उि जनयमों के जनयम 43 ग के उपजनयम (7) के पश्चात ्जनम्नजलजखत उपजनयम अंतःस्ट्र्ाजपत दकया िाएगा, अर्ाित् :- “(8) सरोगेसी की ििा में अजधष्ठाता माता, जिसके िो से कम िीजित बच्चे हैं, को जििु िेखभाल अिकाि अनुित्त दकया िा सकेगा । टटप्पण (1) :- ‘अजधष्ठाता माता’ पि स ेसरोगेसी के माध्यम स ेिन्द्मे बच्च े का आिय रखन े िाली माता अजभप्रेत होगी । टटप्पण (2) :- ‘सरोगेट माता’ पि से ऐसी मजहला अजभप्रेत होगी िो अजधष्ठाता माता के जनजमत्त बच्च े को धारण करती ह ै। टटप्पण (3):- इस जनयम में ‘अजधष्ठाता जपता’ पि से सरोगसे ी के माध्यम स े िन्द्मे बच्च े का आिय रखने िाला जपता अजभप्रते होगा ।“। [फा. स.ं ए-24011/21/2023-स्ट्र्ा. अिकाि] मनोि कुमार जद्विेिी, अपर सजचि टटप्पण —मलू जनयम भारत के रािपत्र, असाधारण भाग 2, खंड 3, उपखडं (ii), तारीख 8 अप्रैल, 1972 म ें का. आ. सं. 940 तारीख 15 माचि, 1972 द्वारा प्रकाजित दकए गए र्े और उनका अंजतम संिोधन अजधसचू ना सं.सा.का.जन. 374(अ) तारीख 15 मई, 2023, िो भारत के रािपत्र, असाधारण भाग 2, खंड 3, उपखंड (i), तारीख 18 मई, 2023 में प्रकाजित की गई र्ी, द्वारा दकया गया र्ा । का.आ.सं.940 MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS (Department Of Personnel And Training) NOTIFICATION New Delhi, the 18th June, 2024 G.S.R. 331(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules, 1972, namely: - 1.(1) These rules may be called the Central Civil Services (Leave) (Amendment) Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Central Civil Services (Leave) Rules, 1972 (hereinafter referred to as the said rules), in rule 43, after sub- rule (5), the following sub-rule shall be inserted, namely:- “(6) In case of surrogacy, the surrogate, as well as the commissioning mother with less than two surviving children, may be granted maternity leave of 180 days, in case either or both of them are Government servants. 3. In the said rules, in rule 43-A, after sub-rule (5), the following sub-rule shall be inserted, namely:- “(6) In case of a child begotten through surrogacy, the commissioning father who is a male Government servant with less than two surviving children may be granted paternity leave of 15 days within the period of 6 months from the date of delivery of the child. 4. In the said rules, in rule 43-C, after sub-rule (7), the following sub-rule shall be inserted, namely:- “(8) In case of surrogacy, the commissioning mother with less than two surviving children, may be granted child care leave. Note 1:- The expression ‘commissioning mother’ shall mean the intending mother of the child born through surrogacy.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 Note 2:-The expression ‘surrogate mother’ shall mean the woman who bears the child on behalf of the commissioning mother.”.
