Executive Summary & Key Takeaways

## Report on the Biological Diversity Amendment Rules, 2025 **1. Executive Summary:** This report analyzes the Biological Diversity Amendment Rules, 2025, as published in the Gazette of India. This amendment focuses on streamlining the process for obtaining a certificate of origin for cultivated medicinal plants. The key changes involve introducing a web portal for maintaining records and processing applications, aiming to simplify procedures for Biodiversity Management Committees (BMCs) and applicants. The report details the changes to Rule 19 of the Biological Diversity Rules, 2024, and the First and Second Schedules, outlining the new procedure, fees, and forms related to the certificate of origin. The primary beneficiaries of these changes are likely farmers and organizations involved in the cultivation and trade of medicinal plants. **2. Introduction:** This report aims to provide a comprehensive overview of the Biological Diversity Amendment Rules, 2025, based solely on the provided government policy text. The analysis focuses on understanding the changes introduced, their implications, and the intended beneficiaries of this amendment. **3. Policy Overview:** * This report pertains to an amendment of the Biological Diversity Rules, 2024. * The core objective of this amendment, as inferred from the text, is to simplify and standardize the procedure for obtaining a certificate of origin for cultivated medicinal plants through the use of a web portal. **4. Background and Rationale:** The provided text indicates that the amendment is designed to address the process for obtaining certificates of origin for cultivated medicinal plants. The likely reason for this specific amendment is to improve efficiency, transparency, and accessibility for stakeholders by moving the record-keeping and application process to a web portal. This shift aims to reduce administrative burdens on both the Biodiversity Management Committees and applicants seeking certification. The amendment suggests a need for a more streamlined and potentially less paper-intensive system than was previously in place. **5. Key Provisions / Changes:** The amendment introduces the following key changes: * **Changes to Rule 19 (Procedure for obtaining a certificate of origin for cultivated medicinal plants):** The existing rule is entirely substituted with a new rule detailing the procedure through the web portal. * **Old Rule 19 (Inferred):** The text implies that the previous Rule 19 outlined a different, likely more manual and less standardized, procedure for obtaining a certificate of origin. * **New Rule 19:** Establishes a three-step process: 1. Biodiversity Management Committees (BMCs) must maintain a book of details of cultivated medicinal plants in Form 11 on a web portal. 2. Applicants must apply for a certificate of origin using Form 11A on the web portal, including the appropriate fee. 3. Based on the entries in the BMC's online record, the certificate of origin will be generated in Form 12 on the web portal. * **Effect of Change:** This moves the entire process online, potentially speeding up application processing, improving record-keeping, and creating a more transparent system. * **Changes to First Schedule (Fees):** * **Specific Change:** Serial numbers 11 and 12 are replaced. The new entries clarify fees related to the online system. * **Impact:** There is no fee for the BMC to maintain the online record (Form 11), there is a fee of 200 (currency not specified, but likely INR) for an application for a certificate of origin (Form 11A), and there is no fee for the certificate of origin itself (Form 12). * **Changes to Second Schedule (Forms):** * **Specific Change:** Form 11 and Form 12 are replaced with new versions. * **Impact:** The new Form 11 mandates details of cultivated medicinal plants including common and botanical names and the quantity produced annually. The new Form 11A asks for applicant details and the quantity of each medicinal plant for which access is requested. The new Form 12 is a certificate of origin with a Unique ID/QR code and confirms cultivation within the BMC's jurisdiction. **6. Target Audience and Stakeholders:** Based on the provided text, the primary target audience and stakeholders are: * **Farmers and organizations cultivating medicinal plants:** They are the applicants for the certificate of origin. * **Biodiversity Management Committees (BMCs):** They are responsible for maintaining the records and issuing the certificates of origin via the web portal. * **State Biodiversity Boards (SBBs):** Relevant as the applicant must select the state in which the SBB is located. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** * Central Government (Ministry of Environment, Forest and Climate Change) responsible for enacting the rules. * Biodiversity Management Committees (BMCs) are responsible for implementing the procedure at the local level. * State Biodiversity Boards (SBBs) are indirectly involved. * **Timelines/Procedures:** * The amendment comes into force on November 1st, 2025. * The procedure involves the applicant filling Form 11A online, the BMC maintaining records in Form 11 online, and the system generating the certificate in Form 12. * **Specific to Amendment:** Implementation hinges on the availability and functionality of the web portal, and the capacity of BMCs to use it effectively. **8. Expected Outcomes / Impact of Changes:** The likely intended outcomes of these changes are: * **Simplified application process:** The web portal is intended to streamline the process for applicants. * **Improved record-keeping:** The requirement for BMCs to maintain online records should improve the accuracy and accessibility of information. * **Increased transparency:** The online system could potentially enhance transparency in the certification process. * **Reduced administrative burden:** Automating certificate generation should reduce the workload for BMCs. * **Quicker certification:** The automated process is expected to be faster than the previous manual process. **9. Conclusion:** The Biological Diversity Amendment Rules, 2025, represent a significant step towards modernizing the process of obtaining certificates of origin for cultivated medicinal plants. By transitioning to a web-based system, the amendment aims to create a more efficient, transparent, and accessible process for all stakeholders involved. The success of this amendment will largely depend on the effective implementation and management of the web portal, as well as the ability of BMCs to adapt to the new online procedures.
