L.-33004/99 सी.जी.-डी.एल.-अ.-29072025-265053 CG-DxLx-xEG-I2D9H0x7x2x0 25-265053 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 456] नई दिल्ली, सोमवार, िलु ाई 28, 2025/श्रावण 6, 1947 No. 456] NEW DELHI, MONDAY, JULY 28, 2025/SHRAVANA 6, 1947 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 22 िुलाई, 2025 सा. का. जन. 499(अ).—केंद्रीय मोटर यान जनयमावली ,1989 ,जिनम ें केंद्र सरकार मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 110 के द्वारा प्रित्त िजियों का प्रयोग करत े हुए संिोधन करन े का प्रस्ट्ताव करती ह ै ,म ें और अजधक संिोधन करत े हुए जनम्नजलजखत प्रारूप कजतपय जनयमों को इस अजधजनयम की धारा 212 की उप-धारा (1) के द्वारा यथावश्यक इसके द्वारा प्रभाजवत होन े की संभावना वाले सभी व्यजियों की िानकारी के जलए एतिद्वारा प्रकाजित दकया िाता ह;ै और एतिद्वारा नोरटस दिया िाता ह ैदक उि प्रारूप जनयमों को उस तारीख स ेतीस दिन की अवजध समाप्त होन े के बाि जवचाराथग स्ट्वीकार कर जलया िाएगा, जिस तारीख स े सरकारी रािपत्र म ें यथा प्रकाजित इस अजधसूचना की प्रजतयां िनता के जलए उपलब्ध करायी िाती ह;ैं उपरोि अवजध समाप्त होन े के पहले उक्त प्रारूप जनयमों के संबंध म ें दकसी भी व्यजि स े प्राप्त होन े वाली दकन् हीं आपजत्तयों या सुझावों पर केंद्र सरकार द्वारा जवचार दकया िाएगा। इन प्रारूप जनयमों के प्रजत आपज‍ तयों एव ं सुझावों, यदि कोई हो, को अपर सजचव (एमवीएल,पररवहन और सड़क सुरक्षा), ईमेल: comments-morth@gov.in, सड़क पररवहन और रािमाग ग मंत्रालय, पररवहन भवन, संसि माग,ग नई दिल्ली-110001 को भेिा िा सकता ह।ै 5035 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] प्रारूप जनयम 1. िीर्गक एव ंप्रारंभ – (1) इन जनयमों को केंद्रीय मोटर यान (........संिोधन) जनयमावली, 2025 कहा िाएगा। 2. इन जनयमों के अजतररि होत े हुए भी य े आजधकाररक रािपत्र म ेंअपन ेअंजतम प्रकािन की तारीख स े प्रवृ‍ त होंगे। 3. केन्द्रीय मोटर यान जनयमावली, 1989 (जिसे इसम ें इसके पश्चात ् उि जनयम कहा गया ह)ै के जनयम 62 के उप-जनयम (1) म,ें मि (बी ए) म,ें "तीन वर्ग" िब्िों के स्ट्थान पर, "एक वर्ग" िब्ि प्रजतस्ट्थाजपत दकए िाएगं े। 4. उि जनयमों म,ें जनयम 62 म,ें उप-जनयम (1) के पश्चात ् जवद्यमान परंतुक म ें "दिटनेस प्रमाण-पत्र" िब्िों के पश्चात ् "ई- ररक्िा और ई-काटग सजहत सभी पररवहन यानों का" िब्ि अंत:स्ट्थाजपत दकए िाएंगे। 5. उि जनयमों म,ें जनयम 62 म,ें उप-जनयम (1) के पश्चात्, जवद्यमान परन्तुक के पश्चात,् सारणी म,ें मि (20) के पश्चात,् जनम्नजलजखत मि (21) अतं :स्ट्थाजपत की िाएगी, अथागत:् - 1 2 3 4 5 6 7 8 (21) ई-ररक्िा और नही नही नही हा ं वाहन को जबना भार के (पूरी तरह चाि ग करके तथा पणू ग ई-काट ग के जलए नही एक्सीलेटर जस्ट्थजत म)ें सीधी या समतल सड़क पर चलाया अजधकतम िाएगा और िब वाहन पूरी गजत प्राप्त कर लेगा, तो अजधकतम गजत गजत की गणना जनजश्चत िरू ी (िसै े 50 मीटर) तय करन े म ेंलगन े वाले समय को मापकर की िाएगी। वाहन की अजधकतम गजत 25 दकमी/घंटा स ेअजधक नहीं होगी। 6. 1 अप्रलै , 2026 को और उसके पश्चात,् उि जनयमों म,ें जनयम 100 के उप-जनयम (1) म,ें "प्र‍येक मोटर यान" िब्िों के पश्चात,् "ई-ररक्िा और ई-काटग सजहत" िब्ि अतं :स्ट्थाजपत दकए िाएंगे। 7. 1 अप्रैल, 2026 को और उसके पश्चात,् उि जनयमों म,ें जनयम 101 के उप-जनयम (2) म,ें मि (iii) के स्ट्थान पर जनम्नजलजखत को प्रजतस्ट्थाजपत दकया िाएगा, अथागत:् - “(iii) एआईएस-045, समय-समय पर यथा-संिोजधत, क्वाजिसाइदकल, ई-ररक्िा और ई-काटग के मामले म”ें 8. 1 अप्रलै , 2026 को और उसके पश्चात,् उि जनयमों म,ें जनयम 117 के उप-जनयम (1) में, “या दकसी ई-ररक्िा या ई-काटग या दकसी वाहन” िब्िों का जवलोपन दकया िाएगा। 9. 1 अप्रैल, 2026 को और उसके पश्चात,् उि जनयमों में, जनयम 117 म,ें उप-जनयम (1) के पश्चात,् तीसरे परंतुक म,ें "तीस दकलोमीटर प्रजत घंटा" िब्िों के पश्चात ्"ई-ररक्िा या ई-काटग को छोड़कर" िब्ि अंत:स्ट्थाजपत दकए िाएंगे। 10. उि जनयमों म ेंजनयम 125-थ के पश्चात ् जनम्नजलजखत जनयम अंतःस्ट्थाजपत दकया िाएगा, अथागत:- "125-ि ई-ररक्िा और ई-काटग के जलए जवजिष्ट आवश्यकताएँ। - 1 अप्रैल 2026 को और उसके बाि, ई-ररक्िा और ई-काटग के सभी जवजनमागताओं को, टाइप अनुमोिन प्रदिया के भाग के रूप म,ें गुणवत्ता जनयंत्रण स्ट्थाजपत करन े हते ु अपनी जवजनमागण जवजनमागण केंद्रों और प्रदिया का लेखापरीक्षा (ऑजडट) कराना होगा। यह ऑजडट ई-ररक्िा और ई-काटग के टाइप अनुमोिन प्रदिया का संचालन करने वाली परीक्षण एिेंसी द्वारा दकया िाएगा। बिते दक वैध आईएटीएि प्रमाणीकरण या समकक्ष प्रमाणीकरण रखने वाले जवजनमागता के जलए, ऑजडट का कायगक्षेत्र केवल िस्ट्तावेज़ स‍यापन तक ही सीजमत होगा। (2) 1 अप्रैल, 2027 को या उसके बाि जनर्मगत सभी ई-ररक्िा/ई-काटग म ें जलजथयम आयन बैटरी पैक लगाए िाएंगे और इसके जलए जनष्पािन की आवश्यकता समय-समय पर यथा-सिं ोजधत एआईएस-156 (भाग 1) और (भाग 2) के अनुसार होगी । [िा. स.ं आरटी-11036/109/2024-एमवीएल] महमूि अहमि, अपर सजचव नोट : मलू जनयम भारत के रािपत्र, असाधारण, भाग II, खडं 3, उप खडं (i) म ें अजधसूचना संख् या सा.का.जन. 590(अ), दिनांक 02 िून,1989 द्वारा प्रकाजित दकए गए थ े और जपछली बार सा.का.जन.......(अ), दिनांक ............. के माध् यम स े संिोजधत दकए गए थे।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 22nd July, 2025 G.S.R. 499(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Gazette of India, are made available to the public; The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government. Objections and suggestions to these draft rules, if any, may be sent to the Additional Secretary (MVL, Transport & Road Safety), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001 or on the email: comments-morth@gov.in; Draft Rules 1. Short title and commencement. — (1) these rules may be called as the Central Motor Vehicles (………. Amendment) Rules, 2025. 2. Save as otherwise provided in these rules, they shall come into force on the date of their final publication in the Official Gazette. 3. In the Central Motor Vehicles Rules, 1989, (herein after referred as the said rules), in rule 62, in sub-rule (1), in item (ba), for the words “three years”, the words “One year” shall be substituted. 4. In the said rules, in rule 62, after sub-rule (1), in the existing proviso after the words “fitness certificate” the words “of all transport vehicles including e-rickshaws and e-carts” shall be inserted. 5. In the said rules, in rule 62, after sub-rule (1), after the existing proviso, in the table, after item (20), the following item (21) shall be inserted namely:- 1 2 3 4 5 6 7 8 (21) Maximum No No No No Yes The vehicle shall be driven in unladen speed for E- condition (with full charge and at full rickshaw and accelerator position) on straight or flat E-cart road and when the vehicle attains full speed, the maximum speed shall be calculated by measuring time taken to travel fixed distance (say 50 meters). The maximum speed of the vehicle shall not be more than 25 km/h. 6. On and after 1st April 2026, in the said rules, in rule 100, in sub-rule (1), after the words “every motor vehicle”, the words “including E-Rickshaw and E-cart” shall be inserted. 7. On and after 1st April 2026, in the said rules, in rule 101, in sub-rule (2), item (iii) shall be substituted with the following namely:- “(iii) AIS-045, as amended from time to time, in the case of Quadricycles, E-rickshaw and E-carts” 8. On and after 1st April 2026, in the said rules, in rule 117, in sub-rule (1), the words “or an E-rickshaw or E-cart or a vehicle” shall be omitted. 9. On and after 1st April 2026, in the said rules, in rule 117, after sub-rule (1), in the third proviso after the words “thirty kilometers per hour” the words “excluding E-rickshaw or E-cart” shall be inserted. 10. In the said rules, after rule 125-Q, the following rule shall be inserted namely:-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “125-R. Specific requirements for E-Rickshaw and E-carts. - On and after 1st April 2026, all manufacturers of E- rickshaw and E-cart, as part of the type approval procedure, shall undergo an audit of their manufacturing facilities and process, to establish quality control. The audit shall be done by the test agency, undertaking the type approval process of E-rickshaw and E-cart. Provided that for a manufacturer possessing a valid IATF certification or equivalent, the scope of audit shall be limited to document verification only. (2) All e-rickshaw/e-carts manufactured on or after 1st April, 2027, shall be fitted with lithium ion battery packs and performance requirement of the same shall be as per AIS-156 (Part 1) and (Part 2), as amended from time to time.
